Office Chair at Work Charge a 35% restocking fee when the chair we purchased was defective Elizabeth New Jersey

We bought a new chair through Office Chair and it took a month to get it. We received it and it was defective, foam deteriated worn looking and dirty.  We returned it in original shipping box within the 30 days we had it.  They denied they got it back, we had to prove to them they did through FedEx, but they insisted on lying about it until they couldnt any longer.

They wouldnt refund but after some pressure from our credit union they refunded us 65% of what we paid saying it was a restocking fee.  They also told us all of their chairs were refurbished. No where on their website do they say this until you get to page 5 item 20 in their terms of service, small print. It is mentioned nowhere else.  The chair we received was defective and shoudnt be subject to a restocking fee at all.
