About two years ago we were late on a payment due to becoming disabled. Our checks were returned by Option One and we were told that we would have to pay penalty charges and the payment would have to be by certified check or money order. (We have never submitted Option One a bad check.) We got caught up and began sending personal checks for the mortgage payment and Option One began sending them back and advised that they would not accept personal checks anymore.

We retained an attorney to work with them to no avail. Option One threatened forclosure and refused to accept certified checks. All the mortgage payments are currently in our attorney's office where they sit in limpo. Our credit reports indicate that we have not made any payments on our home for about a year and a half. We would like to refinance, but we can not because it looks like our house is in forclosure. How can we be in forclosure for a year and a half? Option One people have been very unprofessional and unethical in all of our dealings. I would like to be rid of them but feel that I'm stuck unless I initiate some sort of civil action against them.

I believe someone should look into their dealings and ascertain if they are following proper business procedures. I'm attorney indicates that she has never seen any mortgage company display such behavior.
