Hi my name is Reynaldi Paillan
I was in the market for a car in March 2014 so I was driving down West colonial and stumbled across Orlando Kia. I've looked around the lot and saw a 2007 Scion tc. I test drove it seemed nice but the the price was a little higher than what I was looking for. the sales representative said he would work with me and after negotiating for about an hour, we settled on 3000 down and 235 a month. I got proof of insurance and sign the paperwork, afterwards I left with my brand new car. 4 days later I got into a terrible accident. The car was declared totaled and I was told that my auto and gap insurance would cover the damages.
I asked the insurance company about my down payment they told to talk to my dealer. I went to the representative who sold me the car and he told me once all the paperwork is done my $3000 would be returned to me. 1 month has gone by and still no down paynent. I spoke to same representative and he told me that financing was working on it. I also ask to speak to financing but they wont let me saying they were to busy seems kind of fishy. 2 months has gone snd then they told me I would not get my 3000 dollars down payment back. Then I asked them what can they do for me because I'm out of 3000 and no car to drive.
They said nothing. I'm writing this report because I don't want to see other people get scammed like I did. My lesson is to do your research read the fine print and ask as many questions as you can. Also have someone you know that is in the car buying business to look at your contract for secound opinion. I think would have been better business is to work with me to find another car that I like with the same deal. If they were truthful in the beginning we could put our heads together and get this issue resolved. But instead the would lie to keep me away from the people who knew the truth. For what reason I dont know but thats why i called it my worst car buying experience ever. Thanks Orlando kia west.

I made a mistake of being too excited to get a new car to do the right research and make the right decisions you're right I should have done better in the process but the problem I had with them was instead of telling me the truth in the beginning and not lying to me for 3 months we could have resolve this issue together if they were up front and help me in maybe I wouldn't be writing this report right now also I was stupid enough to trust only one source I learned my lesson for the future thanks for the reply.

I think you need to go back to your insurance company and renegotiate the payment they have made for the vehicle. Once you buy the vehicle and you have an accident the insurance company is to pay the damages under the terms and conditions of your coverage. Fortunately you also had GAP insurance.
No auto dealer refunds the deposit. The deposit was part of the payment you made, along with the financing, to pay for the vehicle.
Did you have a public insurance adjuster to help you with your insurance claim? If not, consider getting one. It sounds like your insurance was either inadaquate or they didn't pay you all that was due to you under the policy terms.
