Ox Floors Coating Damaged Pool Coping and Deck Resurfacing Job Delaminating Stuart Florida

Signed pool deck resurfacing contract Jan 12, 2024 paying 50% down. Work done in March. Foreman reported 'wrong sealer was put on truck' and he was very upset there were inconsistent shiny/dull patches all over deck. In process of attempting to make surface consistent on a future visit, worker chipped several pool coping bricks in large patches. Upon lead foreman being sent to evaluate and correct what he could, promising to identify/vet/refer/pay a brick repairman, paid another $12.5k March 20, 2024, leaving a balance due of 6.1% on the contract total price.

No contract documents were provided until June 28 at 10:10am, despite salesman promise they'd be emailed and several phone calls to the business.

As months passed, material/installation problems became apparent: long surface cracks appeared as well as yellow patches and cracked/lifting (delamination) areas. I consulted with a highly regarded concrete resurfacing company who sent their owner to evaluate our deck and he wrote a lengthy report on problems and took a number of photos. I shared the report with the owner of Ox, asking how he wanted to address the issues.

When it became apparent Ox had no intention of repairing the faulty installation, I demanded a refund, which he refused. He then insisted because I'd not paid in full the 'lifetime warranty' was void. The whole reason we'd hired Ox over 'competitors' was their 'lifetime homeowner warranty' that transfers to a next owner for another decade warranty; I felt that was good value and worth the elevated cost being charged to resurface our pool. We need our pool deck repaired or monies paid refunded. We need others to know to not trust Ox's warranty and that they reportedly don't return contracts to customers (signed on tablets with salesman) yet the owner repeatedly insists we need to read the contract but didn't send it!

So we've a faulty/ugly pool deck, damaged pool coping when we'd just completed a pool renovation the month prior to signing Ox's contract, and we're out $26,795 so can't afford to hire another company to remove and resurface the deck.
