Mr. Banach accuses me of false accusations and rhetoric. Only after my rebuttal Mr. Banach offers the following third parties to verifications to his claims.

- Another driver injured and his car totaled because the trailer wheel fell off on the Richmond I95 By-Pass.( PLEASE KEEP IN MIND MR. 3-17-2007 Mercury Marine sent field technician Mark Anthony to Chesapeake Whalertowne to determine the problems. Mark Anthony tore down the engine and determined the engine problems also included a salt corroded power head. The proposed $4,000 power head repair was declined. The signed contract which Mr. Montano presented is accurate and states as-is condition, no warranty.( HERE IS WHERE HIS MALICE INTENT TO DEFRAUD ME IS, A SCARE TACTICK FOR ME TO GIVE HIM MONEY, HE ADMITS THAT ABRAHAM MOTORS HAS NOTHING TO DO WITH THE TRANSACTION BUT HE CLAIMS IT DID FROM THE BEGINNING BOATS SOLD ON EBAY ARE NOT BROKERED THEY ARE AUCTION AND YOU ACCEPT ALL RESPOSIBILITYS I WENT FURTHER EXTRA MILE TO GIVE MR. Mr. Montano steadfastly refuses to provide the name of the person or company who serviced the boat from 2002 to 2006 to support his claims that neither he nor Ms. Pitaluga had previous knowledge of the boat's trailer, electrical and engine problems. The statement that the engine had perfect compression was contradicted by the diagnostics performed by Chesapeake Whalertowne and Mercury Marine. ( MR. BANACH CALLS ME AFTER ALL THIS TIME AND CONTINUES TO ASK FOR MONEY, HE TOLD ME HE WOULD TAKE ME IN A COURTROOM IF I WOULD TELL HIM THE SERVICE HISTORY OF A BOAT THAT DOES NOT BELONG TO ME GET OVER IT.)


The Florida Attorneys General office and Better Business Bureau refuse to be involved because I signed a contract stating sold as-is no warranty. The issue is only actionable if I can prove they had prior knowledge of the needed repairs. Mr. Montano refuses to divulge where the boat was serviced from 2002 to 2006 to support his claims the boat was properly maintained and in good repair.( MY ABOVE STATEMENT CAN'T BE ANYMORE CLEAR THEN THIS ALL HE IS TRYING IS TO GET IS MONEY FOR HIS IMPULSIVE ANXIOUS RECKLESS BEHAVIOUR )

Having only the EBay feedback to negotiate with, I attempted to resolve the issue with Mr. Montano on multiple occasions without success. When all options were exhausted, I was disappointed to find out that I could not issue feedback after 6 months. I apologize to other EBayers who relied on Montanos positive feedback without having the benefit of my negative feedback. I waited too long while waiting for the full exntent of the damages to be totaled.( REMEMBER THE DATES UP THERE WHERE HE HAS ALL HIS CLAIMS HE HAD PLENTY OF TIME BUT ALL HE WAS TRYING WAS TO GET MONEY FROM ME)

I offered to settle for $1000 on 7/28/2008, after the accident and before the electrical and engine problems were known. Mr. Montano should keep his facts straight. Mr. Montano has ignored my pleas for financial relief as my expenses mounted to make the boat sea worthy.( HIS DATES DON'T MAKE SENCE THIS HAPPENS WHEN PEOPLE ARE BLIND BY THERE OWN GREED)

On July 22 2006
Ebay item 170008038639 was purchase by Steven

A deposit of 1000.00 dollars was sent to me thought pay pal, Steven Banach called me and said he was leaving Friday after work and drive all night and day to get to Miami Beach Florida the next day Saturday by the afternoon when he said that, I found that irresponsible and reckless.

He arrived and was rushing and anxious like somebody using a substance or something. After just talking with him for a few minutes I realizes this guy has no experience with boats and trailers, I ask him have you ever owned a boat before he answer NO.
We went on a sea trail to run the boat, him his son and I his wife wait with the owner of the boat at the dock it would have exceeded the weight limit on the boat.

When Steven took the helm he almost toss me and his son overboard no joke it look like Steven had never pilot a boat ever.
After the sea trail we put the boat back on the trailer and headed back to finish the transaction the bill of sale was given to both him and his wife and was read by both with the owner of the boat present he signed gave a cashiers check and proceeded to hook up the boat trailer to his Toyota truck.

He came unprepared to any situation that could come up on the road while traveling. I strap the boat down one of the trailer lights was not working he went and purchase some portable temporary trailer light and I install them with him I advise Steven to check the hubs and tires periodically to make sure they would not get hot and to look frequently back at the tires to make sure they were not riding wobbly that would be a sign of something wrong and off they went late it was night time already I thought to myself how can this guy drive 2200 plus miles with a ten year old son not considering the risk , even truckers don't take risks like that.

After 4 or 5 days later I get a called from Steven and claims that a tire had fallen off the trailer and it had cause a big accident just 100 mile from his home. I ask him if he and the others where ok he did not seem all that concerned with my question, he was just asking for 2800.00 dollars to buy a brand new trailer I felt that his irresponsible reckless behavior was the cause of this accident and lack of concern for others, but then he call and wants to negotiate for 1800.00 dollars I said to my self Steven is trying to con me for money while his insurance company is paying for all the necessary repairs or a new trailer and tow bills.
I flat out told him he was just wrong trying to defraud me.

Them he went on a rant childlike he contacted the Better Business Bureau of Florida lie to them saying that I had sold him a boat through my company Abraham Motors , they ask him to fax a copy of the contract from Abraham Motors been involved in the sale and he could not produce it they told him to drop his allegation that they where unfounded.

Them he contacted the Department of Motor Vehicles of the State of Florida and found that my company had never had any complaints what so ever furthermore again he could not produce a contract from Abraham Motors.
Finally he came here to slander my name and company reputation because he lies and tries to cons honest people like myself that was nothing but helpful to him.

Furthermore for all of you that will read this all the while Steven Banach could have tarnish my reputation on ebay right where it all began he could have given me a negative feedback and he never did that tells you his malice intent to defraud me and my company for money. Please I invite anyone to go to my ebay casadelmar21 and look at my feedbacks 100% and see for yourself who he was dealing with someone honest helpful with integrity.

See my fellow AMERICANS this story is about the men with buyers remorse, anxious, irresponsible, reckless, that lies through his teeth to get money from people then he uses and manipulates the system and family to post here in this site to conquer with him to further damage someone's reputation, Trick96 posted here and said they are from Miami Beach well Trick96 is from West Virginia and Steven has relatives in West Virginia but wont say what I did to them not enough man or woman to face one when they are accusing someone of wrong doing they don't have integrity or moral values Steven Banach is playing the victim just to get his way not enough to suck it up and face the facts.

I am still waiting for him to prove his allegations.
I find this site to be very helpful for those people that get RIP--OFF by individuals such as Steven.

I am glad I was not one of the victims of Steven cons but he continues to lie and tries to distort the truth to others we are going to start digging for answers.
The community and companies should be careful with this type of individuals that claimed to be victims but are nothing but wolfs dress in sheep clothes trying to discredit us if they don't get what they want.

In response to the alleged report filed against me and my company. I state that this is completely "false and unfounded". No contract was executed under "Abraham Motors".The buyer needs to present proof as of his allegation!.(A contract for the purchase showing who sold this boat to him). This issue was clarified by the Better Business Bureau in Florida, after the buyer gave false and innacurate information to such entity. Please know that the boat in question was privately owned by a third party, which is a close friend of mine. The sale was conduted personally, as a favor to the owner. Everything was properly inspected by the buyers during the transaction.
The buyers were rushing through the inspection and just wanted to get on their way back. They did not seemed concerned with minor details as they should have. The boat was "SEA Trialed" and accepted in "AS IS" condition. No warranties were given. The buyer overlooked the important details and accepted the boat, his wife and son approved of it also. He was impulsive and anxious during the transaction. He chose to drive all night and day, nonstop to Maryland.(1100 miles). Due to my 20 years experience in boating, I advised the buyer to frequently check the hubs and tires on the trailer. I felt that he should have more common sense, specially knowing that he was traveling with his wife and son. I realized at that moment that he was innexperienced and advised him to be careful. Common sense told me, that he was impulsive and irresponsible. He showed total disregard over my advise or reconmendation, not to mention wanting to get more money for what he created. I am fully aware of what I did. I do not agree with his nonsense. "People who play victims at someone elses cost". I also feel that he is slandering me. My name, address and telephone numbers are exposed. I will like to get this innacurate report to be corrected.

Osvaldo Montano is not to be trusted. I also had a problem with him but I don't want to reveal what it is because nothing can be done about it now and I would not want him coming after me.

All I want to say is don't do business with him. He is not a FAIR person.
