July 9, 2014 we (my disabled husband and myself) parked our van with a Washington State Disability placard displayed in the windshield in the Disable Parking space at our son's apartment complex. We also obtained a written PASS as  visitors from the Village at Lovejoy Apartment complex office.

We were allowed to park in the lot until 6 pm and then had to move another block away after that time. At 5:00 PM I moved the vehicle to the other  spot as required on the parking pass. We then continued our visit with our son. At 6:30 PM, I moved the vehicle BACK to the apartment parking lot and parked in the same Disable spot. Then we proceeded to move laundry and other items from the 11th floor apartment to the van. In between one of these trips, the Pacific Audit Solutions employee issued us a ticket at 6:58 PM for unauthorized parking. When we came downstairs with another load of items, I saw the ticket.

My outrage is this.... are there no protections for the Disabled?  We had a STATE placard clearly in view. Does this company totally disregard the disability protection act just to collect a buck?  We followed directions by moving the vehicle at the required time, but because my husband is totally disabled and could not walk a block to the vehicle, I moved it back closer to the door and parked in a designated Disable parking spot. This way my husband would not have to walk to far and we could finish putting the laundry baskets and other items into the van. AND we still got a parking ticket.

True the cost is only $39.00, but the point is does this company have the right to disregard the State and Federal Disabiltiy Act.
I am going to follow up with the State Department about this and this is an outrage and maybe they are in violation of State and/or Federal laws protecting the disabled. If anyone has any suggestions, please let me know. My husband may be disabled but he still has some fight left in him and we will pursue this.

Using disabled parking

How to use your disabled parking identification card

Keep the identification card that indicates you have disabled parking privileges in your wallet or purse. You must provide it to law enforcement when requested.

How to use the disabled parking decal

If you request a disabled parking tab and placard, you’ll also get a blue “Disabled Parking Privileges” decal. The use of this decal is optional. You may place this decal between the bolt holes on the bottom of the license plate for added visibility, as shown.

Who can use disabled parking

Anyone who qualifies for disabled parking privileges and has a disabled parking placard, tabs, or license plates may park in disabled parking spaces.

  • It’s illegal for anyone else to use your disabled parking placard, tabs, or license plates if you’re not in the vehicle. You can’t let your friends or family borrow them for their own use.

Where to park

  • You can park:
    • On the street, for free, in any parking space that is time restricted (including metered parking). This doesn’t apply to privately-owned parking lots or areas reserved for special types of vehicles (fire lanes, loading zones, etc.).
    • In any specially-designated disabled parking space.
      • Note: Van-accessible spaces are designed for use by wheelchair vans. Please use them only if you drive a wheelchair van or no other disabled parking spaces are available.
  • You can’t park in zones or areas:
    • Where stopping, parking, or standing of all vehicles is prohibited.
    • Reserved for special types of vehicles (fire lanes, loading zones, etc.).

How to report abuse of disabled parking privileges

Contact your local police to report individuals who are abusing disabled parking privileges or parking in a disabled parking space illegally.

Still think you'll lose your "fight."

I don't know about your state, but my handcap parking permit allows parking in Handicap spots and you're on your own elsewhere.

I would bet yours is the same..right??  I can't legally park by a yellow curb a restricted zone, a business I'm not patronizing or reserved parking, with or without my handicapped parking permit.  Even if I park in a handicap space and I don't get out of the car...the wife just makes a quick trip, I'm in violation of my permit.  Don't play the handicapped card as you are still bound by the law outside the handicap zone.

Let us all know how your "fight" over this comes out.  I would guess YOU'LL lose.  Use your permit properly and no problems.

Read the  back of your permit and/or the registration that came with it.
