All of a sudden this case showed up on my credit report. There was no disputed claims from AT&T on my credit report.

Palisades collection said that AT&T gave them the account and now AT&T would have no records, which I find hard to believe. I'm glad I ordered my credit report

Good for you! ..company messed up when they confessed there were no records left

Well, this Palisades company messed up when they confessed there were no records left. Use that to your advantage! You need to mail a letter of dispute to this collection agency and demand they prove this debt is yours; they need a note, contract or some other instrument bearing your signature to PROVE this debt! Send your correspondence via certified, return receipt mail. This provides you with proof they received the letter (very important!).

At this point, they have 30 days to respond. Ususlly collection agencies send a general letter stating they are "investigating" your claim. If, in 30 days, they have failed to provide you with PROOF of the debt thensend a follow up letter the same way you sent the first letter. Restate your dispute, and let them know that if they don't have proof then they need to cease reporting and collecting on this. See, in your case, thay have already TOLD you there are no records. This is going to make their job a heck of a lot harder isn't it?!

After the final 30 days, if they have STILL failed to prove this is your debt, you can file a complaint with the Federal Trade Commission as well as your State Banking Department. You also have recourse in small claims court to the tune of $1,000.00 for the offense.

GOOD LUCK!!!!!
