My wife and I paid Paolo Canfora Masonry & Tile $12,000.00 in advance for a contract to remove the existing driveway and patio at our home and replace it with a new driveway and patio. The $12,000 was paid by check in November 2008. This money was to cover the cost of material. Mr. Canfora began excavation of my driveway in February 2009. At that time Mr. Canfora requested another check to cover some of the labor and excavation costs. Another check for $5,000.00 was made out to Paul Canfora. The work continued at an extremely slow pace with numerous excuses given to me as to why he cannot work on my driveway. (A complete list of excuses are available on request). Currently, there is only a dirt (mud) driveway on the side of my house and the patio has not been excavated. There are other property damages that we have sustained due to the breach of contract and Mr. Canfora's failure to complete the driveway. We believe that Mr. Canfora's failure to complete our driveway has caused us to sustain additional property damages, as well as consequential and emotional damages; these damages directly arise from Mr. Canfora''s failure to complete the contract. An additional $476.15 was placed on my credit card, to cover the rental cost of a machine that Mr. Canfora needed to work on my driveway.

I offered my labor services on weekends to Mr. Canfora so the project would be completed. Actually, I did more work than he did and I want to be compensated for my labor.

Some of the work that Mr. Canfora did complete was not done the way we had agreed upon and I will have to pay another contractor to make the repairs.

During the delayed project, I had several conversations with Mr. Canfora. I found out that Mr. Canfora never ordered the material and that he had spent my $17,000.00 on his other bills.

Cost of home equity loan to cover the $17,476 that Mr. Canfora took from us.$6,000 to $16,000 This amount depends on the interest rate. If the interest rate rises above 10% then the costs will be much higher.

Picketing time (per individual) $200.00 per hour


Cost of replacing the bush that Mr. Canfora did not transplant correctly. $250.00. Instead of taking the time to dig it out correctly, he ripped it out of the ground and broke off the main root.

Personal property damages due Mr. Canfora's breach of contract

Damages to my basement due to Mr. Canfora's removal of the leader drain and not completing the underground drainage system out to the street.
