I wouldn't wish my worst enemy to deal with what we dealt with with Paradise Pool Construction and or Dale, Sandra, or Kelly Meske. It took them four months to do a two week job. Our pool liner had wrinkles in it. Got a leak for faulty concrete job. The side of the pool caved in because there was no concrete reinforcement used.

Filled the pool with dirty irrigation water. Charged us more than the contract, then try to add a back to the contract which we had never seen. When asked to see the proof of the extra charges, he slapped a lien on our house to force us to pay for the extra charges. We had to file a lawsuit so we could get the pool fixed and the lien off of our house.

We had to have all the concrete ripped out and redone, and we had to have the pool liner taken out and the bottom fixed. The guy who fixed it said it was the worse job he has ever seen. He killed trees and existing landscaping in our yard. This was a nightmare to deal with these people. We spent over $30,000 in over charges and legal fees to get our pool fixed. This company and the owners was the worse nightmare that we have had to deal with.

I reported to the BBB. They won't do anything. I did the research on this company before using them and couldn't find anything on them. That is why I am taking the time to write this, for people who take the time, and don't want to be ripped off from a company like this. Do not under any circumstances use this company.

WHO COMMITTED FRAUD JEFF KLINE AND COLLEEN KLINE OF EAGLE IDAHO?

#2REBUTTAL Owner of company

Fri, April 04, 2008

Since June 23, 2003 Jeff and Colleen Kline have been nothing but a pain in our behind. It was against my better judgment to build a pool for them, but I did it anyway. Please keep in mind as you read on that we have never had a customer like this one in thirty years. We have all our records and over 100 pictures of this job.

Paradise Pool Construction is a sole proprietorship owned and operated by myself Dale Meske and my wife Sandra Meske. We have never had a partner! Nor have we ever knowingly committed fraud to any of our customers. We have always tried to keep our customer happy and work out a solution to any problems that might arise.

Please feel free to contact us at ripoff.truth@yahoo.com for information about this and references. Some of our customer have used us only once and others repeatedly and exclusive. We have clients that will welcome you to contact them and other that want their privacy and we respect them for that.

We are proud to say that our swimming pools were showcased in the "2004 and 2006 BOISE, EAGLE AND MERIDIAN PARADE OF HOMES." Since 1977 we have been building the same swimming pool to the same, above factory specifications for all our customers.

Kelly Meske was sub-contracted by Paradise Pool Construction to excavate the pool and install the pool bottom base. Kelly Meske was independently contracted by the Kline's to relocate their trampoline and install their landscaping. The Pool Doctor was hired by the Kline's to winterize their pool.

Jeff and Colleen Kline residing at 569 N. Cove Colony Way, Eagle, Idaho. He is employed at Hewlett Packard and she is a Court recorder for the Idaho courts and has access to all the attorneys of Idaho including the law office we used.

On the front of our contract it reads "BUYER ACKNOWLEDGES THAT HE HAS READ AND UNDERSTANDS THE TERMS AND CONDITIONS OF THIS AGREEMENT INCLUDING THOSE ON THE REVERSE SIDE." And on the reverse side it reads, "ADDITIONAL TERMS AND CONDITIONS OF THIS AGREEMENT."

Under additional terms it reads, "ADDITIONAL WORK: Buyer may request Seller to preform additional work and if Seller is willing to perform same. Buyer agrees to pay Seller for each item Seller's actual cost of subcontracts, labor materials and equipment plus 25% for seller's overhead and fee. All sums for additional work shell be due and payable as the work progresses concurrently with the other progress payments. Additional work shall include but is not limited to (a ) any modifications requested by the Buyer, (c) work required as a result of non-apparent or sub-surface ground conditions such as ground water, hardpan, shale, rock or other like material encounter in installation which requires the use of equipment other then ordinary hand tools and power excavating equipment such as tractor type backhoe or trucks.

In 2003 Jeff Kline contacted us about building a swimming pool for them. I met with Jeff and his wife, Colleen several time at their home and on various jobs sites before they decided to have us build a pool for them. Then on July 22, 3003 I met with Jeff Kline to sign a contract to build a 21ft.X40ft.X8ft. deep Mountain Lake Pool. I left a copy of the contract with him and the other is retained at our office for our records.

I ordered the building permit, the steel pool kit from New York and called dig line. I then marked out the location of the pool per the Kline's blueprint, so I could begin excavating their pool when I had completed the jobs scheduled ahead of them.

First thing before we could start excavating the pool, Colleen Kline told me that she wanted the pool moved back and turned around. This took about 4 hours at no extra charge.

While excavating their pool we hit a fast moving high water table. After consulting with both Jeff and Colleen Kline, they agreed to the additional cost to remove the water and complete the excavation. I then proceeded to install the steel pool walls along with the adjustable a frames. I had to wait for concrete for the bond beam that runs approximately 8in. deep and 3ft. wide along the bottom outside parameter of the pool. Also because of the 3 bends in the top and the bottom of the 14 gage pool steel and the 14 curves in the walls of the Mountain Lake pool along with the concrete bond beam. It is virtually impossible for the pool wall to cave in.

Because of the national cement shortage, This was the first of many delays including inspectors, electrician, gas company and home owner. Colleen Kline couldn't make up her mind and kept saying, "I know what I want because I am so visual." She kept moving giant rocks, full grown trees and plants again and again. I was even afraid she would have me dig up the pool and move it again.

After all the delays we were able to installed the pool liner and turned on the water. Jeff Kline wanted me to pump the ground water into the pool. When I refused because the water was not tested, he put the hose in anyway. When I went to check on the water level in the pool Colleen started screaming and yelling at me about her pool. It didn't stop until I left. When I returned that evening with my wife Colleen apologized to her for yelling at me. Sandra just let it go.

When the pool was done it was beautiful. Even though the landscaping was not completed. The Pool Doctor was winterizing their pool while I was installing a winter cover they had ordered after the contract. When the pool was finished I presented them with the final bill. They refused to pay stating that we charged them for the extra work. After trying to contact them several times with no results. Unable to resolve the bill, we had no other alternative but to proceed with the next step in collecting the money owed us. Per the back of contract.

Jeff and Colleen Kline went through three attorney offices and two years of court filings, depositions and letters. Always changing their complaints about what was done wrong with their pool. Like we had not installed a concrete bond beam. We have photos showing concrete coming out from under the pool wall. Also that we caused damage to their deck and caved in the pool wall.

In May of 2004 Jeff Kline called the office and asked when we were going to fix the pipe that had broken after it had been winterized by the The Pool Doctor. He stated that he was losing a lot of water and it was causing damage to his deck and pool. I told him to call the company that winterized their pool and turn the pump off. When their pool was winterized they did not stop the water from flowing into the pipes allowing them to freeze and break, thus water flowed under the deck around the pool causing it heave and break. We have about 100 pictures of their yard and pool proving that THE POOL WALL DID NOT CAVE IN.

Colleen Kline states in her report that "We spent over $30,000 in over charges and legal fees to get our pool fixed. This company and the owners was the worse nightmare that we have had to deal with."

When all else failed to cheat us out of our money. They went after our LIABILITY INSURANCE for LANDSCAPING AND DAMAGES TO THEIR DECK. They were awarded $28,500.00 and our final bill and expenses for over $20,000.00. They never paid any over charges.

You should have paid your bill and went after your landscaper and pool winterizing company for the damages to your pool deck and not us. NOW WHO COMMITTED FRAUD?

We look forward to hearing from all of you and maybe even build pool for some of you. you may contact us at our e-mail address. ripoff.truth@yahoo.com or Dale and Sandra Meske, Paradise Pools, Boise, Id. 83709 208-794-2020 We are proud of who we are and we are proud of our company.
