Complaint Review: Paul Moyer Extreme Auto Plaza

Paul Moyer, Extreme Auto Plaza Ripoff mis-represent a vehicle to me in stating that the vehicle had only 40,000 miles on it and after the sale and driving half way back to Kansas I figured out how to show the odometer and the the vehicle had 52,000 miles on it his response was that he didn't look at the mileage Des Moines Iowa

Paul Moyer, Extreme Auto Plaza did in fact mis-represent a vehicle to me in stating that the vehicle had only 40,000 miles on it and after the sale and driving half way back to Kansas, I finally figured out how to show the odometer and the the vehicle had 52,000 miles on it. After contacting him his response was that he didn't look at the mileage.

Paul Moyer and Extreme Auto Plaza misrepresented a vehicle to me.

The vehicle, 2003 Chev Duramax Diesel, 4wd is still shown on Autotrader.com. It is listed as having 40,000 miles on it. After driving from Wichita Kansas to Des Moines Iowa to test drive the vehicle, he again stated that the vehicle had 40,000 miles on it. This vehicle has several different things on the odometer window, such as miles per gallon, how far until empty, driver preferences, etc. It is my opinion that Paul deliberatly did not show the odometer mileage to me, instead stating that he preferred to show instant miles per gallon instead. When I called him to express the extra mileage, he kind of just shrugged me off. It is now April 20th and I still have not received title for the vehicle so I can't even tag and drive the thing. I have contacted the Iowa State Attorney Generals office on this deal, for misrepresentation and for failure to provide title w/n the 30 day time limit as provided by Kansas State Law and per Iowa State Law. I would not recommend that anyone, especially out of state of Iowa, purchase any vehicle from this dealership. After reading other complaints on Paul Moyer, it is obvious to me that he is deliberatly misleading all consumers.

I live in Illinois and know that an odometer statement is required at the time of sale. I checked with the Iowa Department of Transportation online (http://www.iowadot.gov/mvd/ovs/selling.htm) and this is what is says:

Odometer Statement

A vehicle's odometer has recorded the number of miles driven. A statement indicating the number of miles must be given to the buyer, and it must be correct.

There is an odometer statement on the back of the Iowa Certificate of Title in the assignment area. The odometer statement must be completed. If there is no odometer statement on the back of the Iowa title, one can be obtained from the county treasurer or the dealer who is buying the vehicle.

If the odometer does not show the correct mileage, check the correct boxes on the form which state the reason the mileage is not actual.

What was checked on the Certificate of Title regarding mileage?

We did sell this truck to this customer from Kansas. This vehicle was listed on Autotrader with approx. 40,000 miles on it approx. 6 months before it was purchased from us. I told the customer that this truck was driven since the advertisement was placed. Neither of us looked at the mileage and there was no misrepresentation, as the customer had every oppertunity to check the odometer and if he didn't know how to turn it on, all he had to do is ask to see it, if he was that concerned as to the exact mileage. I would suggest in the future if mileage is a concern, that this customer CHECK the mileage on future purchases so there isn't any bad questions like this after the fact. The truck he bought did get the title sent out in a timely manner, as we did have to wait on the title, as we paid it off when we sold it and just had to wait on our bank GMAC to send it to us so we could send it out to our customer. This was our company truck and this whole process was not only explained to our customer it was also put in writing that the title may take up to 90 days. Instead he (the customer) had it in approx. 35 days. There was really no need for anyone to be upset in this transaction. Title was delivred as promised, in less days than we asked to be allowed for (which was 90 days).
