Bellezza Salon/Day Spa, owned by Paul T. Desan, sold a number of gift certificates for future services. The business waslocated at 27281 S. La Paz Rd. Suites A & B, Laguna Niguel, CA 92677. Several friends went together for my birthday on 1/16/03 and purchased one of those gift certificate in the amount of $275.00. I made the mistake of saving it for a 'pick-me-up' after the holidays. When I called to make my appointment, I was informed that the spa had been closed on 10/30/03. I assume the person answering the phone was Paul De San, but he did not identify himself. When I asked what I was supposed to do with my $275 gift certificate, he hung up on me.

My husband and I drove to the location on the gift certificate and discovered the spa was under new ownership with a new name. The new owners explained that they could not fully honor the certificates but that they were willing to offer one free service to try to build good faith and reverse the negative image established by the previous owner. While that was very generous, it would still mean a loss of $175.00.

We were informed that Mr. De San had opened a new hair salon called De San and Friends located at 23982 Aliso Creek Road in Laguna Niguel, CA 92677. We have not yet managed to catch him in person to pursue this further, but have been warned not to expect much if/when we do.

Marie, I just read what you wrote in 2003', and I must say, it sure sounds alot different then this one you wrote in 2004'.Anyway, I have a few things I would like to say.

First: If you would have read the Gift Certificate, it clearly stated, "If the Gift Certificate is not redeemed by the time a 12 month period expires from the date of purchase, an "Inactive Fee" will be applied and need to be resolved before the Gift Certificate will be honored".

It is california State Law that states, that if a Gift Certificate is not redeemed within a 12 month period,the business that issued the Gift Certificate,has a legal right to impose an "Inactive Fee", before it can be redeemed.

Second: Your Gift Certificate was purchased in December 2002'.

Bellezza salon & Day Spa was sold in October 2003'.

When the new owners purchased Bellezza Salon & Day Spa, they aquired everything that went with it, including the pendind Gift Certificates.

So why would the previous owner, ( Paul Thomas Desan) be liable after the point of sale?

Third: Here is your statement:

"On October 24, 2003' Mr. DeSan sold the Bellezza Salon & Day Spa, then moved less them one mile down the street to 23982 Aliso Creek Road, Laguna Niguel California, 92677, whereupon he reopened his business under the name of "DeSan & Friends salon."

DeSan & Friends Salon was opened in June, 1981, not October, 2003'.

Bellezza Salon & Day Spa was opened in April, 1991'.

Bellezza Salon & Day Spa was sold, october 2003'.

These are facts, they are recorded, and on record with the City Of Laguna Niguel California.

Mr. DeSan did not move less then one mile down the street, and re-open under the name of DeSan & Friends Salon, it wa salready open, (1981).

After the sale of Bellezza Salon & Day Spa in 2003', he continued doing what he had been doing since he opened DeSan & Friends Salon in 1981, and that was being the owner, and running the business.

Mr. DeSan, for over 50 years, is very highly regarded and respected in the Salon/Spa industry, and would never participate in any kind of unethical practices,that would disrespect and dishonor the industry that he loves.

Fourth: The use of words, "Fraudulant", "Scam", "Rip Off", & "Victimized", to descripe somebody, especially when they are false statements, and could be considered 'slander', and if you "Follow The Rules" like you say you do,then you would know not to make those kind of statements about somebody, unless you know for a fact they are true, and you have the evidence to prove what you say, otherwise you might find yourself in a little bit of hot water.

So the next time you want to get on the internet and rant about something or somebody,make sure what you say is fact, and not coming from emotion.
