On December 21, 2002, my son purchased a gift certificate in the amount of $150.00, from Bellezza Salon/Day Spa, located at 27281 S. La Paz Rd. Suites A & B, Laguna Niguel, CA 92677. Bellezza Salon/Day Spa was at that time operated under the ownership of Mr. Paul Thomas DeSan. I was the recipient of the above-described said gift certificate, as it was a Christmas gift to me from my son. Despite the fact that according to California law, there are no expiration dates on gift certificates, this certificate expressly states an expiration date of one year from the date of issuance.

Since I am a person who follows rules, on December 5, 2003, I telephoned the salon in order to book an appointment so as to utilize the services offered with the purchase of the certificate. This is when I initially discovered the scam in progress.

On October 24, 2003, Mr. DeSan sold the Bellezza Salon/Day Spa, then moved less then one mile down the street to 23982 Aliso Creek Road, Laguna Niguel, CA 92677, whereupon he re-opened his business under the name of DeSan and Friends Salon.

Mr. De San is refusing to honor and/or refund the monetary value of gift certificates which are still valid. In addition, during my investigation of this fraudulent act, I was able to learn that there are countless numbers of people who have also been victimized by this scam, including the police officer who came to my home to take my complaint against this business. Last year (December 2002), this police officer also bought a $150.00 gift certificate from the Bellezza Salon as a Christmas present to his wife too.

Marie,

First of all, if you would have read the gift certificate, it clearly stated, "If the gift certificate is not redeemed by the time a 12 month period expires from the date of purchase, an "Inactive Fee', will be applied and need to be resolved before the gift certificate will be honored."

It is a California State Law that states that if a gift certificate is not redeemed within a 12 month period, the business that issued the gift certificate, has a legal right to impose an "Inactive Fee" before it can be redeemed.

Second, your gift certificate was purchased in december of 2002'.

Bellezza Salon & Day Spa was sold in October of 2003'

When the new owners purchased Bellezza Salon & Day Spa, they acquired everything that went with it, including the pending gift certificates, so why would the previous owner, (Paul Thomas DeSan), be liable after the point of sale?

Third, here is your statement:

'DeSan & Friends Salon' was opened in June of 1981.

Bellezza Salon & Day Spa was opened in April of 1991.

Bellezza Salon & Day Spa was sold in October of 2003'.

These are facts, and they on record, & recorded with the city of Laguna Niguel, in California.

Mr. DeSan did not move less then one mile down the street, & "re-open", under the name of DeSan & Friends salon. After the sale of Bellezza Salon & Day Spa in 2003', he continued to do what he had been doing since he opened DeSan & Friends Salon in 1981, and that was being the owner, and running the business.

Mr. DeSan, for over 50 years, is very highly regarded and respected in the Salon/Spa Industry, and would never participate in any kind of unethical business practices, that would disrespect, and dishonor the industry that he loves.

Fourth: Use of the words, "Fraudulent", "Scam", "Rip Off", & "Victomized", to describe somebody, especially when they are false statements, would be considered "slander", & if you "Follow The Rules", like you say you do, then you would know, not to make those kind of statements about somebody, unless you know for a fact, that they are true, and you have the evidence to prove what you say, otherwise you find youself in a little bit of hot water.

So next time you want to get on the internet and rant about something or someone, make sure what you say is fact, and not coming from emotion.
