My daughter is involved in a court issue and is charged with a serious offense. Early in Jan 2003, she needed a psychiatric evaluation and I was in a panic because this is a time sensitive issue. I was directed to Herbert Stewart of Pax Atlantic Marketing. Mr Stewart called me and by the questions he asked, I believed he was the doctor. He urged me to send him $6,000 (by Fed Ex, cost me $22. Also, I was forced to put a portion on a credit card and pay interest.) I had no statement or breakdown of services rendered.

After thinking everything through, I called and requested proper paperwork. I was shocked to find that only $1000 had gone to the doctor, $2900 went to Cross City Marketing fees and $1500 went to another referral party.

Mr. Stewart listed on the statement that $1600 went to the doctor when in fact it was only $1,000. My sister works for a group of psychiatrists and when she showed them the paperwork, they said that I had been ripped off and robbed blind.

After notifying Mr. Stewart, he sent me a letter stating that he would reimburse me on or around Aug 16th. I have written, left phone messages, but no response.

Another point is that I should have received a discount for paying. Thank you.

Blurring the Lines of Truth

In reference to Mr. Stuwart's rebuttal, I would like to clarify a few discrepancies. Mr. Stuwart did not handle our case in a proper and professional manner; he did not provide my wife and me with an up front statement breaking down services and costs. Over the phone, Mr. Stuwart convinced my wife that it was absolutely crucial to immediately send a check payable to Herbert Stuwart in the amount of $6,000,(dated Jan 8, 2003.) Later on, she requested and received the statement(dated Feb. 10, 2003) and was shocked to find:

$1,500: Referrals
$2,900: Cross City Marketing Fees, Marketing and
consulting costs (i.e. phone, fax)
$1,600: Psychiatrist

We were under the impression that the psychiatrist was to be paid the entire $6,000; however, the psychiatrist was only paid $1,000 out of the $6,000; We have his (the psychiatrist's) statement to confirm this. When these facts were brought to Mr. Stuwart's attention, he sent a signed letter (dated April 30) stating that he would reimburse us for monies paid, except monies paid to the doctor.

We did not agree or promise to pay attorney fees as I had no paperwork and there is no possible way we could afford the large amount he told me. My small excavation business is very slow during the winter and early spring; they are the worst times for us to manage a large payment.

My wife and I very much resent Mr. Stuwart's inferences that we are failures as parents and that we are racially predudiced. The fact of the matter is that my wife knew we was not a Caucasian from the very beginning. We believe in judging a person by his character and never by his race or skin color. Like the majority of people, we are very much opposed to pulling out the race card when there is absolutely no place for it. Likewise Mr. Stuwart is not in the position to judge our success as parents. These accusations must have been made up for the sole purpose of reader sympathy and to blur the lines between what's true and what's not.

My wife has a complete file on this issue and I find Mr. Stuwart's rebuttal unbelievable. He cannot back up the majority of his statements and has not even bothered to acknowledge any wrong doing on his part. It is our sincere desire for him to fulfull his written promise to reimburse us for what is due. This will finalize this matter to our satisfaction, so that we will not have to resort to legal action

The facts as stated are completely wrong. The complaints contacted my office because of a legal problem of their daughter. I listened to their problem and suggested they seek expert legal/medical assistance.

In addition I suggested the need for a public relations campaign to counter all the negative press reports on the conduct of the daughter. They indicated a complete lack of knowledge or experience in this area.

They agreed to pay me to co-ordinate the gathering of the team. I of course required payment for my services and the complaints made a partial payment on my fee. I arranged for the daughter to be seen immediately by a world reknowned psychiatrist who took a great deal of time with the daughter and agreed to participate on her defense team.

To date the billing from the doctor far exceeds the payment made to me,in additon the fee paid to the Dr. was not as stated in the charges made. Because of the failure of the parents to honor their promise to pay attorney fees I had to cease all attempts at locating competent counsel for the daughter.

Understand the parents were out of state and out of their depths. The compliants refused to honor their promise to pay for the expenses of the medical/legal team. I spent a great deal of time with these people and consider anything paid to me as earned money and view your printing these untrue statements as libelous and defamatory.

Perhaps the parents didn't understand or appreciate the cost and value of the service needed to help their daughter in a very serious time sensitive matter. I found it susupiously odd that this problem only surfaced when they discovered I was not a caucasian.

They are trying to use me as a scape-goat for their failure as parents. I request an immediate retraction and removal of this untrue statement from the your web site.
