On 4/14/2003 I visited the Ebay Auction site looking for living room furniture. I found an auction from Payless Furniture, Inc. offering a 100% Full Grain Italian Leather Sofa, Loveseat, Chair and Ottoman. Ebay Item Number 2316745392. The auction promises free curb-side delivery of furniture within 7-14 business days from date of payment. They also offer in-home delivery for an additional $55.00. The auction had a "Buy It Now" option for $1,799.00.

On 4/14/2003 I elected to "Buy It Now" and be the "winner" of this auction. I also elected to pay the $55.00 in-home delivery charge.

On 4/14/2003 I authorized two separate payments through Paypal to Payless Furniture. $1,799.00 for the furniture and $55.00 for in-home delivery, a grand total of $1,854.00. On this date I also received confirmation of payment from Shelly Perry with Payless Furniture.

On 5/2/2003, (14 business days later) I contacted Shelly Perry asking for a status on my delivery as I had yet to hear anything from her. On this same day I received an email back from Shelly Perry stating that my furniture would be picked up from their warehouse and delivered to me the following week (5/5-5/9).

On 5/20/2003 I sent another email to Shelly Perry reminding her of the 5/5-5/9 delivery promise, and asking why I had still not received my furniture. On this date I received a reply from her stating that all deliveries had been put on hold until 5/16/2003 due to a small fire that occurred in their office during the same week that my furniture was promised to be shipped out. She also stated that they had begun shipping out furniture again, and that I would receive another email from her before end of the day (5/20) with a calendar informing me of my shipping date.

I never received a calendar.

On 5/23/2003, I received an email from Shelly Perry offering free coffee tables to every customer who had been waiting so long for their furniture, this included me. We were told to email her our top three choices from her website and that we would be getting them via UPS, not shipped with our furniture. On this day I replied to her email with three coffee tables of my choices. I never heard back from her on that, nor have I ever received a coffee table.

On 5/28/2003 I received an email from Shelly Perry stating that my furniture was scheduled to ship out on June 12, 2003 and that I would receive my furniture within 1-3 days later (6/12-6/16).

On 6/17/2003 I emailed Shelly Perry asking her why I had once again not received my furniture as promised. On this date she replied back to me informing me that the freight company FORGOT to pick up my furniture. In the same email she told me that she had spoken to the freight company and they would "for sure" be picking up my furniture for delivery that day (6/17), or the very next day (6/18), and promised that I would have it before the week was out (by today 6/20).

On 6/19/03, I emailed Shelly Perry to confirm that my furniture had been shipped out on 6/17 or 6/18 as promised. Shelly Perry did not email me back.

Again, on 6/19/03 I sent an email to Shelly Perry stating that I believed I was a victim of fraud and that I wanted a full refund, overnighted to me, by Monday, 6/23/03 or I would file fraud charges against her through the Memphis TN Police Department, and file fraud reports on her with IFCC, National Fraud Information Center, etc. This time Shelly Perry emailed me back. She stated that she would get with the warehouse and see what the status was on my particular order to see when she could get my furniture out to me. However, if I wanted a refund I would get it, but it's company policy that they wait three weeks before issuing a refund.

On 6/19/03 I emailed Shelly Perry informing her that three weeks was unacceptable that I wanted my refund within the next 5 business days. I had already waited almost three months. No response to this email.

6/23/03 Still no word from Payless Furniture.

I have been in contact with other people who have been a victim of Payless Furniture as well. Others were promised their money back, never got it. Never got their furniture either.
