I filed a claim with PayPal for merchandise I never got. They charged my credit card for $40.00 This is the response to the claim, What a rip off! I'll never buy another thing using PayPal again. Yeah, the last line is "your safe using PayPal"!

After careful review, we have concluded our investigation of the Buyer Complaint described below.

We have decided in your favor, however, we were unable to recover any funds from the seller's account. As stated in the PayPal User Agreement, recovery
of funds associated with a Buyer Complaint cannot be guaranteed.

Please know that we will make our best effort to recover the funds in question if they become available in the seller's account in the future and will take appropriate action against the seller. Such action may include
issuing a warning, a temporary restriction, or terminating the account.

Keep in mind that PayPal uses a number of factors to determine when to take action, including member complaints. Due to privacy laws, we cannot discuss
the details of any action taken. We hope you understand our policy and that it assures you that you are safe using PayPal.

Vivian,

Was this charge made directly to a PayPal credit card, or a Paypal debit card?

Or did you use an outside bank credit card to fund your PayPal purchase?

If you used an outside credit card not affiliated with PayPal, Debra has good advice for you.

If it was a PayPal branded card, you have a rough road ahead.

Was this payment for an eBay purchase?

You need to request all of the seller's name and contact information on whatever account recieved your money. Then I would rack up legal fees and take this person to court.

They will have to prove delivery of merchandise, or you will win.

Let them see what that $40 theft is worth. Then win the case and get a judgement that will get on thier credit report.

This is what it takes to deal with a scammer.

Call Your Credit Card Company

I have had this happen to me a couple times. Call your credit card company and dispute the charges. They are familiar with PayPal and thier policies. You do Not have to pay if you dispute the charges through your credit card company. Always use a credit card to pay when using PayPal for this reason!

I just wanted to let you know that since you have gone through all of the channels to get your money back with Paypal all that you have to do is get hold of your credit card company and they will issue you a credit.

Paypal doesn't like it when you do this but hey you have to do what you have to do to get your money back.

I had the same thing happen to me. Just call your credit card company and they will let you know what to do.

They have found in your favor and attempted to get the money back from the seller but the seller has no money in their paypal account. They even mentioned to you that as soon as the seller puts money back into their paypal account it will take your money back.

Your complaint should be against the seller, whom it looks like scammed both you and paypal by taking all of the money out of the account, so that you couldn't get a refund.

The first thing to realize it that PayPal is not really a credit card because PayPal is NOT a bank.

Credit cards are issued by BANKS.

Banks are INSURED by the FDIC. PayPal is NOT.

Thats wht real merchants who accept credit cards pay a fee to a processing company, and that processing company "holds back" a set amount of funds for cases like this that would enable the BANK to refund your money after doing a "chargeback" to the merchant.

PayPal is, at best, good for very small ebay purchases. Never use payPal for anything that you cannot afford to lose.

Stick with a REAL credit card from a REAL bank.
