Back in December 2001 I purchased a brand new 2002 Mitsubishi Montero XLS(The full-size truck) from Peachtree Mitsubishi on Peachtree Industrial. I traded in my 97' Jeep Cherokee I owed $10,000 they only gave me $6,000 for it so I had to roll the negative equity in to the price of the car in the end I paid $41,370 for this truck. The sales person asked me how much I wanted my car note to be we told him no more than $500.00 a month. He brought he manager over and they played with the numbers and I ended up with a $620.10 car note. Not the note I wanted but I got the car I wanted so I took my keys and drove off in my new car.

Now fast forward to July 2003 I was in downtown Atlanta and my truck was stolen. I called my insurance company to file a complaint. long story short, my insurance company was to pay a certain amount and my GAP insurance would pay the rest. I received a phone call for my insurance company saying that Mitsubishi wanted more money they said that the payoff was much higher. According to there records I purchased a Mitsubishi Montero LIMITED I told my insurance company I did not have a limited I purchased the basic model(cloth seats). One of the accounting personnel faxed me a copy of a WE OWE form that we signed, when we singed it there was nothing on the form. Someone had gone back and typed in things to be added to the car : Grill guards $700.00, Leather seats $1800.00 premium sound system $1000.00 Fog lights $550.00. We never agreed or said that we wanted these things done.

My thought are if I wanted all those things in my truck I would have bought the car I test drove (it was a limited and had all those things in it already). When this information came out the accounting department said that my car note was based on me having the LIMITED Edition which I did not have.

Is there anything (I still have all the documentation)I can do to get back the additional monies I paid out once a month for 2 years? Can I file a complaint or sue the company that sold me the vehicle and committed fraud against me?

I want to make sure Peachtree Mitsubishi hasn't done or will never do this to anyone else.
