In September of 2015, I purchased a car from Pett Autoway. It was a 1993 Lexus ES 300. I was a little scared, since this was my first car but the dealer assured to me that everything was fine and gave me a 30 days warranty with the car. Within the first week the car started showing transmission issues, due to the gears shifting incorrectly, causing jerking as the car accelerates.

I then noticed my RPM was not moving. I took the car to Aamco who told me to take the car back to the dealer saying needs to be fixed this can be dangerous .Amaco told me that there was a wire burning in my transmission. I called the dealership and had my father ride with me to take the car back. After days , I was told by the dealer nothing was wrong with the car and he'll explain the problem to my father.

My father and I get there and there's one mechanic there saying the dealer has not been there all day. When we finally got into contact with the dealer , he explained that the warranty was only for the transmission and engine , "if" it goes out or stop working , I was explained my side and how Aamco said this car needs to be fixed. I took the car to get an inspection to at least put a tag on it , the inspector said he could not do an inspection because of my alignment.

I took the car to Michlean who told me the could not fix the alignment due to the very old ancient parts on the car and they recommend I take it back and get a refund, the car at this point is not safe to drive. I once again called the dealership who refused to hear anything from me. I tried contacting free lawyers , and received no help. When trying to get the car towed I noticed I had no title to the car . That is not the only thing I noticed , the car was due for tune ups before I bought it according to the manual. Also, the mileage on different documents including the car are all different. I never sign the second page of my bill of sale , terms and conditions page. I looked up more information on the dealership and the dealership had a fraud report.

The dealrership also stated that void my warranty once I had the car looked at, which was not on any douments I signed.

Yes, as seen , this was last year. I decided to cut my losses when I had to find another vehicle to be my means of transportation for college. As for the warranty , it was all on paper, did not say anything about me having a mechanic looking at it, well void the warranty. I signed the bottom of the page , but I did not initial or sign the final pages. I really can't do much without a title , so it's been accepted that I got one over me. This is just simply to inform those who want to make a car purchase to stay away from this place is all. This is very unethical and a representation of poor moral character. Thank you. Have a good day ! Lyman.

I don't understand why you would even consider purchasing a vehicle that is more than 22 years old.

Did you take it to an independent professional mechanic for a pre-purchase inspection prior to negotiating your contract? If so, what does his report indicate? If not, why not?

As to the warranty, is it in writing or did the salesman just tell you there is a 30-day warranty? If it is in writing, then pull out the warranty contract to see what is covered and what is excluded in the warranty contract.  If you have a verbal agreement, it is very, very difficult to enforce. This should have been your clue, in addition to the age of the vehicle, to walk away before you signed your name on the purchase agreement. The dealer can't amend a written contract with verbal statements.

Solution:  At this point, you have a signed contract (from your post) for the purchase of this old vehicle and you may or may not have taken out a loan to purchase it. If you have a loan on it, then make sure to make the payments until it is paid off so you don't destroy your credit.

If you own the car outright, just sell it. Take your losses early.  You could take the dealer to small claims court to see if you can recover if he misrepresented the vehicle to you, but it is unlikely to result in $$ to you unless you have the statements the dealer made in writing. Sometimes these lessons are expensive and it is just best to cut your losses.

Next time do your research before purchasing a vehicle. Stay away from such old cars, they aren't worth the repair bills in my opinion.
