In Nov. of 2008 we had run into financial difficulty.  So we clicked on the tab on the the website (www.mortgagequestions.com) that says: "Having Trouble Making Your Payments, click here"  That was the beginning of our nightmare.  We waited for a long time and never heard anything.  Finally they sent us a packet and we filled it out and sent it back by fax and mail.  Then after a while with no actions we called.  They stated that they had not recieved the packet and they sent another one.  We filled that out and sent it back also by fax and mail.  Still nothing.  After several calls we recieved another packet fedex to be filled out.  Only this was different, it seemed that if we signed it we agreed to give up our house the paperwork talked about forebearance.  So we called PHH and they said that we was turned down for their help.  However, they see that someone else has put a hold on our account under a different loan restructure.  My husband told them that he did not sign anything with anyone except for PHH. And did not sign or send back that packet that was fedex to us.  The only thing we applied for was either a loan modification and a lower interest rate or taking two payments and putting them to the end of the loan.  I like some of the others I have read about have also experienced, not being able to make payments online or through their speedpay (phone payment) which costs 15.00 everytime you use it.  My husband called the other day and they stated our house is in foreclosure.  Here is a few details of our account that I pulled off their website.


We have recently received monies from you that require manual processing. The total payment amount of $600.00 was received on 10/20/2009 and was applied into a suspense or holding account.

Now you can see that on 08/19/09 we was told we had to make the two months payment.  So we paid those.  We still could not access our account online.  Now we are being told that if we don't make a lump sum payment by 10/31/09 they will foreclose and we will not be able to pay on this mortgage.


We use bill pay through our bank and it takes PHH 9 days to post the payment to the "Suspense" account.  Whatever, that is.   As our money sits in suspense that is more interest we are paying.  I really do not know what is going on and what is about to happen.  All I know is we are scared and we have paid these payments, but the kids and us adults have hardly any food in the house.  As we do not want to be on the streets.  When we bought this home it was under Fannie Mae.  We put 15% down which was a chunk of money for us. 


We are at their mercy.  But I tell you what they will play hell to get us out of our home.


Any help would be greatly appreciated

I believe this consumer because a realtor by the name of Jaynee Middlemiss in the Laconia,NH office deceived  me by selling me a home with a badly damaged ceiling which could cost from $10,000 to $25,000 dollars depending on the contractor, she did not tell me about the seriousness of the ceiling before I closed on the sale of the home.

My Issue with this company has been going on for approx. 5 years we have lived here for 7 years... We also had another home that we sold that was financed with PHH as well we lived there for appox 2 1/2 years and had automatic payments and never had any issues so we were loyal customers to this company and for approx. 5 years and two different houses we never even had a late payment.... However all of that changed approx. in 2009 and it is a very long heartbreaking story...

we are still in our home and have fault tooth and nail to keep it even though they have done their best to make it impossible for us, but somehow by the grace of God we are still here... Our problem began when I lost my job due to the poor economy and recession. I called them to stop the automatic payments and informed them of our situation. They were very pleasant and and informed me not to worry there were programs and that they would work with us. I to was to receive a packet we filled it out and sent it back talked with them on a weekly basis I had names and phone numbers with ext numbers ect they I had corresponded with we did everything they said and follow their instructions precisely and then out of the blue the next thing we know I get foreclosure papers in the mail.

I was frantic called them immediately and they had pretended that they had never spoken to me ever before informed me that my name was not on the loan and completely refused to help me at all. Something that I hadn't known was that the state that we live in if you are married both have to sign the papers even if both names are not on the load itself. So our loan was only in my husbands name even though I signed every paper he did.

We were forced into a load modification had to hire an attorney that worked for this company that claimed that they could help us to really make this long story short we paid them 3,000.00 to stop the foreclosure process they added 30,000.00 to our loan our payment went up and we are now paying approx 1650.00 a month for our mortgage.... They refused to help me in anyway we owe more on our house now than we did 7years ago when we bought it. Its been a nightmare!!!

They have us trapped I have tried and tried to get someone anyone to refinance with a lower rate but do to the issues and the laws no one can we struggle everyday and since we are considered middle class we do not qualify for any programs. Its been a long 5 years I am still jobless to this day and somehow we are scraping by even having to count pennies to feed my kids at times. This company has done everything in their power to take our house away and even though its been really hard somehow we have managed to make it work.

Everything we have is in this houseve our life savings everything!!! I just keep telling myself that losing it is not an option!!! Stay away from this company do your homework when it comes to mortgage companies do not trust just anyone one. I have left out a lot all the ups and downs to say the lease we have been though hell with this company but pray that someone anyone will benefit from our mistakes.... And please if anyone can help us we would so appreciate it God Bless....

I currently have a home loan thru coldwell banker as well, I have also had all the same issues you seem to have had with them as well I am like you I am also looking for solutions to the problem, they have messed up so many times and have cost me alot of money, they are difficult to deal with hoping to pay the mortage off early and never deal with them again.
