To Whom It May Concern:
Three years ago (2006) I spent two and a half years having work done by an individual named Phidias Cinaglia. Mr. Cinaglia and his operations, d/b/a (www.phidplates.com, www.phidias.com, Living Adventures, etc.) are deceptive and misleading and, at the very least, border on the criminal.
Allow me to explain: I have been a paraplegic for 28 years. Three years ago, due to degenerative ailments associated with my paralysis, I decided to purchase a new customized van with a wheelchair lift (my first). Since the van needed certain custom modifications to meet my handicapped needs it was recommended that I contact Mr. Cinaglia to complete these upgrades.
Mr. Cinaglia talked a good show and promised on near a dozen occasions that my van would be finished and delivered to me in Florida by a certain date. I have over 500 emails that corroborate any and all of my assertions. Mr. Cinaglia has a repertoire of excuses for not completing my project.
Two and a half years had passed and Mr. Cinaglia had not delivered on any of his promises to deliver the van to me completed. I was forced to travel to Salt Lake City, Utah and take possession of my uncompleted van. I found it in a horrible state of disrepair and cosmetically damaged. The quality of the work he did perform falls so short of professional that it is laughable. It will continue to cost me time and money to undo the damage he has done.
Mr. Cinaglia is a fraud, a con, a liar, and a charlatan. I would urge anyone who should be unlucky enough to hear his name to steer clear or, better yet, run! If he has no scruples about mistreating and cheating a disabled person, he will certainly not think twice about acting unethically, immorally and/or criminally with the public at large. It is my contention that this individual suffers from a malady of mental conditions that allow him to justify his mistreatment of me and anyone else that he can entice into his web in order to defraud.
I was conned by Mr. Cinaglia for tens of thousands of dollars, and time that I will never recover. I regret the day I ever heard his name and hope that this correspondence reaches anyone else before they become a victim of this person. I will be filing complaints with the Utah State Attorney Generals Office, department of consumer affairs and the Better Business Bureau in order to protect as much of the public as possible.
I am, through innumerable emails, unintentionally linked to his CTIS (Central Tire Inflation System) concept. If I discover that he is marketing, selling and/or installing this system I have been advised by my legal council to sue in order to prevent any liability to myself.

Rather than take the time to reply, I decided it was appropriate to cut and paste my last rebuttal (See Below). It says everything that needs to be said.
It is not worth my time to address Mr. Cinaglia's rebuttal, except to say that the facts are the facts.
I spent tens of thousands of dollars for a product that was never completed, on deadlines either given, or agreed to, by Mr. Cinaglia. Promises were not kept and deadlines were not met... period! I would love to speak with the witnesses he professes to have attesting to my satisfaction and his fulfillment of his contract obligation to me. Let us all wait with baited breath.............
Mr. Cinaglia did not deliver my vehicle. He abandoned the vehicle in a Ford Dealership parking lot in despicable condition.
He is correct in one regard; the decision to terminate the project was entirely mine. It was crystal clear after years of lies and deceit that he was not willing or capable of delivering on his promises.
I would love to sue Mr. Cinaglia to recover all the money wasted, but I am in Florida and he is in Utah. I simply would have been spending good money after bad.
If he feels that I am libeling him, then let him be the one to cast another stone and pursue me in a court of law.
Please beware this individual. I have no intention of removing what I have written in previous statements regarding this individual as long as it keeps the public-at-large informed of this mans character.

The really nasty man who made this false claim of "liar" about me - for work done EIGHT YEARS AGO, DONE AND COMPLETED AND DELIVERED... the really nasty man has STILL NOT FILED ONE COURT ACTION. His claim of course continues to haunt my online reputation - but he is simply using this never-remove-a-report environmen as an ongoing shakedown. He wanted more work than he contracted for, took back his equipment in anger - and has simply been holding my reputation hostage for five years now - ever since he discovered this site and their never-ever-remove-a-report policy. He expects me to SUE HIM or else he'll never remove this report! I have no claim against him. He paid for every bit of work that I delivered. BUT PLEASE NOTE - there is NOT ONE JUDGEMENT against me. NOT ONE JUDGEMENT for anything criminal or civil - even though the man has called me "criminal" in his posting. Not one penny has been paid, not one judgement has been entered against me. Yet this allegation still lives on here...

Not one action filed. Not one deposition taken. Not one receipt produced or demanded. Just years of screaming, charging, inflammatory and disparaging description - but not not one substantiated fact. My expenses from 2006 -> 2007 were well documented; Mr. Boswell received his money's worth, in my opinion. I choose not to personally attack Mr. Boswell... I believe that he chooses to personally attack me using Ripoff Report simply because he cannot nor will not produce evidence of his claims and is possessed by the mistaken belief that his words will somehow motivate me to pay off his blackmail attempts. Regrettable...

Five years ago I performed $30K of custom design and fabrication for Mr. Boswell. And delivered the product and all the components as promised. He chose to terminate the relationship and took delivery of the vehicle at the Ford dealership in Bountiful. I have witnesses to his satisfaction and my fulfillment of my contract obligations to him. Yet, THREE YEARS LATER - in 2009 - he chose to file the above rip-off report - and made these many bombastic charges that I was a liar and a criminal. Now, since he has not once file for ONE PENNY of recovery, and not one charge nor deposition has been filed - despite Mr. Boswell's pompous and impressive claims that he would immediately do so in State Court... all Mr. Boswell has achieved is to perpetrate a lie and a character assassination for the past two years. But of course that is the only achievement which he can expect - since there is NO LEGAL BASIS FOR HIS AWFUL CHARGES and there has been nor will be not even ONE FILING and not ONE PENNY of recovery. He has NO case, just vitriol and a complete lack of ethics to remove this awful slander no matter how obviously he has no legally substantiable charge.

Kimberly King broke into my house, grabbed keys from a wall and opened a storage garage where she remove property that, had she simply come when the house was awake, she could have had without violence. She is a physicalyl massive person, who easily threw me aside. It is a good thing that she left SLC and didn't return to my house after I allowed her to visit as a couchsurfer; the Salt Lake Sheriff's Department was waiting - and had in-hand witness statements from other Couchsurfers in the home who witnessed her home-invasion. I truly am glad for this forum to discuss her awful and pathological charges. She attempted to extort a thousand dollars from me to NOT post her lies on Couchsurfing and on RipOff Report.

Am in agreement with this report filing that con and charlatan are key operatives correctly describing Phineas Cinaglia.
As kindly as I can put it, he misrepresented himself on a number of points with meJames aptly titled him a liar and charlatan, and I would wholeheartedly concur.
Although I did not amass as great of a financial loss as James of Bonita Springs, CL, I too am out $325 never be recovered. I have a digital archive from Mr. Cingalia for a monetary agreement that he chooses not to honour.
I just wanted to go on the record that Mr. Cinaglia is not to be trusted, and reaffirm that it would be wise and prudent not to engage in any business practices with this person.

I am shocked that three years after the end of the relationship with Mr. Boswell, he chooses 2009 to publicly assault my character and the work I performed for him. My records show that over $30K of labor and retail-valued materials were delivered to him and received by him at the Ford dealership where we made the final delivery. His decision to terminate the project was his entirely. The reality is that, had Mr. Boswell had such a clear case to present, instead of simple character assassination... I think he'd have file his "charges" in a legal forum, three years ago - instead of simply shouting his charges, in a libelous way.
