I will only recommend to do your research about Phil Wasserman (aka) Phil Waters before you get involved with the financial service he is in. A company that thrives on giving advice only to make themselves money, not to the benefit of the clientelle.

Maybe you've been to one of his seminars at Ruth's Chris, Outback, Bonefish, or Flemmings The food is great, but swallow it and run! He talks about feeding the golden goose so the goose will lay golden eggs. Well, looks like Phil's getting fatter and another vehicle in his yard every day! At least someone is producing.

Maybe he'll recommend a hedge fund for a large sum of your money. You better check your statement at quarterly reports, because they might be negative. Did I mention he is a daytrader? No, not his money, YOURS. . .

I must tell you that this thread is a failure on your part and you must be very unhappy to have wasted close to an hour of your life with your responses. Do your homework before coming to class, sir, and things may workout in your favor. Oh, and who am I your asking yourself. Try this...google stockbroker fraud, you will see more lawsuits against stockbrokers than you will ever find against Phil W. But then you the misinformed don't have a clue to start out with.

My accounts with Phil W's firm have been SO successful,(average between 6-9% annually since 02) and not one penny in losses over that period. I think some of you are well advised to make an appointment with this guy and check for yourself.

An open letter to Churchlady and everyone

I have read some of the comments on here and just to make sure there is no doubt as to the incredulous statements continually being made by "Churchlady".
Mr. Wasserman is not now - nor ever has been - licensed to do business in the state of Utah. PRFS has ONLY dealt with fixed annuities so your argument of losing money is completely baseless and uninformed.
Obviously "she" has an axe to grind with Mr. Wasserman. So be it. Man up and talk to us directly! However, don't throw in a quote of scripture and act like it gives you the right or standing to think and write completely hateful comments. My grandmother could run circles around you quoting scripture and she never had an evil thing to say about someone over and over day after day month after month.
I am posting a copy of a letter sent by our local Big Brothers and Big Sisters. As soon as ROR attaches this letter, you will see this claim of "never heard of you" is one more baseless, uneducated and hurtful statement. And if you like at a later date, I will have another letter attached from the the Los Angeles chapter of BB-BS where underprivileged kids were able to go see LA Lakers and Clippers games because of his generosity.
If you wonder who I am, read the hurricane article posted as one of the PROOFs in this thread. I have seen firsthand his generosity to charities and to those in areas of disaster.
Rip off Report is an invisible platform. There are no binding resolutions to any complaint and is anonymous. Just yet another blog where anonymity gives strength to the uninformed.
None of us are perfect...however as the saying goes "let he who is without sin cast the first stone."
These "complaints" are only hurting the livelihoods of good hardworking people who work for Mr. Wasserman.

My name is J.L.
I was wrongly accused of a crime and facing life in prision.
All lawyers I spoke to told me to take a plea.
This was over 15 years ago-I was referred to Phil Wasserman-
who took my case-In representing me he took a lot of abuse from the State
But as was his reputation-he was fearless.
The charges were eventually dropped during trial when it was disclosed it was a case of false identity.
Today I have a family-good job-and a great life.
Phil Wasserman was well known for fighting corrupt judges and standing up for people's rights-the people here who disrespect him would have been the first to hire him if they were in trouble.
A lot of his practice was defending police officers-and fighting against judges and politicians-and I eventually met a lot of his other clients-He won dozens of jury trials-
Did he anger people while defending people like me?
yes he did-and I thank God for that-
Most of the judges he fought with were later thrown off the bench
If you believe that everybody charged is guilty and the government never lies or is wrong-then you probably believe in the tooth fairy.
This guy defended major league baseball players-was on national television-
and some insurance agents want to knock him so they can feather their pockets?
Only in America.
I saw copies of all the not guilty verdicts.

Read about that story and how that guy-chief judge of Tampa-was forced to resign and later investigated by the FBI .
Do I recommend this man?
Every day of my life-

I have known Phil for many years. Initially, I was hired by Phil to assist his accountants in reconciling his company's accounting records.

After completing the reconcilement of his company's accounting records, I observed Phil and his staff when they were servicing his annuity and life insurance clients. I quickly became impressed as I noted that his clients were satisfied with trhe services that Phil and his staff were providing. At that time I decided that I would ask Phil if I could become associated with his firm on a full-time basis because I too desired to help phil's clients. I wanted to be part of an organization that actually helped people. Since I had seen people lose alot of their life savings during the market fall for the 2000-2002 period, I noted that Phil was helping people with their finances so they would not lose any more of their hard earned money.

Over the years I have met hundreds of Phil's clients and I have seen many of these clients at functions, including Phil's birthday, and have noted that these clients liked Phil and his philosophies.

It appears that everyone is free game these days and that anyone can say anything about anyone, regardless of whether they tell the truth or not.

My name in Dennis Flanagan and I have known Phil for about three years. I know for a fact that most, if not all of the negative press about Phil has been posted by competitors that lose business to his organization or ex-employees that couldn't live up to Phil's expectation. Phil without a doubt is strong willed and demanding employer, but that does not make him a thief, nor does that mean that he fails to put his client's interests first.

It is funny that everyone who takes aim at Phil fails to mention the fact that he has served thousands of clients, of which 99% have had an excellent experience. Not to mention he has saved most of these clients thousands of dollars in market losses if not more in this turbulent economic environment.

I would advise those of you who think you know something about Phil to actually do some research. Call him, ask him questions, you will see that he is a pretty personable guy that is an expert in the areas of insurance and annuities. You don't hve over 500 agents and offices nationwide by ripping your clients off. By the way, research does not include entering someone name in Google. We all know that the internet and forums like this have become the bathroom walls of this century.

If you actually take the time to research Phil you will find, among other things, that he is constantly donating time and money to charitable causes, he has adopted a child, and he has helped thousands of individuals better their financial situation, but for some reason those aren't the items people want to talk about. You will also find that Phil is not a disbarred lawyer, he resigned. Someone needs to get their facts straight.

Recently, a prospective client of Phil Roy Financial called me for a reference; whether or not they should do business with the firm, and mentioned some of the things written on this site.

Curious, I browsed the site and came across a few of the filings on Phillip Roy Financial, and find it hard to hear some of the things I'm reading. I worked for the firm for several years and still maintain an active communication and friendship with Phil and many of his employees.

With my experience as a noted author (search for my name at Amazon) and especially as a frequent media commentator (Wall Street Journal, BusinessWeek, Fox TV, CNBC and many other outlets), it's highly disappointing, although not a total surprise, to hear some one sided views towards an issue or individual.

The fact of the matter is that Phil, his current team and myself serviced and guided scores of clients over many, many years. In any business where there has been this much volume of service, no doubt, there are going to be a few people that are not happy with what transpired, and in some cases, will go to great lengths to disparage with accusations that certainly deserve another view towards the issue at hand.

Especially in this hostile market environment, I still to this day receive notes and kind emails from people of Phil's firm that feel blessed and fortunate to be with the firm. Many are ecstatic at the results of their investments and are often referring family and friends. Furthermore, to point out an individual's past and use it against him is simply an unfair reflection upon the many, many people that have prospered as a result of doing business with the firm.

As with any investment, be sure to know the facts before jumping in, explore the pros and cons, ask plenty of questions and feel comfort in what you are doing... All elements that in my experience, Phil and his team are sure to patiently bring to the public at hand.

I know who villus is-an acquaintance of mine in the field is suing him-villius-he is an agent who badmouths other agents to roll their business-
This guy villuis does this to a lot of reps-he hasnt done it to me yet
because he really doesnt know me
but its not unusual in this field
he posts as someone from a different area
and uses it to try to get business
I don't know Phil Wasserman but I know a couple of his reps and they are great people
by the way
my reputation is sterling
so if villus wants to post his real name and info -i ll post mine-he can then file stuff about me and ill join the litigation group against him
Most stuff done against all agents and reps in this field-without anyone revealing their real names or info-is done by competitors
whats sad is it gives the whole industry a bad name
by the way
Im friends with the top producer in the life field-he gets the same kind of stuff
from competitors-jealous because my friend makes more money than them

I have been appointed with Phillip Roy Financial Services for twelve months. During this time Phil has conducted many training sessions regarding ethics and behaviour when dealing with Clients. He always stresses acting in the best interest of all people we come in contact with. I have never heard anything different.

You have to understand that Phil runs a business that moves hundreds of millions of dollars every year. When you do that much business you are going to upset someone. The articles I have read thus far sound more like his competitiors than they do disgruntled clients. As far as products go, Phil has shown numerous times that he represents the best, because that's what he wants for his clients.

Because some people tend to believe what they read, it's unfortunate these comments can be disseminated to the public who don't know who he is. Not only is this a man who has helped thousands of people in their retirement years, but this is also a man who gives both his time and money to causes benefiting others. He does this without expecting anything in return.

Is he a good business man? Of course! Is he paid well for his work? Sometimes. There are countless times he has given great advice where nothing would come back to him monetarily. He should not be criticized for his actions, he should be commended for his honesty and generosity. You can count him among the good people who earn a good living while giving back to the community.

An example? It's not necessary that I get into specifics, let's just say the cancer patient he has helped recently would differ from you and your comments about his character. As far as his business decisions go, you should ask one of his many clients about how he kept them from losing their pensions and how they are able to live the rest of their lives worry free. I'm a big fan of his, and will continue to be one, because I've seen first hand how many people he has affected in a positive way. I hope this helps some of you who will actually read this unfortunate comment.

Anyone considering doing business with Phillip Roy Financial would be better served going elsewhere. Spending millions of dollars on a lousy infomercial does not make one legit, and in this case even know what they are talking about. This firm will only sell the worst annuities out there with the highest and longest surrender charges, even worse then what was shown on Dateline. They also send out misleading reports and minipulate consumers into poor investment decisions using phsycological tacticts. I do not understand how the State of Florida can let this person stay in business, they most not care about protecting its senior citizens.

There are many other more suitable choices for people out there than the annuities they are offering.

I have know Phil for about 12 years and worked with him in a key role for a little over 6 years. As I watch the comments being made in this report I can come to only one conclusion. Someone with an axe to grind feels that somehow this can do some good for someone. I think Phil's comment on web sites like this becoming the "Bathroom Wall" is the most accurate statement so far. I believe these comments are absolutely meaningless and should be disregarded by any free thinking and fair individual. Phil has made any negative allegations known to all associated with him, clients and prospective clients included.

In the time I have know Phil I have seen his intensity, his energizer bunny work ethic and his legendary temper. Tough to keep up with him at times for sure. But what I have also seen is many families of employees being taken care of in bad times with incredible generosity. All employees in this firm enjoy free medical benefits, salaries higher than average for this industry or in this state. Tough to work for? For some faint hearted, yes. But, for those that want to be part of the best team in our business, well worth it.

More importantly! Our clients are very happy with Phil and the firm. I have seen many people taken out of harms way. I have seen many people, more than I would like, come to us too late to save them from devastating losses. All that we do is suitable by all standards and rules in our industry, which is thoroughly regulated.

We have told everyone to stay were they are if they are in good stuff and to get out if they are at risk. That's all... very simple. We and our clients sleep very well at night during these crazy economic times.

Is Phil very successful? Yes! But so are many employees and clients! That's what matters most of all to me.

Religion and ex-employees?

Wasserman talks a lot about religion and ex-employees. So far he has identified two people here as ex-employees (in his mind), this being the reason for their negative posts. If that's the case, why does Wasserman have so many employees that don't like him I wonder?

He speaks about God and ministers that his foes should seek guidance from. Is Wasserman so Godly?

As P.R. Wassermans' feathers get ruffled we see his true personality emerging. He's his own worst enemy and with his last comment we can surely see who is the mentally unbalanced one.

He is distraught that I copy and paste newspaper articles and dig up the past that he so desperately has tried to hide. He should focus his anger on the journalists, the courts, the judges and lawyers and all of his ex-peers that have shunned him.

P. Wasserman has received more than his share of second chances. He talks the talk about his good deeds but has he really delivered? The first sentence in all his advertisements begins with "Phillip Wasserman and Phillip Roy Financial Services, one of the nation's leading sellers of annuities and life insurance." Has anyone ever questioned if this is true? No, of course not, we believe everything he says.

I quote a media article from a year ago:
"A lawyer by trade, the Sarasota-based Wasserman, 49, resigned from the Florida Bar nine years ago while facing disciplinary action. The Florida Supreme Court found him guilty of charging excessive fees, failure to act with diligence, improper trust-account maintenance and even paying a disciplinary fine with a bad check."

"Wasserman also acknowledged that several members of his family were tied to the Chicago mob."

Is this an individual to trust?

"Mr. Wasserman is not currently licensed to practice law in any state. During 1996 to 1998 , Mr. Wasserman filed two separate Chapter 11 bankruptcy petitions and a Chapter 13 bankruptcy petition in connection with the loss of his law practice , all of which were dismissed. In 1995 , Mr. Wasserman was convicted of indirect criminal contempt of court for using profane language to a judge."

On another note, I don't know why he felt that he needed to give a definition of "Villus" on this site but I assume he was referring to my user name "Villius." There's two "I's" in there pal and has nothing to do with Villus.

So does the big Chicago mob boss know how to bake pizza?

An October 2004 St. Petersburg, FL Times article stated:
"In 1996, when Wasserman was suspended from the practice of law by the Florida Supreme Court and seeking bankruptcy protection from his creditors, he blamed his troubles on mobsters who feared he might be part of a plot to take over a Mafia family."

And what happened with Sportssports.com and Sportsend, Inc.? Google it folks and you'll see what Wasserman did there. You might find a synthetic fuels exploratory company connected to it.

Update: Wasserman's attorney, Anthony Battaglia, said the state has a "personal vendetta" against his client and Wasserman has filed formal complaints with the office of the inspector general regarding the conduct of the investigations. Wasserman called Antilla's column false, biased and unfair.

Another update: Wasserman called me to tell me more about his company. He said more than 800 representatives are now affiliated with him and that he's now a multi-millionaire and a major charitable donor.

No doubt Wasserman will again, as usual attempt to defend himself by calling me petty names. That's ok, that's his MO. He learned in life to bully and scare people away from him. Maybe that's the mob influence he speaks of.

The suit comes from a case where Stanley and Eleanor Weisman, multi-millionaires, sued Allianz Life Insurance Company over a purchase of an annuity. Wasserman was named as a defendant because he owned the Phillip Roy Financial Services firm, even though the sale was made by an independent sales representative.

The Weismans, who are also defendants in the suit against Hargrove, dismissed the suit against Wasserman and Phillip Roy Financial Services after Wasserman provided Hargrove and his firm with 30 days notice to dismiss their lawsuit or be subject to sanctions and money damages for filing a frivolous lawsuit.

Challenges presented themselves hour after hour, the biggest of which was how to get the much-needed water and ice to those who needed it most, including South Florida hospitals and senior citizens. Valenti Trucking provided the semi tractor trailers, which were in short supply, so that thousands of gallons of bottled water and other supplies could be loaded in Sarasota and transported to Florida's East Coast, initially to Westside Regional Hospital for disbursement to other area hospitals.

Sen. Klein then put Phil Wasserman in touch with John Benz, a hospital employee working with Broward County EOC. Upon receiving news that both ice and water were in short supply, Phillip Roy Financial Services professional money manager Mike Allen dropped everything to search the state for ice. At the same time, Allen answered dozens of calls from people who had heard of the firm's efforts, including requests for assistance from local senior citizens and retirees living in the affected areas.

Investor Beware When Schoolyard Bully Grows Up

Sept. 11 (Bloomberg) -- Remember the schoolyard bully? Well, he grew up, got an insurance license and today advertises himself as owner of ''the #1 Retirement Income Planning firm in the nation.''

Meet Phillip R. Wasserman, 50, the chief executive officer of Phillip Roy Financial Services, whose Web page describes the company as a Clearwater, Florida, ''empire'' that offers the services of financial advisers, registered investment advisers, noncommissioned stockbrokers and other experts. The firm draws more than 40,000 retirees and seniors a year to ''seminars around the nation,'' the Web page says.

All that may be so, but there's plenty the Web page doesn't tell. For starters, Wasserman has no license to sell stocks, no regulatory obligation to supervise stockbroker transactions and no registration as an investment adviser.

Don't blame him.

The stockbrokers who work in his office have licenses, and the out-of-town securities firms that employ them are supposed to oversee what their far-flung brokers do. Customers who sign up with Phillip Roy, though, might not grasp that the guy with his name on the door isn't the supervisor of the stock brokers down the hall.

And they might be surprised to know about Wasserman's past. A former lawyer, he resigned from the Florida Bar in 1997 after being suspended: The Florida Supreme Court said on March 21, 1996, that, on the heels of four previous public disciplines, fresh findings against Wasserman by a referee warranted two consecutive six-month suspensions and rehabilitation before he could be reinstated.

'Don't Blame Me'

Today, there are nine consumer complaints related to him or his companies that Florida insurance regulators are ''looking into,'' says spokeswoman Nina Banister. The Florida Division of Securities opened an investigation of Wasserman on March 14, says Richard A. White, director of the division. And Wasserman is a defendant in a lawsuit brought by an elderly Florida couple that is in settlement negotiations.

To Wasserman, the actions by the Florida bar, the consumer complaints and the regulatory probe are the fault of vengeful and ''crooked'' judges, ungrateful customers, jealous competitors and regulators who have taken ''inappropriate actions.'' (The Florida Bar Association once described him in a brief as suffering from ''the 'don't blame me' syndrome,'' pointing to the Bar Association, politicians and the Internal Revenue Service as the root of his problems.)

Corruption 'Crusader'

He said through his lawyer, Scott M. Bonavita, that he is aware of only two complaints with the Florida Department of Financial Services, and that no wrongdoing will be found in the suit by the Florida couple. As for his troubles with the Florida Bar, Wasserman says he was a ''crusader'' against corrupt judges whose outspokenness cost him his job.

''Several times, Phil sued and took on both powerful politicians and corrupt judges to his own detriment,'' Bonavita said.

He liberally makes threats of litigation, from a former client, to a lawyer he opposed, to Bloomberg News.

Bloomberg would be ''dead wrong'' to think he would limit his actions to a libel suit, he wrote in an e-mail on July 24. To the lawyer he opposed, Wasserman wrote in a February e-mail that court sanctions would be ''just the beginning.'' After the Florida Office of Financial Regulation opened an investigation of Wasserman earlier this year, Wasserman filed papers to start an investigation of alleged bad behavior by the regulators. His complaint is pending with the Inspector General in the state's Office of Financial Regulation. Bonavita said the probe involves Wasserman's hedge fund, the Phillip Roy Fund.

Offering Help

Wasserman says he has ''helped build retirements and safeguard assets for thousands of customers,'' the vast majority of whom are happy. He said through Bonavita that he and his ''lovely wife of 25 years,'' Diana Wasserman, have engaged in philanthropic work since 1985, and that he takes customer complaints very seriously.

Though he doesn't have a license to sell stocks, Wasserman has had a part in getting investors to put money in the stock market. William Kelleway, 64, of Osprey, Florida, for example, was among those at a Sarasota investment seminar run by Wasserman in September 2004. Twelve days after the seminar, Kelleway and his wife Ann visited Wasserman's suite of offices, where they were introduced to stockbroker Daniel Madigan.

The broker's advice that the Kelleways invest in ''just two securities,'' Annaly Mortgage Management Inc. and Impac Mortgage Holdings Inc., cost them $121,929, according to a complaint they filed with the Financial Industry Regulatory Authority, or Finra, on April 18. In the 11 months that they owned the shares, Annaly fell 29 percent and Impac 45 percent.

'Don't Want Reprisals'

Madigan, who at the time worked for both Wasserman and USAllianz Securities Inc., now known as Questar Capital Corp., had little to say about the case. Finra, known as NASD at the time, fined USAllianz $5 million in December related to supervisory problems. ''I just don't want any reprisals from Mr. Wasserman,'' Madigan said in a telephone interview. He is no longer in the securities business and declined to describe his current employment. Finra records say Madigan has never been fired by a brokerage firm, and that he left the industry in July 2006.

Investors who think they've been wronged by their financial advisers already have strikes against them: they typically are unable to sue in court because of mandatory arbitration agreements. Then, if they get to arbitration, they have less than a 50 percent chance to win, Finra data shows. Winners needn't celebrate: a study by economist Edward S. O'Neal and lawyer Daniel R. Solin released in June showed that ''win'' rarely amounts to being made whole.

A Misunderstanding

Of course, no one is thinking about that when brokers or insurance agents are giving the big pitch. Nor could they imagine the smiling salesman showing a hostile side.

After I contacted Wasserman to ask about the Kelleway complaint, he threatened the couple with a libel suit, says James Keeney, their Sarasota lawyer. The Kelleways became so frightened that Keeney revised the complaint with Finra, eliminating various assertions about Wasserman.

Wasserman's lawyer wrote to Bloomberg on Aug. 7 that the couple may have learned that Wasserman's ''policy'' is to take legal action against anyone who ''libels or defames'' Wasserman or his businesses. They then ''misconstrued this policy as an individual threat.''

But Wasserman wrote me in a June 14 e-mail that the couple and their lawyer had been advised that if the complaint wasn't revised immediately, ''legal action will be filed against them.'' That sure sounds like an individual threat to me.

'Acrimonious Conversations'

John Hargrove, the Fort Lauderdale lawyer who represents another Florida couple enticed by Wasserman's seminar, says Wasserman called his clients and ''had some very acrimonious conversations with them,'' after the St. Petersburg Times inquired about their case. The elderly clients felt ''intimidated'' by Wasserman, Hargrove said, ''and they are tough people.''

Investors willing to do a lot of research might have learned some of Wasserman's background before signing up. But they could never have anticipated that he'd threaten to make their lives hell if things went bad and they complained.

The regulators don't keep a database of bullies.

Isn't it easy for someone to hide behind the internet-when Mr. Wasserman was an attorney he wasn't gutless like the posting above-he called a corrupt judge crooked
on the record-he was sought to be disbarred for impugning the integrity of a tribunal-
he resigned under pressure from the bar-the judge he called crooked
resigned soon thereafter under FBI investigation
Mr. Wasserman represented major league baseball players-many law enforcement officers and fought against a corrupt judiciary and politicans-he was featured on many national telivision programs and has been eligible to practice law for many years but chooses not to do so.
In building a large and successful firm this is all some unknown person can come up with-come on!
Mr. Wasserman is proud of his career as an attorney-his amazing aquittal rate at trial-and the people he helped

I hope everyone realizes that this man is a criminal. He was disbarred from the Florida bar as an attorney over 10 years ago. He can't practice law anymore so it makes sense that he would go into a business where he can get his hands on other peoples money. BEWARE OF THIS INDIVIDUAL!

While there is no objection to the advice to be careful with your investments, it is given in such a way as to suggest that Phil Wasserman is dishonest, a thief, etc.

We have dealt with Phil for several years now with the result that our retirement funds are much larger and more secure than they were before Phil. Phil is a little scattered at times - too many projects at once. He also does not return his calls as well as he should. However, we recommend his strategies highly. Run them past your lawyer first if there is any question. And yes, he will make money. He does not work for his health.
This should be a win-win deal. Happy

While on a particular forum (Insurance Forum) was asked by a colleague if I knew anything about Phil Wasserman or Phillip Roy Financial being that I live in Saint Petersburg (same general area as Phillip Roy Financial). I had no idea, since I'm really new the insurance industry and only lived here for @ 5yrs.

So, I decided to research the name and business, and wahlah...here I am; Ripoffreport.com . I have no bias either way...whether for the accuser or Mr. Wasserman (Phil)...but his point about the location discrepancy does seem valid. Not to mention that I notice how the accuser knows Phil Wasserman also as Phil Waters. If that is his AKA name, usually a disgruntled client wouldn't know that... but a disgruntled employee, more than likely, would. Just my observation, for whatever that's worth.
