I had the great pleasure of speaking to three of their insensitive employees. I tried to reason with them. They were completely unreasonable especially the one that went by the name of SHANE. He hung up on me as I was talking to him. Classy. I tried to make a payment plan. They refused. I tried to appeal to their goodwill by explaining that my spouse is in the Air Force serving in Iraq and I was recently laid off from a government job. The lout named Shane threatened to tell my husband's commanding officer about this debt implying that he would suffer greatly if this debt was not paid off immediately. (insensitive maggot=SHANE)

It's not as if I was avoiding to pay it because I was already paying on this debt $50 a month because that's all we can afford at the moment. They wanted all or nothing right now. After pleading with them, they were "kind" enough to offer 2 payments of $250 a month. If I could barely afford $50 a month how would I come up with $250? In the end I had to bargain with them on their shoddy terms.

If I could afford a lawyer, I would happily see that their butts were on the street instead of gleefully harassing consumers from their comfortable chairs.

Pinnacle, you may have one this time but I know that karma is just waiting for the right moment to even up the score.

Believe me, I am quite convinced that there is a special place in hell for blood-sucking debt collectors where the devil himself calls each one personally to harass them for eternity.

I am sorry to hear about the collection agency treating you so horribly. We too are active duty AF and my spouse has deployed to Iraq twice. Just out of curisoty, why don't you use the Hazard Pay of $225.00 extra a month he is receiving for being in Iraq to just pay them off and get them off your back?

I can understand money is tight but the Hazard Pay should be extra because you do not get that unless you are in a hazardous region.

You also have the Soldiers & Sailors Civil Relief Act, take the other partys advice and look into that as well.

As far as discussing this matter with your husbands commander or shirt violates the FDCPA. They can leave a message with them but it is not okay to discuss the debt. In most instances the commander & shirt has a lot more improtant things to worry about and at most they will tell your spouse to fix the problem, which could be anything from showing a monthly payment is being made to if extreme financial issues and calls from several creditors, he may suggest credit counseling.

You should envoke the Soldiers and Sailors Relief Act if they attempt to sue you (seek a money judgement.)

The Act is to protect our military when stationed overseas. In a nut shell, if you are being sued or forclosed while you or your spouse is stationed overseas, you may envoke this Act so that the courts will NOT HEAR the case until the service member is returned (reassigned or seperated) to the U.S.

They are a collection agency, and they will take any amount as a payment. While they may not put it towards a settlement, they will accept the money. From what you have described, it sounds like they offered a settlement of 2 payments of $250. If you can only pay $50 per month, they do not have to accept this towards a settlement. But a $50 payment will still go towards the balance regardless.
