I signed up with Pivotal on 7/12/05. I signed a contract for two years and fulfilled the entire two years with no problems. In July of 2007 I went in to use the gym and the girl at the counter told me after scanning my card that my membership had expired. She said that I would need to sign a new contract to continue to be a member.

She brought out a half a sheet of paper and explained to me that I do not have to lock myself into anymore extended contracts since I did my two years. She said that all I would have to do is sign the paper and I would be month-to-month and could cancel at anytime. I signed. All the paper said was that my membership would be month-to-month and that the would do automatic debt from my bank acct. of $39.00 a month. No where on this paper did it say anything about giving them a 30 day notice.

That month to month thing lasted somewhere around 8 or 9 months and I decided to cancel it. I called them up and they referred me to a place called National Fitness. Claiming they handle all the accts. I call them up and they said that I would have to email, fax, or mail a letter to them saying I want my membership canceled. I had asked which way would be faster and she told me to email it.

I emailed the same day and a confirmation was sent about two days later. Now they usually debt my acct around the 14th or 15th every month. I canceled this around the 8th or 9th. I didn't hear anything from them after that. Until the following month when I got a phone call from someone at national fitness saying my acct was late. I explained to her that I had canceled my acct. She said that she knows this, but since I didn't give a thirty day notice I would still have to pay for another month. I told her that is wrong my contract stated nothing about a thirty day notice. She said the old one did. I told her that I had signed a new contract she said that that really wasn't contract, but simply just a reminder.

I fought for days with these people over this and still fighting with them. They have been very rude and also very threatening with the collection agency stuff. They said they were sending me, but I still have received any letter to indicate this. They said they require the thirty day notice because that's how long it takes to process the paperwork to cancel. Yet they had my confirmation done in two days. Not sure why they keep saying they needed a thirty day notice its not like they have a waiting list of people to get into this gym, they didn't have to get anything ready or replace anything when I left. This is a total rip-off and one money hungry company
