Pizza Hut Employee Grabs Customer by the neck & Local police won't file report Fairmont West Virginia

A close family member of mine was at the Pizza Hut location mentioned. She was being threatened by a certain girl at a football game before this. She left the game went to pizza hut and the girl that threatened her came in. She was leaving and walked by that girl and the girl pushed her. They exchanged words and the family member hit the girl.

She started for the door to leave and one of the employees came out from behind the counter, grabbed her by the neck and slammed her into the first door, then proceeded to take her through the second door push her out and tell her if she was 18 she would kick her a*s (this family member is underage) & apparently the employee is over 18. The local police department said this was okay because they were breaking up a fight....There was no fight at this time my family member was leaving the restaurant.

Another family member of mine contacted the restuarant expecting they would be somewhat understanding and concerned that their employee put their hands on my family member. The manager was extremely rude with her and told her that is their procedure when something like that happens....which makes me wonder what are the police for then...she then asked to speak with their manager...the General manager...They got on the phone with her and were extremely rude with her too...they advised her they didn't understand why when children fight it's always someone else's fault...She told them the fight wasn't any concern of theirs just that their employee touched her family member.

They then advised her if she wanted to file a police report she needed to contact the police and they wouldn't be there all night to file this report. They then advised her Good Luck getting one(an officer) to talk to you.

She has since contacted the 800 customer service number for Pizza Hut, filed a report and was advised someone would contact her in 1-2 buiness days. It's been 4 days and no one has called her. Does anyone know what steps can be taken?

There were words tossed and a fist thrown. The managers and employees need to take over and eliminate the problem. I'm not so sure you family member could hit someone and they not retaliate back. She did it to herself when she hit the girl in the restaurant. You will get nowhere with your argument. The employee did the right thing by breaking it up and seperating the parties we're discussing. You might get a free pizza but that's about it. You would have to file a law suite against the girl but I'm sure that wouldn't go far considering your family member was the one doing the hitting.

Leaving the restaurant after assaulting another patron. That is a fight. No, the employee should not have put her hands on your family member. She should've called the cops to deal with him and/or her. Age of either member involved is irrelevant. This is ridiculous. I agree, you should be grateful this family member is not being charged with assault.

OP - your problem is that you can't identify the wrong action the person at Pizza Hut did without identifying the wrong of the family member. In other words, would the dude at Pizza Hut grabbed your family member and tossed them out the door if they had not attacked the other girl? The answer is NO. How about taking the family member and kicking her a*s yourself - it sounds like that should have been done a long time ago by someone in the family.

If I'm management, I wouldn't be looking at discipline for the employee. I might be considering that person for Employee of the Month. What steps can be done.

1. Serious behavior modification of your family member up to and including a hellacious a*s-kicking.
2. A blessing your family wasn't brought up on assault charges.
3. Expect other people to handle your family members when they get out of hand.
4. Reduce the number of visits to Pizza Hut (optional).

on my post before the update, I forgot to state that ever since this has happened, I've developed a blister like sore on my lip, and some sort of rash traveling down my chin! Does anyone have any advise on a lawsuit?

My point is not that the "family member" was right or wrong...and that's not why I posted this here...It's not right that the employee put their hands on her as she was leaving and then told her if she was 18 she would kick her a**.

If it was your daughter, sister, niece or nephew that an employee touched, I'm sure you would be upset with the situation especially since she wasn't the one that started the fight. And, no, this isn't acceptable behavior in public but it's also completely unprofessional on part of the employee & managers, and a HUGE liability issue.

According to the coporate office that finally called back on Friday (11/9/2007) they were not happy with the situation. I will give more updates as they come with this "BOGUS" report.

I agree with the OP. Last week when I was in Pizza Hut in Pony, I kindly asked the man behind the counter for extra Pepperoni. He came from behind the counter and started stroking his p***s and saying "here's some extra pepperoni for ya". As I stood there in shock, he kept coming closer to me, until he was close enough to grab me by the neck, and force my head...not out the door like the OP, but towards his p***s. I didn't know what to do. I was in shock, so I let the man continue momentarily. Suddenly, the sheriff walked in. I drew back in disgust, but the officer still cited me for public indecency. I tried to tell my side of the story, and explained that I was just forced to do what was happening. But he wouldn't listen. It's true, the cops do allow people to place their hands on you at Pizza Hut....it sucks!

Perhaps if your "family member" was able demonstrate appropriate conduct while out in public, or at least stay out of public places if she cannot behave, then none of this would have happened. What exactly is there to file in a police report, other than your "family member" disturbing the peace?
