okay heres the situatuion.. I work at pizzahut almost every night. Im not a driver,so i park my car away from the store,but in my sight. its usually the next row of parking spaces about 20 feet(not sure of distance)or more,less this way im assuming that is is free of being hit by anyone.

1st incident-around may - june of 2005 i was working my usual shift. i didnt go anywhere that day other than to work and home it was sprinking rain out side,but all was well. i went home after i was through forgetting to inspect my car to make sure it was free of anything. the next day i go do some stuff and my first stop of the day i get out of my car and just happen to turn and look at the back of my car and guess what a fuc**** pizza hut customer has hit my car. They backed up into it busting the passenger tail light and messing up my bumper on the passenger side. I was pissed extremly. so i call the insurance company and report it as a hit and run,but i still have to pay the $500.00 deductiable which is bullsh**. just getting my bumper repainted and decals put back on it cost me $400.00. and to get another tail light was $60.00. so totaling 460.00

incident 2-superbowl sunday feb 2006 very busy night. jall i went was to work and home.customers comming in from everywhere. It wasnt raining or anything. A great night for business. i was there my normal superbowl hours from 12-8(i think i stayed untill 9)very exhausted. I clock out and go to my car, which is parked in another spot where i thought it would be safe from anything. i was wrong. Another customer hit my fuc**** car again on the drivers side back bumper. They left again without comming inside and saying anything. This time it cracked the paint down to the bumper and i couldnt buff it out,so i had to get it repainted again just after i got it repainted in june.I was extremly pissed more so than last time. So i went home calmed down. this time i didnt even bother with the insurance cause i would still have to pay a deductiable. IT cost me $480.00 to get it repainted again. this time i had to rent a car which set me back another $100.00

so im out $1040 because of customers hitting my car. When i went to work the next day i ask if pizzahut was paying to get my car repainted this time. I didnt get a answer. so i had to fork out the $480.00 plus the $100.00 to rent a car out of my pocket I think this is bullsh**. If a pizzahut customer hits a employees car and leaves, then pizzahut should pay for it if your insurance won't pay.
I think that pizzahut needs to reimburse me $1040.00 because of their customers ignorance. It is wrong for anyone to hit someones car and then leave.
if this happens again, i will take legal actions against pizzahut
if they donot offer to pay for it to be fixed
i have all recepts from where i got my car repaired each time.

Do you honestly believe that having Pizza Hut post signs that resolve them of any liability will prevent your car from getting hit continually?

Wouldn't a better solution (one that might actually work) be to park your car elsewhere and walk, take the bus, ride a bike, etc.?

If my car was allegedly getting hit every day, I certainly would take every effort to keep it off the premises!

gee.. dont you know what your talking about.. thank you for your thoughts on this matter.
and no my car won't be safe parked on the street.
customers should be more careful and not inconsiderate bast****.
if this happened to you, yeah you would be pissed as well..
pizzahut should post signs that say "we are not held responsiable for damage to personal propery"
but do they have these signs? no they don't
foodlions, other stores, other restaurants have these signs posted.
thats all i've got to say about this matter.

Insurance, Liability/Negligence and Law.

The ONLY party that owes for your damages is the inconsiderate idiot(s) that ran into your vehicle.
PH holds no liability/negligence whatsoever in these incidents. Neither PH or their insurance have any legal duty to pay you a dime.

If you were the owner/mgr of the PH and somebody made a claim like this against your insurance you would go ballistic and tell your insurance co not to pay a thing. WHY? because you as the business would have done nothing wrong.

If you decide to sue PH please let us know how that goes. I would love to see what both the PH attorney and the Judge have to say.

Hopefully, after the emotions of your ordeal fade you will understand why your thoughts on this are not realistic.

In the meantime, sounds like your vehicle would be safer parked on the street.

Its too bad you didn't get license plates numbers and call the police for hit and run. But I understand you were working and can't keep your eye on your car all the time.

I don't doubt your car was hit though and I don't think that you necessarily had to serve someone a bad pizza or bang their wife in order to be a victim of hit and run. My mother's car was hit twice in the same grocery store parking lot within a 6 month period (no, she doesn't work there, she was just a customer). Of course the cowards took off both times. Years ago while in college, I dated a guy who managed a pizza joint (not PH) and it was not an uncommon thing to hear about an employee's car getting backed into by some dumbazz customer. I have had near misses myself in many a parking lot. People leave the road and drive into a parking lot and all their I.Q. points suddenly go out the window and they just drive however they want. Its like they think a parking lot is a "neutral zone" of sorts, where its a "free for all", so to speak.

The suggestion about putting the forms and pens behind your wipers for the "crashing customers" to fill out was made in jest, I hope. Obviously someone who is gonna "hit and run" won't suddenly have a change of heart because they spy some white sheets of paper and a pen.

Of course you can sue the driver, as long as you can identify him and prove he did it. Why don't you make it convenient for the next person who damages your car. Print up some forms that request basic information such as name, address, phone, insurance, etc., and place them under the windshield wiper. Rememember to leave writing implements as well. This should solve your problem.

Now if your car gets damaged again, and the form isn't filled out, think real hard. Are you banging someones wife or girlfriend or boyfriend or husband? Do you owe someone money? Did you narc someone out? Did you give someone a bad pizza? Not that pizza hut realy has any other kind.

Methinks there's more to this story than meets the eye.

You think Pizza Hut should be liable for damages to your car because their customers caused this damage? You won't ever get a court of law to go for this,ever.Ever ever ever..

I don't think you can even sue the driver who did this when the accident occurs in a parking lot, much less your employer, especially when you are not even a Pizza Hut driver.

Honestly,it seems you have someone out to get you. Call any attourney and ask, they will tell you that Pizza Hut is not liable. They cannot control their customers faulty driving.

In my opinion, you need to get your deductible lowered on your car. It may make your premium increase, but as many times as you've been hit, it will be worth it.
