RIPOFF REPORT VIP ARBITRATION - SUMMARY OF ARBITRATOR’S DECISION

v.

Angry Victim of PlasmaCAM, Author of Report #1400186

 

PlasmaCAM, Inc. (the “Complainant”) through Ripoff Report’s VIP Arbitration Program has challenged the truthfulness of certain specific statements (each, a “Statement”) posted by Angry Victim of PlasmaCAM, Inc. (the “Author”) on the Ripoff Report website at www.ripoffreport.com at Ripoff Report #1400186 (the “Report”).  The Complainant denies the allegations. Author did not provide a response to this matter upon invitation. Therefore, in accordance with the Ripoff Report VIP Arbitration Rules (the “Rules) the Author waived their right to participate in this Arbitration. By submitting a Report on the Ripoff Report websites, the Author agreed that a dispute over this matter may be submit by the Complainant to the Ripoff Report VIP Arbitration Program.

In accordance with the existing Rules at the time of this Arbitration, the Arbitrator was asked to decide whether the challenged Statements were an opinion or a fact. If, and only if, the Statement was determined to be a statement of fact, the Arbitrator was asked to further decide if, by a preponderance of the evidence, to determine if the Statement was true or false.  If the statement identified by the Complainant is determined to be an opinion, no determination will be made as to that particular Statement because an opinion cannot be determined to be true nor false.

In this case, because the Author did not appear and participate in the process, the Arbitrator had only the evidence submitted by the Complainant to consider. The evidence submitted included Ripoff Report #1400186, Complainant’s Arbitration Statement, Complainant’s Witness Statements, and other supporting documentation (collectively, “Supporting Evidence”).

Each Statement appropriately challenged by the Complainant has been considered, together with the Supporting Evidence.  The Arbitrator determined that certain statements challenged in the Report were false. Therefore, according to the VIP Arbitration Rules, those statements have been redacted.

For many years, PLASMACAM has been selling their GoTorch CNC cutting machine via eBay auctions. Their advertised price was $2,995.00 + $500.00 for shipping. The excessive shipping cost was their way of covering eBay's 10% seller's fee, so the BUYER would pay that fee, rather than PLASMACAM paying it. However, that fee was NOT paid to eBay. On 9/11/2017, or perhaps a day prior, PLASMACAM raised the advertised price of the GoTorch on their website to $3,995.00, "marked DOWN from" $4,995.00. This was brought to my attention by another PLASMACAM table owner. I immediately went to eBay and found that PLASMACAM had dropped the ball and forgotten to change the price on their current eBay auctions. I immediately purchased BOTH GoTorch machines and paid for them with two credit cards. PLASMACAM immediately canceled the order, and checked a box for eBay claiming they were "OUT OF STOCK" on the machines and could not fulfill my orders. PLASMACAM has a warehouse full of these machines in a building across the street from their offices in Colorado City. They did NOT give me the option to wait patiently until their GoTorch machines were back IN STOCK. They just returned my money without any communication. You must have the advertised item ON HAND and ready for IMMEDIATE DELIVERY upon payment received. It is ludicrous for PLASMACAM to claim that they were "out of stock" on two items they were advertising for sale in eBay auctions. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)).  PLASMACAM RIPPED ME OFF! They are willing to sell me the two machines at their new price, with each machine fully $1,000.00 HIGHER than the eBay price of the machines I purchased as per the terms of eBay. PLASMACAM owes me two brand new GoTorch machines for the price of $2,995.00 each + $140.00 shipping each. They canceled my purchase under a claim that they are "OUT OF STOCK" on the machines, so I had better not discover that they are secretly selling them elsewhere, because if they are BACK IN STOCK then they can send the first two machines to ME! I WILL pay for them ONLY AFTER they are delivered, because I do not trust PLASMACAM as far as I could throw their twitching, burning corpses. I would not put it past them for one split second to send me two machines that are damaged beyond repair, and then refuse to refund my money, claiming that "[I] must have damaged them during assembly." I already own THREE of their machines. My plan was to use these two GoTorch machines when I travel, to go to car shows, craft fairs and other vendor shows where I could make my products on-the-fly for customers. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)).  PLASMACAM is, IN MY PERSONAL OPINION, the most shifty, dishonest, unethical, underhanded, flaky, untrustworthy, sinister, deceptive MULTI-MILLION DOLLAR CORPORATION I have ever had the displeasure of dealing with. I want to sue them INTO OBLIVION!
