PNC Mortgage Bankruptcy Division-Loss Mitigation Deceiving - - Unknowledgable - Class Action Suit should be made against these people! Miamisburg Ohio
I had to file Chapter 13 because my husband & I separated and wanted to protect my house and car, since its all I could really afford. I've been making payments, though at one point I fell into arrears while in bankruptcy but settled it all in January of 2012. A few months ago, I received an escrow shortage letter, which I normally do every year, but the amount was for almost 3500 dollars!! I know my property tax didnt inflate that high in one year! I called the Bankrupty Deparment, and they simply said "this is because you owed money from 2011". I said how is that even possible? What do I owe? They said "PMI"....I said "I have a Conventional Loan, there is not PMI on a Conv Loan"....they forward me to someone else....someone else says "Many times ppl in bankruptcy wind up overpaying so when you are discharged we run an analysis to see if you over paid or underpaid"...huh? Wouldnt you want to know if Im current or not, as much as I do. Now???
Fast forward a few months, since I refused to pay the new 2300 dollar payment vs my current 1966, I get a call from my lawyer who said theyd clear it up and that I should continue making payments until an investigation is conducted. This is what Ive been doing. Lawyers secretary says "Hi-the lawyers at PMC called and they said that since you havent paid your mortgage in 6 months they are ready to negotiate a lower term mortgage for you for the next 40 yrs" (I have 20 years left and they want me to sign this paper, so that I will be 80 when its paid off??) I said I have made all of my payments. I am even double paying my trustee at the moment because I owed PNC 7K+ to cure my back mortgage + any arrears. And they keep making payments to PNC. So I think they actually owe ME 2K right now.
I then called PNC where the head of the Bankruptcy Division, a nice (not really) lady named Felicia told me that she cannot tell me what 6 months they have as being unpaid. I said "this sounds illegal...if the bank is making a 'deal' with me to modify my loan to avoid forcelosure, and I am telling you I made payments, its as easy as telling me what I owe" She said that she can't divulge this information until the end of my bankruptcy and since Im in Bankruptcy they cant foreclose on me....oh really??? so does this mean I never have to pay mtg for the next 4 years? Felicia, this doesnt make sense.
My lawyer then tells me they should, by all means, tell me what I owe (they gave me permission to speak to the kind lady who was of no help at all)
I will wind up being foreclosed, or strongarmed into refinancing my loan (as their favor to me for being on time) for 40 years, and I am getting the runaround. I should be billing my lawyer, their lawyers for filing false claims, and a lawsuit at this time! What is wrong with PNC Loss Mitigation? How is it possible that I have an audit trail of every dollar, but 'our system doesnt go back to 2012'? How is this possible????

Today I wrote PNC again, in an effort to find out where my mysterious backpayments of 4286 are coming from which are claimed by Loss Mitigation (who says they cannot tell me why Im delinquent, just that Im delinquent, yet refuse to release the money I have been sending to PNC unless I write a letter of refusal). This bank is a complete scamjob. They have record of delinquency in 2011 yet cant tell me if they have record of a 4K Bank Certified Check that I have in my possession from 2012. These people are working my last nerve and if I get billed Im jumping on any class action motion filed against them because they are stealing from a woman who filed bankruptcy 13 to protect her home! What is wrong w/ these people I will never know. But honestly, something needs to be done about this.
