This company has rapidly and rightfully earned the bad name it has here. First they sent me a form letter stating that I owed them over $4,000 for a debt that I know is no longer valid. The SOL ran out on the thing over 2 years ago. I had also made arrangements with the original debtor to pay the principal and the interest was forgiven.

I requested a copy of my credit report from Free Credit Report and see where the original company had CHARGED OFF the interest in 1999. This pack of leeches purchased that charged off interest for pennies on the dollar and now wants me to pay them (who wants to bet that the original company filed this as a loss on their corporate tax forms and got credit for it, any takers?).

I pulled up the Fair Debt Collection Practices Act and reviewed it. I sent them a letter to either provide the ORIGINAL signed contract with the first debtor with a copy of the transfer to them in 1999, or a copy of the SIGNED contract I have with them. If not, CEASE AND DESIST. I know I sent the letter after their "30 day cut off", but in reviewing the FDCPA, Section 809, para C, I can't be held legally responsible for that. This is the 2nd company in this band of bloodsuckers who have tried this and I'm SICK OF IT. The first was a gang of rude, obnoxious clods from LHR. I expect this gang to do the same thing and sell it to another group of bloodsuckers.

I have this advice for anyone contacted by these people, and I use that term loosely. Check the Statute of Limitations in your state, pull up a copy of your Credit Report (If you have a charged off account on it, you can prove the SOL by the charge off date), and write them and tell them to prove it or shove it. If they keep calling and harassing, document and SUE SUE SUE. At a $1,000 buck a call, they'll get the message REAL QUICK.

Can I Sue for Medical Problems?

I forgot to ask. Can these people be sued for Medical Damages caused by their uncalled for harassment. I've had 2 heart attacks, one being a Major Myocardial Infarction where the medicos had to bring me back or I'd be taking a dirt nap right now. This undue stress is debilitating to say the least.
