Complaint Review: Portraits By The Bay Photography

Portraits By The Bay Photography company charged $4200 for photos worth $2000. Company tried charging taxes for each deposit made. I gave a $1,700 deposit (which is now lost) and then decided to use someone else, and they sent a letter from a lawyer stating they want payment in full even though I did not use their services. I found this company though the South Jersey Bridal Expo in Vorhees New Jersey. The company charged me $4000 to take 300 photographs of my wedding. They requested a deposit of $1,500 plus tax which they said was an even $200. So my total deposit was $1,700. The company stated that each deposit would be taxed, after arguing the company stated that I would not have to pay taxes for each deposit. About a month later I met with a reputable/well known company called Lindelle Studio and found that Portraits by the Bay was severly over-charging. Lindelle Studio charged me $2148.62 for 300 sets of pictures, plus all original pictures, 2 portrait pictures, and one large custom portrait, Dynasty Leather Album, and two parent albums. When I notified Portraits by the Bay, (Some time in February of this year) that I would no longer need their services they said no mention of further fees because the contract says nothing of the sort. The contract only states," In the event of a postponement of cancellation, the deposit is non refundable. This is pre-printed on the back of the contract and I was never made aware that there was anything on the back, (no initialing). About a month after my wedding I received a letter from thier lawyer stating, "The contract which you executed states that an additional $1000 payment was due sixty days prior to you wedding date of March 10, 2006. To date, my client has not received that deposit. Furthermore, pursuant to the contract, you were to pay my client the remaining $1000 balance on the date of the wedding. Therefore, in order to avoid protracted litigation, kindly forwar the balance due my client in the amount of $2000."

I am a very happy customer after using Portraits By the Bay for my wedding for both photo and video.  I am not sure the details of this situation but I dont believe it is a good reflection of the service you get if you hire Portraits by the Bay.  Jason is extremely talented and helpful, he puts all of your worries at ease and works hard to get you amazing photos.  I have had many people compliment my photos and ask for Portraits by the Bay's information since my wedding.  They are very talented, and I would highly recommend them over and over again.

Case of Buyers Remorse

#3REBUTTAL Owner of company

Wed, May 16, 2012

To whom it may concern:

My name is Arthur Morris I own www.portraitsbythebay.com a successful wedding and portrait company in Ocean county NJ with over 1,500 happy brides over the past decade. One of our clients in 2006 chose to go with a company which was much cheaper then ours and backed out of a contract one month before the contracted date and then tried to come after us for the deposit they had paid us already. In our contracts it is clearly stated that in case of a cancellation they are out there full deposit.

In the contract they signed: It is very clear... And in New Jersey sales Tax is 7% and would be charged to every payment if not included in the original invoice. Clearly this is a case of buyers remorse. As for (((REDACTED))) they went out of bussines and were bought by another company do to there poor bussines practices. I was told by the new owners of (((REDACTED` about this 1 year after this persons wedding. There Sales pitch: They would prey on eager young couples to save them money and I was assured that this would never happen again. Hopefully Jennifer got her pictures and is still enjoying them to this day.

Any way I tried reaching out to Ripp off report numerous times and got no response to this date. What do I have to do to get this fixed.
