Preferred Lease and Custom Built Systems (CBS) entered into an agreement on June 13th 2002. CBS wanted to lease $39,074.20 of Hon furniture. CBS received a 7 page fax spelling out the terms of the lease. We signed and faxed back all pages of the lease and Airborne Expressed the paperwork also. One of items required was a check for $2,949.24, which was for the 1st and last months payments and a $250 UCC filing fee.

The check was cashed on June 17th 2002. All was quiet until July 22nd 2002 when I received a FEDEX envelope with a new lease. The original term of the lease was for 36 months at $1,349.62 which comes out to $48,586.32. The new lease was for 48 months at $1,232.47 which comes out to $59,158.56.

The 1st problem wasn't the $10,572.24 of additional cost, but the length of the lease exceeded the time agreed to. So, we rejected the lease and called Preferred Lease to ask that they honor the original lease or return the deposit.

They said NO!

We were told that we weren't getting any of our money back! On July 26th 2002 my lawyer wrote a letter withdrawal of lease offer and demand for return of funds previously tendered with no response! So now Custom Built Systems will be Suing Preferred Lease for the return of funds.

During a phone conversation with Rob Kalinowski (Preferred Lease) I was told that he worked too hard on this and that I wouldn't get back any of my money. Our response was that we never agreed to the 2nd lease, and since they couldn't honor the 1st lease, what was the basis for them keeping our money. He, Rob Kalinowski, started to yell at me on the phone, insisting that I didn't give him enough of my financial information so this was the best he can do! We even called Quinton Berry, the principal contact according to the Better Business Bureau (BBB), and only sent into voicemail.

We still haven't received a response! I suggest you check the BBB web site to see they're propensity to commit this kind of act.

First and foremost they offered me a contract in writing. I accepted the contract and submitted the required deposit under the contract. After submitting the deposit, they changed the terms and refused to honor original agreement.

I rejected the new contract and they failed to return my deposit.

They stated that I tried to change the company from Custom Built Systems (CBS) to CBS Cyber Cafe. I did no such thing. The paperwork was always for Custom Built Systems and they never gave me any paperwork for CBS Cyber Cafe to sign. I am the sole owner and only stock holder in both companies anyway. The full name of the company is Custom Built Systems Cyber Cafe. The parent being Custom Built Systems.

The bottom line is that Preferred Lease - Capitalwerks did not honor a signed loan agreement and stole $2,949.24 from me.

What John failed to tell you is that he chaged the transcaction from a company that had been in business for 10 years to a brand new start up company and claimed they were the same company which they were not. He submitted an app under Custom Built Systems, but then wanted the deal done under his new venture CBS Cyber Cafe.

The deal was still approved but since he was changing it to a new comapny the bank wanted to see his tax returns, which is standard in financing situation and he was information that more finanical information may be required. He refused to provide the financial information the bank requried, so they would not proceed.

So we got him another approval at another bank, and he walked on that approval too. Preferred Lease did the job they were hired to do, he failed to provide the information required, and he walked away from two open approvals.
