Premier Bath, Premier Bathrooms, Inc. Rip Off the Elderly in Kansas City South Daytona Florida
My mom has arthritis and saw an ad for the Premier Bath so she made an appt for a salesman to come out. He sold her a $10,000 tub. And if I remember right that did not include installation. This all happened about a year ago. She was hoping my husband would install it for her. When I found out I was in shock. I told her that would pratically clean her out. She had written them a check for $1,000 down payment.
I asked her what kind of cancellation policy they had, and I don't think we could find anything on the receipt. She came to her senses about a week later and called them and said that she could not afford that and wanted to cancel. They told her they did not know if she would get back her down payment or not. They ended up just sending her a check for $500.
I just do not think this right. Has this happened to anyone else out there? If anyone ever hears of a class action lawsuit against them for this type of thing, please let me know.

Premier Bathrooms, USA, Inc. provides each customer with a copy of their executed contract at the time of sale. Contained within the contract are the terms and conditions including the Notice of Cancellation explaining that the customer has until midnight of the third business day after the contract is executed to cancel their contract. Should the customer cancel outside the three day rescission period, Premier is under no contractual obligation to return their deposit and may retain all or a portion of the deposit to cover the legitimate expenses incurred in fulfilling its contractual obligation to the customer. Despite the customer canceling outside the rescission period, Premier kept only the amount needed to cover their incurred expenses and refunded the customer half of their deposit in the amount of $500.00.
Additionally, customers in this regions are provided with a a separate Notice of Cancellation that they must sign at the time of the execution of the contract. This Notice, as required by law, again explains the cancellation policy and procedures.

The customer has until midnight of the third business day after the contract is executed to cancel their contract. Should the customer cancel outside the three day rescission period, Premier is under no contractual obligation to return their deposit and may retain all or a portion of the deposit.
Premier incurred legitimate expenses in an effort to fulfill its contracutal obligation to the customer, including but not limited to, administrative fees. Based on the fees incurred by Premier, we were able to refund fifty percent or $500.00 of the customer's deposit.
Additionally, customers in this region, as required by state law, are provided with a separate Notice of Cancellation that they must sign at the time of the execution of the contract. This Notice again explains the cancellation procedures.
