I had left the company giving my notice (what a mistake) they never paid me for my last 13 days of work. The reason for leaving was because in my signed contract they said after 90 days of work (standard in Florida) I would receive benefits, vacation days, etc. 90 days rolled around and they would keep giving excuses - It was just all a lie - I realized early on that they have done this to several people before. It amazes me that they are still in business. They would hire sales people for about a month and when they would get a lead they would fire them then take the lead away from the fired sales person, they also would receive gifts as payments from clients for their own house (which has been investigated). Every pay period rolled around and everyone would be stressed about receiving their pay or some surprise reason such as, they would tell everyone that we would get the rest of the week off for 4th of July never mentioning till later that we would not be paid for those days. They also have a clause in the agreement that says after 90 days I would get vacation days (not mentioning paid or unpaid) very shady.

The work force board has been contacted and is working on this, as well as my attorney, and (as of now) other unnamed agencies. Florida law states that if you are not paid your last payment and it has been over a month you can sue for 3 times the amount as well as attorney fees, and all damages such as bounced checks, etc. because of not being paid. They boss also crosses many lines with comments about past employers, past and recent CLIENTS, sexual orientation (f*ggot, d*ck in his mouth, hookers, etc.), race (she will be your n*gga), religion (J** them down) , there are no boundaries. These issues will also be included in another suit if not settled. I have several witnesses and signed affidavits to back this up. They are STILL IN BUSINESS! I am obviously not the only one either. They love to blame anyone who is fired or who leaves for everything that goes wrong. Feb. 29th is approaching (I know it will be a long process, but I have a solid case and will win). Anyone else out there who wants to join me can. I already have several witnesses past employers, investigators, as well as government employees. Call (((ROR REDACTED))) for help.

She stated that most companies pay their employees vacation after one year. Most companies, I have ever been associated with, pay after 6 months of working.

Call the Media on Brad and Laura ASAP

#23Consumer Comment

Hello Barry,

I still think Steve is at least trying to give you some good advice and at least you are aware of what he is telling you.

As far as the media goes, start calling the networks who's logos they have on their website. Call the local networks, call the newspapers, have a picket sign and contact anyone else they owe pay to. Get everyone there saying how disgusted they are not to have their pay. Mention how Laura has lied to you as well.

Laura Has lied, you still don't have your money. Laura, pay the man his money, NOW d**n IT!!!!!!

Brad and Laura it takes a special low life to not pay someone their wages.

Steve - Thanks for the information but that is no help to me - like I have been saying they have moved. They were evicted from their last place of business. I have been gathering information for my case - my attorney is not representing me - This will all be in small claims court. I have enough evidence and testimony's and witnesses to get 3 times the amount owed to me plus court costs and other fees such as bounced checks, etc. Not to mention the IRS. The postings on this site actually helped in my case because Laura actually stated that I was an employee. and on other rebuttals she referrers to others as sales or contractors. I also have emails stating she owes me, etc. Even if I do not get my money in the end they are in big trouble with the government

***Also, be sure to fill out and mail the SS# form right away to the IRS to determine your worker status W-4 vs 1099.

***Also, file a wage claim with the Wage and Hour division for your lost wages. FYI...They CANNOT pay you minimum wage if they promised you another rate of pay at hire. You are legally eligible to get what they promised you.

And, it is unlikely you have actually retained a lawyer as he would be doing these things, and his first advice to you would be to cease contact and stop posting here. Therefore, do these things for yourself. Do them today.

I should contact the media

#23Author of original report

Fri, February 15, 2008

I would love to contact the media - but Laura / Brad are no where to be found - look at their website no address (they did not even change the phone number that has been disconnected on the header of the browser page). I emailed them they will not give me the address to their new operations - very secretive (but look at the statements she had made in previous rebuttals "I have nothing to hide I have always been upfront and honest about everything") P L E A S E. The website does not have an address anymore ( the message makes it seems that there are "agent's" plural waiting in the massive office ready to help you.

I find it funny how they found money to move to a new office - how does that happen? I guess they moved in with all their financial difficulties and brought their $3,000.00 pure breed dog they bought recently. Took off over a month of work during the holidays because times were so hard they just could not work. I feel SO bad fr them they must be struggling to make ends meet.

They have some VERY BIG surprises coming their way, IRS, Attorneys, and yes maybe now the media. Who would you suggest to contact? I have over 5 witnesses and 8 testimony's now. If you know any local or national writers, news anchors, etc. please let me know. We can also broadcast on youtube, etc. I am also sure Microsoft would be happy to know of all the pirated software on all of their computers. Please do a search for Premier Home Show or Brad Huard in Rip Off Report you will find other complaints from other people. They also have several cell phones and credit cards with other company names on the card. They started paying us with one bank then moved to another. In the 5 months i worked there they could not find an accountant, health insurance, etc. - I never once witnessed a call, interview, anything to that tune.

After the 29th if I don't get paid I am going to spill EVERYTHING. I have so much documented evidence, and with others I have been in contact with it is unbelievable they are still in business. I think someone other than me needs to post on national builder websites all across the country about this company - If I do it - they may have something legal against me. But anyone else feel free to warn all potential victims of what is out there. It is a public service. I have filed with the bbb.

THESE PEOPLE MUST BE STOPPED!!

Barry,

Laura and Brad obviously aren't taking you seriously enough on your pay that is outstanding. Have you considered going to the news media? Sounds like your not the only one waiting for pay? If it were me I would have the media all over this and mention the racial and sexual remarks in the work place.

Tell the media too about your rip off report.....

Please keep us all up to date on how it all works out for you.

Good Luck,

Laura - Please STOP COVERING UP!

#23Author of original report

Tue, February 12, 2008

Please read Laura's Statement above under her entry "Misunderstood - Not a Victim" (that has been documented so if it changes we have copies)

"Unfortunately, benefits were something we were LOOKING INTO for employees and were not made available to ANYONE. (Exceptions, conditions, cost, and pre-existing conditions are what made the final desicion for us.) In time, maybe it would be something of a benefit to all. As far as your employment was concerned it was something that may be possible. We discussed it many times throughout your employment. YOU KNEW that we hadn't found anything acceptable and you didn't seem to have any issues with that."

OK case in point "benefits were something we were LOOKING INTO for employees and were not made available to ANYONE" Let's stress the word "employee" and re-emphasize it later with "employment" all in regards to "benefits" and "signed contract (I must emphasize not stating me as a contractor) - I was sent a 1099 when I filled out a W4 form - what's that about? I didn't have issues with it? Why do you think I left the company?

"As far as any back wages due to you, Mr. Barry Fader, we have been in full cooperation with all necessary and pertainent agencies to resolve any of our legal obligations. Of course in a timely manner."

It has now been 4 months - Even government people were told that a check was sent in the mail for the 13 day 10 day's regular pay 3 Day's minimum wage (they can do the 3 day minimum wage legally) - The check was never sent. They basically lied about sending it. Now after being sent a 1099 which is still not clear I am told I will only be paid for 1 week and 3 days minimum wage, but it is on the way - the story changes everyday. At first I was told that I would not be paid at all because of a printing mess up that happened after I left the company. Then they realized that the printing job was made after I left (proof of that) also witnesses made them retract this - besides by law it would not matter either way - they make excuses for everyone that leaves the company - NOTHING is ever their fault.

I was also threatened by Mrs. Huard by insinuating I was performing an unemployment scam - unfortunately she has NOTHING to go on because the company I started with after Premier had folded and I was out of work so I filed for unemployment - they ask what your last 2 employers were. I told them. So when they received forms from the workforce office they believed I was in on an unemployment scam - funny how peoples minds work.

Under Mrs. Huard's next statement "We are a company that has been very upfront and forth coming with time sheets, contracts, agreements, etc... We have NEVER tryed to hide anything either. Read all comments. Nothing is stated that isn't fact and in accordence with this response."

- I ask employee? not an employee? Benefits? No benefits? 1099? W4? We will pay you. We won't pay you? We have a check in the mail. We never sent it. Our toll free number has been disconnected and changed (we are a reputable business) and we now have no contact address on our website. UPFRONT? NOTHING TO HIDE?

"Our company shuts down every year from approximately Thanksgiving to the end of January of the new year."

- wow with such financial strain how can you afford to do this? Close the business down for over a month & no money - how did you survive - not to mention your employees?

"All to satisfy our agreements. We counted on those funds that were part of our agreement to get everyone though the holidays until we came back and started up all new business we secured to start after the nw year. When our agreements were due and payable to us, they bounced causing more issues. ALL EMPLOYEES WERE MADE AWARE OF THE SITUATION. We told them the truth, things were getting hard and we would/will take care of the situation a.s.a.p."

- I left Premier Home Show on October 17th - why was I not already paid before this "crisis" - I still have not been paid - I was never made aware of this "crisis" I was told many different story's. (they have are still in business and have a new undisclosed location - with "nothing to hide and up front to everyone") will let everyone know when I do get paid.

"full cooperation with the labor board as well Disgruntleds"

- if you are in cooperation then why have I not been paid? How much did it cost to get that new office and 800 number?" Why is it that every past employee is referred to as "Disgruntled"? What makes people this way? hmmm maybe after being promised benefits after 90 days? Maybe after being promised to be paid the next paid period and now it has been 4 Months!

" Until then, please try not to beleive everythings you hear. I though we were all inocent UNTIL PROVEN GUILTY!!!"

- OK Mrs. Huard we already know not to believe everything we hear.

#23Consumer Comment

Tue, February 12, 2008

Laura, real nice that your company had some accounts bounce on you, or whatever your excuse is. Sale stuff if you have to, get Barry his pay. Get the owner Brad to get a line of credit on his house, anything but get these employee's their wages that are due. You don't 1099 them and say oh, your self employed now.

You may think you are innocent till proven guilty, but let the facts speak for themselves, it sounds like your company is guilty of not Paying it's employee's. Geeeeee, go figure that one out!!! Once the guy is pissed off enough about not getting his pay, it ends up on rip off report. Barry probably didn't feel he had a choice anymore. Can't say I blame the guy.

Pay your employee's their pay, obviously you are still being paid, you are around aren't you, answering to this complaint? Brad must be paying you something? Right? Come on now, pay the man his wages he is due. Enough of the excuses.

Tell Brad to stop sexually insulting women as well, just because they are interviewing or working there doesn't mean that they have to be subjected to his crude comments.

I witnessed what Barry is describing. There werent any minorities that worked there while I did but I heard plenty of racial jokes from the owner. I heard numerous descriminatory remarkes regarding sexual orientation made about employees and vulgar comments about women were the norm (ie loudly joking about employees and interviewees having large fat pussies, talking about looking up employees skirts and down blouses.)

O.K. - This is getting out of hand.

We are a company that has been very upfront and forth coming with time sheets, contracts, agreements, etc... We have NEVER tryed to hide anything either. Read all comments. Nothing is stated that isn't fact and in accordence with this response. Our company shuts down every year from approximately Thanksgiving to the end of January of the new year. EVERYONE thats working with us knew that and was fully aware. Not only is this a tough time of year in our industry, we had a few of our clients that bounced MAJOR AMOUNTS of money to us just before Christmas.

Anything we had as far as funds went out to secure air time, production, printing, etc..... All to satisfy our agreements.

We told them the truth, things were getting hard and we would/will take care of the situation a.s.a.p. I have been in full cooperation with the labor board as well Disgruntleds can say what they want, please look at the facts and check to see if I'm being upfront and honest. You can't squeeze BLOOD from a TURNIP. When the situations is corrected, eveyone with an issue will be handled appropriately and legally.

Until then, please try not to beleive everythings you hear. I though we were all inocent UNTIL PROVEN GUILTY!!!

Does ABC, NBC, FOX and the other networks know that this company is using their logos on the website you listed above? Are the broadcast companies aware that this company is using racial terms with it's employee's? Are these companies aware that Premier Home Show's doesn't like to pay their employee's? I am suspicious that something is really fishy here with this company. Who is Brad Haurd? Is that even his real name?

Either way, it is ILLEGAL to "1099" an "employee"! That is the real issue here!

#23Consumer Suggestion

Sun, February 10, 2008

This is obviously a real lowlife employer!

Barry, go to the IRS website and download / print out the form "SS-3", "Determination of Worker Status". Fill it out truthfully and mail it back, after keeping a copy for your records.

Now, this employer gets "flagged" by the IRS while under investigation.

The benefits to an employer of giving you a 1099 is to pretend that you are not an employee, but rather an independent contractor. And, at the same time, they do not pay for workmans compensation insurance, unemployment insurance, nor do they match your SS.

It is a true scam, and totally illegal.

Good luck.

Laura: Please stop making excuses for Brad and pay Barry his wages. He obviously has financial obligations to meet and you are taking your time making him go through hoops, loops and legal action to get his pay and benefits.

You or your company (Brad) should not be referring to anyone in a racial tone, even if you don't like brothers or Jews, keep it to yourself, the work place is not an appropriate venue to use racial slurs and terms at others.

You should also compensate Barry for all his money he is out, his legal bills, pay due to him, everything.

I will remember to never do business with you ever or your company. Come up with a better rebuttal as well, your first one SUCKS!

Facts & Fiction

#23Author of original report

Sat, February 09, 2008

Fact - yes they have have been on time in getting me my tax forms to me but still I am unsure why I was a 1099 when they had me sign a W4 form. Some people who have viewed my case have sad this is for tax reasons.

It DOES state that benefits were promised after 90 days - after we discussed the issue I even tried to work something out (like get paid 100 more a month so I could get my own basic insurance) they would not work with me in any way. Believe me I have tried to make many compromises before my decision to leave. Yes I would say this would be a FALSE PROMISE - I believe other (professional & government) people who have seen it seem to think so as well.

I do have grounds to support the sales statements I have stated and have several past (sales) employees who seem to think the same.

It does not state (1) year of employment in the signed contract all it states is vacation after 90 days. I am the only one to blame for this, if I had known what I know now I would have asked from the beginning - I do have to ask why it would not be more specific in saying what you are stating?

I am still waiting for my last paycheck - I will update to this site when that occurs.

As far as the statements in the workplace - I am sorry to say (are completely true - you may not have been witness to any but I have several people who can back me up on the comments made - No comments were directly aimed at me but the references were made and in no case should ANYONE have to hear or be witness to anything like this when in a work environment.

I do have to say Laura you have been the only person who has made any effort with anything. I believe you will do the right thing in the end and I know that you only do what Brad tells you to do. I know you have a conscience and understand my predicament.

I just honestly have to ask why has it been so hard even after asking you to pay me in 3 payments (that would not have been so hard and would show some effort or action that any respectable employer would do) it would have shown me some integrity - but actions speak louder than words - the fact remains I have not been paid. You even tried to say that you were not going to pay me because of some printing mess up that happened after I left the company - after many in-house witnesses to this account you changed the story back to paying me and I have been waiting, I know that there has been at least one government agency in contact with you - You even stated that you mailed my check and never did.

I ask you why say something that is not true? Would that be called a lie?

I have a creditable witness to this.

I do not believe this needs to go on any further than it has. Like I have stated before the ball is in your court - and that is where it will end up after Feb. 29th - in court. You will honestly have much more to loose. I am not one who gives up.

Barry - your well aware of your contract that you signed. Just refer to your contract. You were not made false promises.

In regards to sales people in the office, you Barry were a designer that has
NO IDEA WHAT YOUR SPEAKING ABOUT!!! NOR DO YOU HAVE GROUNDS TO SUPPORT YOUR STATEMENT.

To my knowledge, any employer that pays for vacation or time off would REQUIRE AT LEAST ONE (1) YEAR of EMPLOYMENT.

As far as any back wages due to you, Mr. Barry Fader, we have been in full cooperation with all necessary and pertainent agencies to resolve any of our legal obligations. Of course in a timely manner.

Your reference as to any statements and or comments made toward you in the work place, NON of which were ever made by your direct employer. Not to mention your were ALWAYS treated with the ut most respect. I'm suprised that you would make such statements.
