DEAR TRACY, DEAR PROGRESIVE--

First of all, I have my MBA in Marketing. So if you do me wrong, it can get Ugly.

#1- Your client rear-ended me over 2 years ago.
#2- You paid $1800 in car damage
#3- You told me to seek a chiropractor and send you the bill.
#4- I seek a chiropractor and send you the bill of $5,000 and you decide it is too much.
#5- Progressive insurance asks me to take them to court 2 years later.
#6- I cancel plans to Cabo with my fiance to go make an April 21st court date.
#7- My BFF husband works for Progressive. He makes 6 figures. SHe tells me to fight this case.
#8- I am pissed I have to cancel my vacation plans. You owe me for medical bills. They are very reasonable.
#9- I am am a fighter to death. I have an MBA. I can be dangerous. Try Googling the name Tracy Hizor, and you may just want to settle :)

Let's start by exposing some truths on Progressive Car Insurance.

I have to take Progressive Insurance over $2,500 for a car accident case. I have to fly in to San Diego next week. I live in Seattle. I'm the victim, not the attorney.

Dear XXXX:

Originally I considered only the treatment you received in San Diego as reasonable. In an effort to resolve this case I can give you the month of February for your medical treatment as well. However, I cannot give you the charges billed by Associated Chiropractic. Their bills are incredibly excessive. The supplies are included in the procedure charge and this facility billed $50 per treatment for supplies, they charged $108 for a procedure whose code indicates it's a 15 minute procedure. They also billed another $48 for manipulation. A standard chiropractic visit with
several modalities generally runs around $90 per session, maybe $100, but definitely not $206-$223 per tx.

The full amount of my initial evaluation is $2050, any additional consideration is minimal at best. No future care will be considered as we have causation concerns pertaining to your injuries and medical treatment as it is. The loss of earnings you submitted is so far removed from the date of loss that I cannot consider that as part of the settlement either.

You had 5 tx in February. I will consider those 5 treatments at $100 per visit. The offer for full and final settlement is now $2500.

You must realize I have to look at the severity of the impact, the nature of the treatment, the consistency of the treatment, whether or not the charges are reasonable, how your age and physical condition would affect your injury, medical documentation to support the healing process for an injury of this nature. Nothing in this claim or surrounding your diagnosed injury supports the medical treatment you received. This is the best I can do.

I have reviewed your case. There are several issues, or problem areas,with this case that just make any high dollar settlement not feasible.

Pay me ten times the doctor bills for pain and suffering (which I am not claiming now but oooohhh, my back still hurts and that accident killed my chances of performing in the Olympics this summer), PLUS
Pay whatever the judge awards in Punitive Damages PLUS

I am the owner of Associated Chiropractors not (Associated Chiropractic); and I need to expose the truth with this rebuttal as you have used false numbers and totals to your advantage.

The facility billed $50 per treatment for supplies, that is absolutely false. The $50 charge was for lien filing/unfiling and was paid by the injured and is not a cost incurred by the insurance company. This was not for supplies.

"they charged $108 for a procedure whose code indicates it's a 15 minute procedure" actually this charge is for an hour massage not a 15 minute procedure.

My chiropractic visit was only $48.00 not the $206-223 charge you accused this facility of billing. You need to review the records and get your facts straight and stop slandering my company. Your false statements are injurious to to a companies reputation.

I am ethical and have never jeopardized my reputation. Get your information together and learn the facts. Your information is wrong, false, and continued slander is injurious to a company's reputation.

Get your facts straight and stop posting wrong information. You obvioulsy do not know how to manage your claims very well, based on your rebuttal and false accusations.......... The owner
