I was approached by Bryan Bosworth from Property Masters in 2002 who called on an ad I placed in the AZ Republic for a home I had for rent. He explained that Property Masters was interested in managing my rental properties. After meating with him and meeting his team, I agreed to place a few of my homes with this company to see how well they could manage my homes.

After the first couple of months, I realized that they were not delivering on their promises because the monthly reports were incomplete and the monthly checks were not included in the report as promised. After a couple of meetings and two more months of missed reports and payments, I referred this matter to my attorney.

We entered into binding arbitration which was part of the contract that I signed with the company. When we appeared at the hearing, a representative of Property Masters did not show, nor were they representated by an attorney. the judge entered a judgement in our favor which was leter affirmed by the court.

Shortly after the judgement was entered by the judge, we attempted to collect on the judgement, but were surprised to discover that Property Masters had closed down and opened under a new name of Home America.

The attorney representing Property Masters and Mark Bosworth stated that the company went out of business. The interesting thing was that they had the same office, phone numbers, fax number and web address that was forwarded to a new website at http://www.homeamericapm.com

Soon after my attorney filed a fraudulant transfer complaint. We soon found out that Property Masters had several complaints filed against it and had closed with the intention of "wiping away" these potential liabilities.

Today we are still weaving our way through the legal process in an attempt to collect on a $20,000 judgement.

I just happened to stumble across this posting while doing some research. I would like to clarify that I happen to own a company in Indianapolis, In. named Property Masters LLC. We are a General Contracting and Property Preservation Company in very good standing within our community and with my national clients. We are members of several trade associations and with our local Better Business Bureau.
Our reputation is very important to us.

I just wanted to make it clear that we are not the former Property Masters LLC in Arizona involved in this dispute.

That being said, here are some general facts about Home America that the reader may find interesting. Home America Property Management is a professional property management firm operating in Prescott and the Phoenix, Arizona metro area. We have thousands of satisfied property owners/investors and tenants.

As property managers we accept the tenuous position of maximizing rents for the owner's investment while keeping a handle on prospective and current tenants. Owners often have concerns about the value of their property, rental income, maintenance issues, late payments from tenants, legal processes, collections, monthly statements, and a host of others. Tenants have concerns about timing of rent payments, amount of payment due that day, late fees, legal notices, maintenance issues, and a host of others.

Occasionally, some tenants blame our company for not fixing things quickly enough. They are not concerned that the owner may not have enough money in their account to make some repairs. Conversely, some owners blame our company for putting in tenants who end up not paying the rent.

We cannot predict the future, but we can act professionally to serve our customers to the best of our ability. We have dealt with about 15,000 owners and tenants over the years. We have had a few complaints among those thousands. We cannot think of any major company in the world that does not have some consumer complaints.

Do not give up-apply for recovery fund

You can contact the Board of RE and it seems like they are trying to give a better service to the consumer. Ask for info, if you have a judgment against Mr. Bosworth and he still is in RE you can be awarded $$$ sum from the recovery fund. Its about 7 pages application. Good luck and best wishes.

Judgement is against company LLC that Closed

I appreciate the information, however, the judgement is against the company (Property Masters, LLC) which closed and the next day opened as Home America Property Management, LLC with the exact same address, ownership, employees, customers, phone numbers, etc.

We are currently pursuing a Frauduant Transfer complaint.

My suggestion to you is to find out if the realtor Mr. Mark Bosworth owns a property, they way he does business probably he has lot of $$$. With the court judgment you can put a lien on his house. It means he can't sell or refinances his house and you should record it with the county recorder. You can record your judgment with the county recorder as well.

Another possiblity -there are agencies that will collect for you they take some of the percentage but its better to get some than nothing.

You can have the constable going over to collect. If you have a judgment against them you can file a complaint with the Board of RE in AZ, they have a Recovery Fund, you are entitle to that if they will award you the amount (maxi $75,000) they will revoke his RE license. I had a similar case with another management properties, I had find out that the broker had worked for Mr. Bosworth so she got a good training. The same story no checks, inflated bills, I took him to court and won, it was a story to collect after putting a lien and sending the constable to his office I got the full amount. The ball is your hand- you can do it. I feel for you I had been in the same situation.
