Joseph Pham, owner of Providence Realty and Mortgage in Mira Mesa, CA purchased the home that my roommate and I rent and have a 2 year mortgage on. He made his purchase at a Forecosure auction and came by that evening, giving us a 3 Day Notice to Quit. We thought that he knew the law and would be honest with us; but, we were very wrong.
When Mr. Pham came to our home that night, he refused to tell us his name or where we could pay our rent. His attorney's name was on the notice; and when the attorney was contacted, he would not reveal the name of our new landlord. The attorney's paralegal left a message on the telephone answering machine that their client did not want to accept rent and was going to sue to have us evicted.
We knew he was not acting honestly or ethically, but I had read about people buying up properties at foreclosures; and, using similar unethical and illegal actions to get rid of tenants they wanted off of their property, with no regard to the rights or wellware of the people they were abusing.
When Joseph Pham stated pulling his bullying behavior on us, it did not work. We knew our rights and we knew he was very out of line, especially with him being a Realtor in San Diego and owning a business. He had to be aware that he was breaking both state and federal laws with his actions.
Mr. Pham was determined to get us out of our home and we stood our ground. He brought a lawsuit against us for an Unlawful Eviction. We found the documents on the carport floor, underneath my car. We did not know who left them or when they left the. We went ahead and filled out the paperwork, paid the $225.00 each to file our answers and paid about $100.00 to have a service do the rest of work, since we only had 5 days total to take care of it and that included weekend days.
Mr. Pham had a lawsuit against us that included many lies about us and conveniently omitted the deceptive and unethical behavior on his part. Our answer was easy because we documente our actions and knew we had followed the law.
We went to CA Superior Court in Downtown San Diego. Mr. Pham had his attorney with him; and, my roommate and I represented ourselves. Joseph Pham lost his case; but, he caused us many hourse of worrying about having a place to live. Having a landlord threatening to throw you out is very disconcerting. We knew he was willing to break certain laws and we had no idea how low the man was willing to go.
Another really strange thing that Mr. Pham did was to hide his identity from us. What kind of decent, honest person acts like that. The title of the property that we rent was listed as Caminito Vera 8915 San Diego, CA, Ethan Coen Trustee. We knew our landlord was not named Ethan Coen; but, he never listed his true name anywhere in connection to the rental property. The only reason I could guess that he would be so secretive would be because he was doing cruel things to people and did not want them to know who he was. Of course, that is only speculation on my part. He treated us horrible.
starting putting pieces of the puzzle together and found the true identity of our landlord. I did some research on the internet and then began to put small pieces of the puzzle together. I found his identity. If he had not been so cruel and abusive to my roommate and me; I would never have wasted so much time finding out who our "no id landlord" was.
I could not believe that we were the rare tenants that he tryed to throw out in such a cruel way. Of course, his actions towards us would make sense as to why he was going to great lengths to hide his identity from us. If he treated us like he did; more than likely he has done or will do this to many more innocent people. If he does, I hope this helps to lead people to Joseph Pham in Mira Mesa. I have noticed he have been buying properties and posting notices to scare people out.
