I work for this company.  we drive railroad crews. we get paid by the mile and the hour for wait time.

Some runs are long, good payers, some are short.  we work on a rotation board, the next in line get the next run.  we have several runs that come in every day and we know what time they are called for.

Several times I have been expecting a call for a certain run because I know what time it gets called, as last night I was first on the rotation board at 7 minutes after midnight, knowing that one of the locals get called at 340, but got called for a $15.00 run instead at 540.  Someone got that run at 340 and it wasn't me, even though I was first out.

This has happened several times.  I believe the dispatchers are picking and choosing who to call because they are certainly not calling by the numbers!  When I ask my boss about it, they just say, well, no someone else was on the board in front of you.  Which is BS. We get no compensation for this.

They also don't pay you for miles run, they have what they call code set mileage and that's what you get, regardless of circumstances!

Living in a disgusting right to lose money state, nothing can be done.  I also can't quit and find another job as I have a disability that precludes from doing physical work, also am older and have no college degree.

I think it's unfair to know for a fact you are lined up for a $50.00 run and get one for $15.00 instead, and NOBODY does anything about it!  This has happened several times, I have actually caught someone else taking a run that should have been mine

we are supposed to be on the board twelve hours a day, but when you get a run late and it doesn't finish until twelve hours later, you don;t get to stay on the board for twleve hours, therefore you don't get a run the next day.  This schedule is not fair, and now they tell me we're only going to be able to be on the board for eight hours because some of the drivers are going to work fatigued!

Example, my shift is 4 p.m. to 4 a.m., I got a run where I started my shift at 2:30 a.m., it ended at 3:00 p.m.  Eight hours rest later, it's now 11 p.m., I go on the board, position is number 5.  At 4:00 a.m. I have to go off the board without working! And was first on the board when I had to go off!!!   I feel that if I go on the board at 11:00 p.m. I should get to stay on the board for 12 hours.  This is why we are fatigued!  First, I slept all night, now won't be able to sleep until about 4:00 or 5:00 this afternoon, then I will have to go to work.  On top of that, the stress of worrying about when you"re going to work next keeps you from sleeping.  They need to get rid of the schedule, everything was fine before it went into effect.  People that want to have 12 hours off a day should get another job!  I just want to work.

On top of that, dispatch are the biggest screwups I've ever heard of.  They call us when we're on a run to take a run, they call when we are code 4, which means down for eight hours rest, they are rude, incompetent, and treat the drivers like crap.  They hang up on you so you have to go through another 20 minutes of listening to those IDIOTIC safety messages again, and if you don't think those messages are stress-inducing, just listen to them for 20 to 30 minutes while you're on hold.

The computers don't work half the time, so you have to call dispatch to let them know or have them close out your run, which normally takes 20 to 30 minutes just for them to answer the phone, by which time you're ready to scream.  That is also a factor in what time I get to go back to work. and then, when you do get ahold of them, they are rude and don't put you code 4, as last night I told dispatch my computer would let me code out, she told me I was code 4, and they called me 6 hours later for a run!  We are required by law to have 8 hours undisturbed rest.  Then when I told them I couldn't take the run, I didn't work the whole night.

The dispatchers finagle the rotation board around to their liking, I know I have been skipped over many times, as it's an automated system, this shouldn't happen.  I started documenting these things in May, will have records when law suit time comes.  I have no problem with over time pay, they always pay it.
