I filed a cliam with the California Public Utilities Commission and Nevada PUC and have heard nothing! Its so cut and dry that we are being ripped off..so I dont understand why the PUC in the state of California and the PUC of Nevada has not contacted us. How often do they get claims with so much writtten evidence against a utility company? Is the PUC just another tax sucking organization that does nothing to help the consumer?
Complaint I am referring to:
TelePacific & Mpower Communications are defrauding us and lied to us in writing, dealt with Tom Norys and Rhonda are defrauding us beware!I tried several times to resolve this issue with Tom Norys, Rhonda, Telepacific corporate to no avail. Below is a copy of the claim I filed with the PUC. If any of you have had problems with Mpower ot Telepacific please let me know as I have a large law firm ready to begin a class action.

(lets see if they help and if our tax dollars are going to a good cause)
Dear PUC: This is very simple. We added a new location and division to our business. When we spoke to Tom Norys the sales manager for telepacific he assured us in WRITING (which we can present all of these to you at anytime) that we would not be penalized with any fees since we are in fact just adding / transferring service. Therefore we stayed with telepacific based on these WRITTEN assurances. Several months later we receive a bill for $8,000.00 for early termination! We contacted the department that sent us this bill (spoke to Rhonda) and she basically called us liars and asked us to fax her the emails from Tom Norys assuring us of no penalties. I faxed her right away and in fact called her to make sure she received it. Her reply was yes but she would need to confirm with Tom Norys! Wow talk about making us look like bandits. I even gave her our current locations info to further prove we are still a client of theirs! In addition to all this I also contacted Tom Norys and he AGAIN in WRITING re assured us that we are not to pay the fee and he promised in writing ot contact Rhonda directly. He even email me back that he did this and all was done. Based on this email we figured this was final. Last week we get another bill for $8,061.64! I again contacted Tom Norys via email and phone on October 25th 2007 and reminded him of his written assurance and advised him of this recent and fraudulent bill sent us. Needless to say as of today I have not heard from him. I can not risk having our credit affected for something we do not owe. What's really sad is that we are an existing client of this company and spend over $1,500 a month with them at our new location. This is just ridiculous. I plan to take copies of this claim to the media, the web forums, the bbb etc. In the meantime we ask that you please help us. God Bless

I was involved in a similar situation with a certain Cell Phone company. Dealing with the company directly provided no results. A letter was sent to the PUC. Within 24 hours of them receiving it we not only recevied a call from the PUC but from some upper management person at the Cell Phone company. Needless to say within a couple of days the issue was resolved.

Now, the only thing you have to be sure of is that you are following the guidelines for a dispute with the PUC. One condition is that you MUST send the PUC a check for the disputed amount. This basically tells them you want them to settle the dispute. If you just send a letter, they will file it, review it, but usually take no action on it.

Once you send the amount to the PUC the company can not report you as negative to any of the credit reporting agencies. The PUC will try to get you to work it out. But once the investigation is done the PUC will either return the check to you OR to the company. Depending on which way the investigation goes.
