Puente Hills Nissan Finance Manager Submitted Fraudlent Contract for 72 Months In Stead of 60 Months at the 60 Rate City of Industry, California

I spoke with Mr. Julian who addressed himself as the general
sales manager for Puente Hills Nissan located in the city of Industry,
California. Basically he said that he
spoke with the president of Puente Hills Nissan and he reviewed all of his
paperwork and it showed that I signed the paperwork so they are covered and he cannot
rewrite the contract!
THIS CONTRACT WAS WRITTEN IN FRAUD AND IT SHOULD BE TERMINATED FOR
DEFAULT! Mr. Julian asked me why
did I wait two years to report it to him? I DID NOT FIND OUT THAT THIS CONTRACT
WAS 72 MONTHS UNTIL I RECEIVED A COPY OF MY CREDIT REPORT.
I signed a new
contract on the 15th for a term of 60 months that I did not receive
because the finance manager never gave it to me but he back dated the contract
and kept the former terms in it for 72 months with the new payment of $300.88.
I AM ON A FIX INCOME AND WOULD HAVE NEVER AGREED TO A 72 MONTH TERM.
THE
FINANCE MANAGER (Joey) MANIPULATED THE COMPUTER SYSTEM TO MAKE IT LOOK LIKE I
SIGNED FOR 72 MONTHS. I REALLY WISH A LIE DETECTOR TEST CAN BE ADMINISTERED TO
BOTH OF US TO SEE WHO IS TELLING THE TRUTH AND THAT THE FORMER GENERAL MANAGER
DEAN CAN BE SUBPOENA.
This dealership has a history of defrauding customers and
has changed ownership several times because of problems within their management
structure!
NOTE: Julian was not the general manager and I believe he is
not a general manager now but an associate manager! Dean was the general
manager! This dealership lies about everything! I was promised a stereo and was
told they had to special order it and when it comes in they will call me! This
is a new car dealership and they have 100s of stereos in their inventory! All
they do is LIE LIE AND TELL MORE LIES!
A week prior to October 12, 2012 I received a telephone call
daily by Nissan company representative Mr. Romeo to come in because they can
fix me up with a good deal on a new vehicle or they would purchase my vehicle
outright! On or around October 12-2010 I went to Puente Hills Nissan
to trade in my 2009 Nissan Sentra hoping to get a cheaper vehicle that would
lower my payments.
I was told on the telephone prior to going down there by a company Representative named Romeo that I could trade in or sell my 2009 Sentra to Puente Hills Nissan. I found a cheaper car which was a 2011 Nissan Versa that was sticker price for less than $11,000.
I told the sales manager that I had changed my mind but was
told that it was too late and that I had to take the vehicle! Nissan had the
car salesman trail me home in the new vehicle so it would show that I took
possession of the new car. I told them I needed some time to think about it but
they said it was too late!
I ended up with two Nissan cars and had to
voluntarily surrender my 2009 Sentra (Repossession) which impacted my credit
score badly all because this dealership was determine to make a sale at any
cost even if it bent the rules to do so. After going through the finance department and signing the
contract that night. I had changed my mind because I thought the car was
costing too much money and I wanted to go home and think about it.
I was told by the Finance manager that there is no cooling
off period in California and once I sign the contract I had to take possession
of the vehicle. The contract dated October 15th is the contract
that I had signed to cancel. The contract date should have been October 12.
This finance manager (Joey) changed the contract terms that I signed that night
from 60 months to 72 months at $300.88 a month.
The general manager (Dean) said that perhaps he can help me
and we sat down at a private desk for over an hour and talked about the 2011
Versa. He pulled it up on Nissans corporate website and said that it was
$216.87 b3ecause it did not have anything on it. The general manager (Dean) gave me three pricing options:
$287.00 a month for 5 years; $327 a month for 4 years, and $436 a month for 3
years.
The $300.88 a month was the
agreed upon terms for 60 months that he never provided a copy to me after he
stood up and tore up the old contract saying that the bank has never did what
they were doing for me. The contract I received was the original contract
without the terms me and the general manager agreed upon.
I feel that this
finance manager (Joey) along with the general manager Dean should be held
accountable for their actions and persecuted to the fullest extent of the law!
I spoke with an attorney who informed me that he has had previous dealings with
this company in the past.
The attorney name will be provided to the proper
legal authorities if requested. I would
have addressed this issue much sooner but this attorney told me not to and that
he would handle it. This attorney kept all of my paperwork for over 6 months
then decided not to handle the case!
After reading the specifications and info about this 2011
Versa on the Nissan corporate website and based upon my credit the vehicle was
priced at $216.87 per month for five years. I returned to Puente Hills Nissan on October 15th
and asked to speak with the president of the dealership.
When I went into the finance department the tricky finance manager (Joey) kept adding things and he (finance manager Joey came up with $300.88 which I objected to but finally agreed to for 5 years. He the finance manager stood and said the bank never accepts a new contract after an original is signed and he showed me the contract and he ripped it up right there in front of me.
The original contract was not for $300.88. That amount is what I last agreed on for 5 years. I had called the dealer prior to me going on the internet and finding you (car Lawyer) and asked to speak to the finance manager. I told him about the situation on my credit report showing 72 months instead of 60 month which I had agreed on.
I asked the finance manager could I speak to Dale (General Manager), and he said no one by the name of Dale works there. As far as I know the finance manager presently working there may not be the same finance manager that I previously dealt with. I feel that this dealership has committed buyer fraud. Yes that is my signature on the contract, but this contract was tore up in my presence only to be submitted to the finance company (Balboa Thrift and Loan) after I left with the terms changed.
The $300.88 was the amount on the new contract but for only 5 years. There were two contracts as you can see but where is the 2nd contract? This was a part of the first contract. If you look on the better business bureau ratings for this dealership there grade is still probably poor. It had a grade of D- in October of 2010. It looks like this could be a different management team than the one I encountered in 2010. I may have dale who was the general manager at the time.
