puerto bahia villas & spa -Omitted my Addendum to the contract without my permission or knowledge, la cruz de huanacaxtle, Mexico Internet
Hi to all travellers, On Feb. 2,2012 I went to puerto bahia complex (under construction) to check it out. The first thing I said to the salesman was that I will not finalize any contract untill my lawyer looks at it and gives me written approval that the paperwork is in order. Their proposal was not bad since I could sell my Mayan timeshare and transfer to them at no difference in price. While signing the contract I included an addendum which stated that my lawyer must approve it first and no funds shall be transferred until then.
When I went over the 50 pages of the contract with the developers rep. I failed to see that the sales manager excluded my addendum from the contract. This I found the next day when I went over the papers word for word. Remember they inform you that the contract is standard,so just sign and hurry. This is done under some duress. The contract also states that you have contacted your lawyer or financial advisor which they don't tell you, just sign. In the mean time they cashed my credit card the same day that I was there, which they were to hold till approval was given.
I went back the next day to ask about the addendum not being there and was treated as if I had the plague. I was not able to speak to any one in authority even after 4 visits. By omitting the addendum to the contract, they changed this agreement making it fraudulent and null and void. To date March 1, no one will return my calls or verify my clause in the contract in writing, only will they verbally state this. This episode smells of a phoney operation being perpetuated on people, mainly from the US and Canada. BEWARE!

Puerto Bahia - Has it been resolved?

I'd recently signed a contract with them to purchase. I am new at this and am wandering if you managed to resolve your issues with them yet? I am curious if anyone has completed & signed their final deeds/documents at their notary's office in Mexico? The manager called me today to inform me that they have not decided how overseas buyers will be signing their documents, whether all the owners need to fly in when their units are completed to finalize the documentation or find another way to do so ... something they have not worked out yet? I have to do my final payment now even though my unit is not completing until late Spring 2013. Did you commit to their marketing credit weeks where an independent resort service company agrees to take back some many of your weeks to rent it out for you? I like to know what your situation is now, & is there a way to cancel your contract & get your refund? I sure hope that everything will work out for us!!
