Memberships purchased for mother and daughter on 6/5/05 for $400.00 to expire in 6/5/06.

Pool immediately closed down for "rennovations." Members were promised rennovations would last no longer than three weeks. (7/1/05.)

Pool did not reopen until 9/1/05.
Pool refused to refund memberships.

Pool was extremely dangerous. No lifeguard or resuscitation equipment or trained persons. Chlorine fumes. Extremely slippery conditions.
All of this reported to management 9/1/05.
Pool refused to refund memberships.

Pool refused entry and revoked membership to/of the daughter 10/20/05 on the grounds that health department suddenly and allegedly forbade entry to minors. Pool refused to refund money for daughter's membership.

Efforts to recover membership fees ongoing.

Seems to me that if you signed up for one service but did not get access to it, you could put in a small claim suit for damages of at least the value of the pool.

Some states do and some states don't require a lifeguard. There are specific requirements for life-saving equipment and I would suggest looking them up and then sneaking your camera in to snap photos of the missing equipment. Also I would suggest sneaking in for a sample of the water and take it to someone qualified to see if it is within tolerances or requirements for chemicals, Ph, and all that.

As for slippery...that's pretty subjective and if you didn't already fall down, not likely to fly in a court. If you did fall, then by all means visit a medical facility and make a report..and then bring that to court too.

Then and only then do you have evidence. Also...were those promises in writing? Get a copy of something that said that renovations were being done AND how long they would last. If the health department forbade entry, then there would be a report somewhere to show why this is the case. Get that. Health department reports are subject to the freedom of information act and you can get a copy of the report, if there is one. First, however, demand to see it from the club.

Go into small claims armed with this evidence and you will likely win.
