Complaint Review: Red Mountain Funding

In March of 2008, I purchased a car from USA Auto in Mesa, AZ. They use a local finance company called Red Mountain Funding. Since when my payments began in April, I have always been on time, never been late along with being a good customer. Then my car broke down and was out of commission for 2 months and then it was impounded by my old apt complex. So with their help, they got the car out by getting me a towing service and helped finance the repair. Then 2 days later, the mechanic said he got it done and told me to call after 6 PM the next day to go pick up the vehicle. I go to pick up the vehicle and told me to call the guy I am working with at Red Mountain Funding.

So I call him on Friday morning and he got angry with me that I went behind his back on this and said he needed to speak with owner of the company. So I called back in the afternoon and he told me the owner said because of what I did, I have to pay 650 bucks by September 30th 2008 or I will be in default of my contract and they will repo the vehicle which they have in their posession already. They told told me before they would work with me, but all because of a miscommunication and them thinking I was trying to screw them over, they now DEMAND 650 BUCKS. And I have made all my payments as required.

This is generally punishing a good customer over something very stupid. Yes they did me a favor and now they want to add a 2nd repo to my credit. I understand they are a subprime lender and they deal with people who have really bad credit and that is why they need to be strict. But this going over the line now, all over something like this. If they repo and there will be a definency balance likely from the auction, this will force me for sure into bankruptcy. The owner is not somebody who is understanding and it will be hard to come up with 650 bucks because I have rent due on October 1st. This company allows people to get cars, but it appears they have low tollerance for bumps in the road and who are living paycheck to paycheck and have rent due.

If every payment was paid as you yourself stated as "ON TIME" what is to get current? There is a piece of the puzzle not in the story somewhere. Did you get behind when you needed to fix the car? Otherwise, I am lost in what is really going on. If you got behind then yes they expect you to keep the car current whether the car is in working order or not. Cars break down and we all have to pay to repair them and stay up with payments, which is why i do not carry a car loan on a car. That way if it needs repairs I also have do not have a payment on a car and a repair bill as well. Good luck, let us know how it goes.

Thank you for the suggestion. More than likely I will seek legal advice in this matter. However after reading my story over again, it is fairly clear on what is going on how this company is treating me and not letting me make arangements to get the account current. The fact is this is unfair hardball where I have made every single payment ON-TIME.

Maybe you should visit Legal Aid and discuss your problem with them to learn your rights and responsibilities in this matter. You would seem to be following a pattern of casual behavior that leaves you open to exploitation & abuse.
