When I purchased a vehicle from USA Auto they apparently used Red Mountain Funding as the finance company.  I was never told it was Red Mountain Funding only USA Auto.

I immediately noticed issues with the vehicle.  Under AZ state law it fell under LEMON.  Boy was it.  I spent $2500.00 as a down payment which I really didn't want to do, but I needed a reliable car.  USA Auto assured me it was.  First time I filled the tank it took 10 gallons for a 20 gallon tank (according to the manufacturer book).  First time I went 65 mph the vehicle shut down on me in rush hour traffic while in the left lane.  I had to get it towed to USA Auto.  Their tow truch took over 2 hours in the blistering August sun.  I was only 15 miles away.

Once at the dealership, they stated that there was nothing wrong with it.  It started right up for them.  I said there is no reason for the vehicle to shut down while driving unless there is something wrong with it.  No warning lights came on. Even the tow truck drived tried to get it to start and could not.  He even looked under the hood and couldn't give a reason why it stopped.  I also told them about the gas issue to which they dismissed my concern, seeing as I had on had the vehicle now for 36 hours.  I was actually on my way to see them for a new temporary paper plate as the one they had given me was only good for 3 days.

I got back on the road with the vehicle only to have to fill up everytime I approached 233 miles on the tank.  10 gallons of gas.  The fuel system was faulty.  After I had been to the dealership 7 times to get it resolved (1 one the times they had it for over a week), they stopped taking my calls.  At this point they had had my vehicle more that I did since I gave the the money.

I had no intention at the time of purchase of filing for bankruptcy.  However due to unforseen and uncontrollable circumstances it was required.

I included this vehicle in the bankruptcy.  They had my hard earned $2500.00 to which I would never see again.  I did all of the proper notifications as required.  Now that my bankruptcy is days away from finishing - I had the creditor meeting back on Jan. 3, 2014 - They did not show up, send a letter, anything -They hit my credit report with the vehicle.

It is against the law to report on someone's credit report when they have filed bankruptcy aganist you for something you purchased, let alone in the last hours of the case.

I tried to contact them with no reply.  This is the only way that I can help fellow consumers in a tight spot to beware and not be penialized for doing what the law requires.

I will never go back to USA Auto and I hope that if you read this you haven't fallen into their trap of unreliable vehicles or funding with illegal practices.
