sent cease letter on 10/18/06 delivery date was 10/23/06.
reginal adjustment bureau called on 11/07/06,said they never got the cease letter. I am keeping notes of when reginal adjustment bureau calls. I am planing on filing a lawsuit
against them tommorow.What else can i do?

Blondie,

When sending a CEASE COMMUNICATIONS request, follow this procedure EXACTLY.

Send it by certified mail, return reciept requested. Put the certified# on the letter itself and keep a copy of the letter with the certified# on it for your record. This is very important.

Now you have absolute proof of WHAT you sent and WHO recieved it on WHAT date.

Now when they call you document it and immediately file your lawsuit for up to $1000 plus costs for the FDCPA violation. You can subpoena your own phone records and theirs to prove the call was made.

Then you get paid.

I wrote the Regional Adjustment Bureau (RAB) cease and desist letters also. I wrote 2 letters back in the early part of September, and they stopped calling me about a week or so later. You should write one letter to RAB directly and another to the person who is calling you (mine was named Wes McDonald). After a few weeks past, I got a letter from them, saying that they "lost" my phone number and that I should tell them again what it is. I refused to tell them my phone number because it was there fault that they supposedly "lost" it. I haven't gotten a call from them since.

See, I was in debt with CapitalOne late last year. I wrote them a cease calling me letter earlier this spring, then they stop calling me shortly afterwards. I didn't even know the Regional Adjustment Bureau even existed until they started calling me back in September on behalf of CapitalOne.

I don't get anymore debt statements from CapitalOne anymore, just RAB. I've paid them $40 a month for about the past 3 months, and I haven't gotten a call from them since. Whatever you do, don't give them your bank account information to "automatically" deduct what you owe them. RAB can then take out any amount of money that they want. I just wait for my bill to arrive in the mail each month, then I just send them a check. They should offer you sometime here soon, the opportunity to settle your debt once and for all. I owed about $400. They were authorized by CapitalOne to settle with me for $290. Settling is a option for you to choose if you want (You don't have to do it). I turned it down. I couldn't afford to pay $290 up front, so I'll just keep on paying them $40 a month until I pay off my debt for good. I hope this information is helpful to you.
