Rimma Pevzner, employee of remax executive realty was trying to sell to me her condo. When I attend the open house , which she was holding, she offer me some price reduction in exchange to her services to be my broker to buy her own house as well as selling my existing condo (which were not even being planned to sell at that time). Being not very experience consumer, and trusted person I agree on her conditions.

I put $500,000 offer to her condo conversion from 2- family house, which she gladly accepted.

Rimma Pevzner did verbal presentation of her unit and did not supply me with any written information on the unit during open house, however all information I was be able to pull out from MLS printout, which were previously was printed by me and advertised for more than 2 months by Remax/executive realty. Some of the property description was also included in original offer paper.

Rimma Pevzner advice me to save money on inspection and legal fee, which surprise me. During inspection we discover about $9,000 damages to the building external structure. When I got this to her attention, she smartly replies house will sell as at is. When we decide it to leave this deal, she agrees to do some repair or pay for them.

In original offer indicated that P&S should be signed July 21, 2004 by 6 p.m.

Rimma rush to my house almost 2 hour later that indicated time, would not give me enough time to review P&S , refused to translate and interpreted me this agreement ( actually she apply , that nobody reads those papers, just check the dates and price and initial each page, and if you want you can study them later).

On my question where the property description from MLS and original offer, she answer it will be in the condo documents, which are not ready yet. She pointed me to paragraph, which indicated that I have 5 days after condo documents arrive to review the paper and to be reasonably satisfied. Verbally she reinsures me that P&S does not take any power, unless I am satisfy with condo documents; and she collected my 5% of deposit ($25,000).

Life was still good, and about week later signing P&S agreement, second unit of her 2 family house mysteriously shrink from 2180 s.f. to 1945 s.f. I guess, broker who live in the house for more that 5 year, did not calculate s.f. of her condo conversion correct. When I ask her about size of my unit, her answer was that the unit smaller that it was previously advertised, refused to give me exact number, reply wait until condo documents will be ready.

In mean time, she was constantly was calling to mortgage broker company Bostonian Mortgage, getting all kind of information on me, and checking all my private information, which Bostonian Mortgage was not suppose to give to her. I also called to Bostonian Mortgage to find out result of appraisal, since now my property shrinked too, I was not quit sure if it was worse offer price anymore. Bostonian mortgage told me that usually inspector comes with offer price anywhere, but in this case he will wait until condo documents will be ready. Also when I apply to mortgage, Bostonian Mortgage asked me what I am doing with my present condo. Since it was on the market, I just told him the true. However he suggested me to put in application that I am going to rent my condo. My reply was it possible, if I can not sell quickly.

Now I return my story back to Rimma Pevzner. When Rimma Pevzner find out that she miscalculate s.f. she become nervous, and start to push me in the long conversations, which make me even more suspicion, that something is wrong. So I told her to stop worry, I really like her place, but if it will be big difference in s.f. we will have to do some price adjustment, on which she responded "NO! You already have mortgage commitment, it will not be any price adjustments, and if you will try to pull out from the deal you will loose you $25,000". I was not aware that I have mortgage commitment,so I called back to mortgage company, president Boris Gluzman reply "you do not have full commitment, since appraisal not yet done, but you have excellent credit history, and with your credit history you have 100% guarantee to getting mortgage".

Condo documents arrived about 2 week prior to closing to my second attorney (fist attorney become useless, because I found out that he is close relative with Boris Gluzman, president of Bostonian mortgage and friend for the last 12 years of the Rimma Pevzner). By the time I had opportunity to look the condo paper, it was only 2 days left for my review.

Condo paper was horrible done, it was some copy which she made for condos with multi buildings, and was not appropriate for 2-family condo conversion. Some other important issue, also arrived after review condo documents and wipe out again original offer. To make up for missing s.f. , Rimma Pevzner actually added the space of the storage room to total s.f. and now start to claim that place even larger, that it was advertised. Who care that it is not a living space???

We denied condo documents and requested money back.

Rimma Pevzner faille to return deposit when I discovered the incorrectness in square footage, faille to return the deposit after rejection of the condo documents.
Her delay to providing condo documents to appraisal company cause me from getting a mortgage commitment letter in indicated p&s date.

The interesting, that when I finally got some legal papers from Bostonian mortgage, who guarantee 100% of getting mortgage, the paper have 2 interesting conditions, which would allow me to break P&S by certain date, if I just sow those paper, rather than verbal 100% guarantee. (1. I have to have fully executed least for my existing condo, for way above market price by day of the closing, + appraisal have to be at least for $500,000)

If it all not conspirency by broker, mortgage company and first atorney against off me, what is it???

Fraud and lies affect me, so bad that I almost got nuts.

And new atorney is not optimistic, it's 3 against off 1, will be disaster in the court. He actually to offer buys her out. Out of my mind. How the people can get away with all this!!!

Thank you for your respond, Rimma.
I wanted myself to add what is going on with this case, but my attorneys stop me from writing anymore on public forum. Yes, it is on this or other forum (I do not remember now) and also by the numbers of the people in the community who found out about this story I been advised to file this complain with the licensure of the board. Some people were telling me that board can help; others had different opinion about this organization.

I had not much choice, since money was gone, and I am not a gambler. I wrote full story to a board, and later on I delivered all papers which I could find to show all information in writing. It is my understanding that because of amount of the data which I presented case took very long time.

Last time when I checked on the case, it was my understanding that investigator recommended hearing in front of the members of the Board. But case went different way and been close without any action.

When I called and ask director of the board why this case is closed, I been told, that case is closed, and since it close he will not spend tax payer money on wasting of his time on any explanation. He probably forgot that I am also tax payer; it was not my fault that investigation took so long.

I could go in front of Superior Court to reject his decision. But I only have 30 days, and something much more important was planned for this time, and I was out of the country visiting my mother grave, so I just let it go.
Why bother? It is no justice anywhere. I just hope that whoever had I chance to read this story will not be as trustful as I was. For me this purchase was not just a buying a house..

It was another dream of getting into larger family (and this is why I was planning to buy larger place and Rimma place end up being not big enough to fit us all comfortable). All of it got destroyed.

I lost a dreams, money, health and even worse - any believe in the justice. And in my opinion it because I never could imagine that such a story is possible. Thank you to this side that I can warn other people to be more caution and hopefully it will help others to avoid all pain and aggravation. Unfortunately most of people never heard about this side, especially in Russian Community.

As of Rimma reply about me and this entire story, I wrote true and to who is public believe it does not matter. But just to be careful and not got victimize like I did.

These are false accusations, as ruled by the real estate licensing board!

All of Ms. Ludmila Nayvelt's accusations against me are absolutely false. Ms. Nayvelt has tried to manipulate me in several different ways and even filed a complaint against me with the Massachusetts real estate licensing board (located at 239 Causeway Street, Boston, MA 02114). Please bear in mind that this is the Massachusetts agency specifically responsible for making sure that real estate brokers act ethically and that innocent consumers are protected.

The board extensively considered and investigated Ms. Nayvelt's report and concluded that Ms. Nayvelt's complaints have absolutely no merit and that I acted ethically and appropriately toward her. The board upheld all of my actions and issued a final resolution denying Ms. Nayvelt's complaints.

I recently found out that, condo which I was planning to purchase was sold. My Deposit of $25,000.00 was never returned, despite of the request from my attorney, based on my unsatisfaction of condo documents. I lost additional money on attorney and medical bills due to stress. And city of Newton, MA published official size of the condo which is only 1652 s.f. not even close to the size of the condo as it was advertized 1836 s.f., based on which my offer was made and P&S aggreement was signed.
Rimma Pevzner/realtor was poorly doing her job, while she was also trying to sell my property: she incorectly advertised my condo, even after my review and corrections on MLS,the materials which she was passing during Open House and was not available for my review was not presented accurately, plus it was invasion of my privacy (while she was holding open house, she turned on and started to use my computer without getting permition from me). I complained to her boss Re/MAX executive Realty. It is my understanding, that in responce, her boss helped her with one of the best and expensive attorneys in Boston.
My question is. If those sharks are protecting each other, because they have so much money, how we, simple consumers, who have hard time even to save some money for down payment in such of expensive market, can be protected from those sharks, who just make money from us. Help !!!! I am a single mother, and for me losing over $25,000 plus attorney expenses and etc. is very devastating expirience. And what is even worse I do not feel to beprotected as a consumer and scared to deal with realtors after this terrible expirience.

I would like this story to get to media so other people like me can be more cautious in dealing with real estate.
