 Broker and agent knew in advance that this property could not be rented and perspective tenant would not be approved pending HOA litigation...We were told the unit was owned by a man and wife when in fact it wasn't. We are still waiting for the paperwork that entitles them to even lease this property....We found out the unit is in several mortgage lenders hands, 3 to be exact...The unit hasn't been lived in since it was built 8 years ago...It needs mold and radon testing which they told me would be my responsibility, as well as repairing all appliances, heat, a/c, plumbing ETC...

I'm only the tenant and should not be responsible for repairs in this community...Nothing but lies from beginning to end....Don't trust these people..The broker told me that it was my fault that the HOA didn't want me as a tenant, that I was rude, vile, disgusting and many other derogatory remarks. The broker also told me she spoke to a certain person at the HOA who gave her all this information on Thursday morning..This perticular person left her position in the HOA on Wednesday, so that was another lie..

In fact the broker was rude as could be and still will not provide the correct paperwork that gives them the right to lease this property...And the information and paperwork from the HOA attorney...

I have reported them to the consumer affairs dept...Attorney Generals office...Realotors Board in Fort Meyers and have made the community HOA aware of their behavior...

My name is Steve Manderschied and I am a Real Estate Agent with Re/Max Sundance Realty II.  My Borker/Owner is Renay Montague.  This rebuttal is in response to the alleged scam attempt posted by Mr. John Ferro reagrding a Town home we had adversied for rent in Estero, Florida. First I want to state that I just became aware of the posting on this site, had I known earlier I would have responded earlier.  Mr. Ferro contacted me about this town home which was adversited for rent.  I met with Mr. Feroo and his wife, showed the property, and they wanted to move forward with application.  When I contacted the HOA for the application,  I was notified by the HOA that there were still some outstanding fees owed.  The Owner of this property, Indiania Home Servicing, who hired me to find a tenant, is an investor out of Miami, FL.  This investor had just purchased this property from a foreclosure sale. When the HOA notified me regarding unpaid HOA fees, I notifed my client.  After looking into the situation, this property has a Master HOA as well as the Town home Communinty HOA.  The fees were paid for the Town Home HOA at time of the foreclosure sale purchase, but my client, the current owner, was not aware that there was a Master HOA as well.  This can be a common issue when properties are purchased from foreclosure sale.  My client, owner of property, made a request to the HOA to determine how much was owed to the Master HOA so that issue could be resolved, paid, and Mr. Ferro's application could be processed.  I contacted Mr. Ferro to inform him of the current situation and that the Owner of the property was working on resolving this issue.  Mr. Ferro immediately started to accuse me of trying to scam him out of money.  He claimed that this property was owned by a bank and we had no right to rent this property.  Mr. Ferro was very rude and would not listen to reason when I attempted to explain to him the situation regarding the Master HOA.  He called my Broker and made false accusations of fraud and attempt to scam.  He also contacted the HOA and made the same false accusations.  Given Mr. Ferro's actions, the property owner, my Broker, and the HOA decided that we would not rent to Mr. Ferro.  The owner of this property, my client, paid the Master HOA fees that were owed and unknown to them at the time Mr. Ferro was interested in renting this property.  The property was rented shortly thereafter and has since be re rented to another tenant. There is no issue with the HOA and the property was and has been owned by my client prior to Mr. Ferro's inquiry and still is to this day. I have been in the Real Estate Business here in SW Florida since 1993 and take great pride in my honesty and professionalism.  Furthermore not once did I ever ask Mr. Ferro for any money, nor did he ever paid any money to myself or my Broker prior to him making these false accusations of fraud.
