I received a phone call from Rephen Law Firm stating that I had several returned checks and that their client "Telechek" had retained their services. I did indeed have several returned checks, but to my knowledge they were taken care of. The date on these checks date back to July of 2008. When I asked why I had not received anything in the mail from them, she stated that they don't mail anything to you. They have been leaving me messages for about 2 months saying that there was an urgent legal matter and I needed to call them back. If it was soo urgent, why didn't they contact me by mail? She also advised me that my court date was May 14 and this needed to be taken care of before then. My understanding of the law is you have to be served with some sort of papers before there can be a court date. Isn't this correct.

Also, don't they have to show you proof that you owe these monies? The checks I had totaled about $2300.00, but she said the client was willing to settle for $4000.00. I called Telechek to talk with them about it and I was told they couldn't tell me anything because the account had been sold to another collector. Telechek couldn't even tell me if the debt still existed. I really don't know what to do. I no longer have the records for these checks. I don't know now, after receiving the phone call, if it was ever taken care of. My question to anyone is, should I call Rephen back and try to make a settlement with them, or should I just let it ride. Also, what can they legally do? I don't have the money to pay an attorney, much less pay them $4000.00. Any suggestions?
