Resurgent Capital Services LP left a voice message on a secure NERC (National Energy Regulatory Commission) contact line and indicated the person they were referring to was at this number and by not hanging up you confirmed you are this person, even though it was on a voice messaging system that will not hang up until message is completed. Apparently they do not have an individual or person to physically talk to whom they are looking for and verify there contact with them. It is also apparent they do not know the actual contact information for the people they wish to speak with, or they would not have called a national secure number as they did in this case.

Fortunately this message was reported to NERC as a violation with possible implications following. As a individual, by indicating that a voice messaging system takes the responsibility of accepting such verification and expecting this to hold legally, is a stretch on their part! The call made by this company crossed the line of business ethics and they should be dealt with on a legal level. It is unfortunate for people that such companies exist.

for a civil suit for FDCPA violation.

Any debt collector that leaves any message on any phone system does so it their peril. They can be hit for failure to identify themselves and that they are attempting to collect a debt or they can be hit for 3rd party debt disclosure.

It is FOOLISH for any debt collector to leave a message on a phone system.
