As the heading states: This (family of companies)is sure going to alot of trouble to harrass us over a huge debt over $1300.00 they cannot or will not show actual proof of. And after mailing/ calling/ credit bureau investigations and calls-
(all useless)They have ruined my husbands credit report and keep passing a supposed debt around among their different company names. I have written doumentation that they were to provide written proof/ via mail with FCRA rules etc.

This host of companies are known as so many aka's all with new or different LP's etc.- re: Sherman Acquisition LP/ LLP/ II-LP/also TA-LP,and LVNV Funding LC/LLC/ LVNVfundingCompu/LLC. Resurgent Capital Services LLC/ LC also: Allied Interstate,
etc. This has been going on for years.
For some reason they will not prove this debt is actually owed (which it isn't, it is ficticious) and keep spending the money to ruin the credit report. Especially TransUNION. These are information and supposed bad debt collector? companies, who are buying our lives and selling them on paper and we are the ones who have to write letters. After a call to TransUNION, a rep asked me the SSA # - she looked up the file and spoke with me
she verified to me in front of my husband that all of their transactions are verified electronically.
Careful notes were taken name, time, date etc.
(ALL WRITTEN DOWN) She spoke with me about someone elses report over 15 minutes and NEVER ONCE asked my name. She just gave out detailed information on my husband. I could have been anyone.
Also the FCRA was contacted by phone and a young man named Herschel was asked a few petinant questions, but was rude, careless, and told me simply that in order to get any help we would need a lawyer. A LAWYER?????????
We are not safe in this country unless we have and can stay on top of these companies. Money and abuse of power will get you almost anything these days I suppose.
Who can really help us? We do not have alot of Money and Power.
Just our good little selves.

My suggestion is file a complaint with the Federal Trade commission and your attorney General office of your state. Ignore the coachroach deadbeat collector. He is part of the legalized mobster organization that preys on innocent people.

The website address is FTC.gov The more complaints they get. The more likely they will put these lowlife thieves out of business.

Follow Steve from Florida's advise. Don't talk with these coachroaches. They are blood sucking mobsters that violate Racketeering laws.

To the coachroach that responded to this. Go back and crawl under the rock you came from.

I cannot just stand by and let someone jump in with such horrible advice. You must obviously be a debt collector, and most likely for Capital Management.

Only a debt collector would try to justify a reason for someone to speak with a debt collector on the phone. This is simply bad advice.

Debt collectors use intimidation and misleading statements to get "debtors" to reaffirm a debt that may not have been legally collectable in the first place, or to get information they can use against them. Most debtors are not up on the law or their rights and usually end up in a worse position due to speaking with them on the phone.

A debt collector has only one mission. Collect money. They are not interested in the fact that the debt may be past SOL, or have no documentation, or even the fact that they have the wrong person, or the debt has been paid, etc.

The entire burden of proof is on the debt collector. This is why everything needs to be in writing. My point is, if you have a legitimate case, WHY do you need to speak to the debtor? Just send one notice, then file a lawsuit. Very simple. No need for conversation.

FYI..Capital Management DOES report to the credit bureaus. I can show you. All collection agencies do.

I can not help you with the problems you had with Transunion, nor with the problem with FCRA, but i can explain how Capital Management plays into this-

(not many reps know what this client is because it is rare and old) Apparently people fell behind on it and then the balance gets to this large amount.

First of all, STAY OFF THE PHONE!! NEVER speak to any debt collector or credit bureau on the phone. Phone calls never existed.

DO EVERYTHING in writing and by certified mail, return reciept requested. be sure to put the certified# on the letter itself and keep a copy for your records. This is very important, as you now have made them accountable.

By the means above, send a dispute to each affected credit bureau. Be sure to invoke your right under the FCRA to be provided with all communications involved in your dispute. This holds them accountable, and they know it. This way they cannot just say the itenm is verified, they have to prove it to you.

Also by the means above, send a dispute to the bottomfeeders doing the collections. Deny the account, and demand full validation of the account. Be specific and demand to see the original signed contract, as well as a full account history and itemization of all charges. Also demand proof that they own the debt or have the legal right to collect on it.

With these things done this way, you will win. The items will vanish from your credit files and the collections will stop.

If they don't, you sue and get paid for the FDCPA and FCRA violations.
