We purchased a new home from Reynen and Bardis Development in December of 2002. This has been the worst home buying experience we have been through.

Immediately after we moved into the home the walls began to crack. Reynen and Bardis claimed this was normal settling and we should wait until our 90 day report. We waited patiently while our home continued to crack around us. At our 90 day time period we turned in our report. There were may items on this report including minor fixes that needed to be completed as well as major structural defects. It took Reynen and Bardis from March 19th 2003 (the day we turned in our 90 day report) until August 7th 2003 to correct the minor fixes. We are still waiting on the major structural issues to be address.

Our home is now cracking even worse. Walls, floors, outside stucco, walkways, and ceilings have all cracked. We have spent thousands of dollars to hire our own engineers. They have determined that Reynen and Bardis used incorrect building practices when constructing our home. It has been 10 months and Reynen and Bardis has refused to fix any of our structural issues.

Please do not purchase a home from Reynen and Bardis. This has been a very long and stressful process for my family and I don't want anyone else to have to deal with this nightmare.

We have had a huge amount of public pressure put on Reynen and Bardis and they have started to move, but they still have yet to fix our home.

And builders claim home owners don't give them a "chance to repair defects!"

Your state is one of many, I believe, in which builders lobbyists convinced the legislature that home owners are filing suit without even notifying the builder of defects. They have laws passing in several states, despite consumer protests, called "Right to Repair" type laws. It essentially restricts your legal recourse when a builder builds defectively and breaches the warranty. There is a chapter of Homeowners Against Deficient Dwellings in California. The national site is www.hadd.com In the meantime, document everything and be sure you can prove in writing that you notified the builder of the defects. If you only have verbal conversations with them about it, they can deny they were ever notified. I'm very sorry you're going thru this...i've been thru it too and highly recommend HADD, especially to buyers who have not yet bought...once you have bought there is limited help anyone can provide, despite a MYTH that it's easy to sue a builder. Good luck and hang in there...and do contact HADD.
