The State Medical Board of Ohio states that officially they have a confidential' ANONYMOUS PHYSICIAN COMPLAINT SYSTEM where anyone complaining about a physician, care problems, or hospital system, won't have their name(s) known or any liability for a false claim assessed. This system' actually is confidential' only if the physician doesn't have friends' on the State Medical Board in Ohio the right' physicians in Ohio (with multiple patient complaints in a dead' file) get their complaints so that they can defend or file an anonymous counter-complaint.

This is what happened to me in 1991, when as a physician-patient I complained about fracture care attempted by a physician untrained in and unable to do the care, and a hospital where they didn't have the proper equipment to reduce or care for the fracture in the ER Hillcrest Hospital of Mayfield Heights Ohio. And instead of fining the hospital or telling the physician not to do care that he wasn't trained in (hand surgery), my medical license was taken for making too much.' And I couldn't even get the medical records from the hospital or physician any documentation of care that made any coherent sense (office dates & care were made up and who would know because everything is so outpatient').

My CONFIDENTIAL complaint to the Ohio State Medical Board was given to Hillcrest Hospital in 1991-2 so that they could accuse me of an impairment' that I couldn't handle the bad care -- not in any state law as an impairment. So certain physicians in Ohio get their patient complaints so as to correct their files, and most do not but the system isn't confidential,' fair or objective, and this makes malpractice insurance rates higher for all as no one knows what really happens with all the disciplines, etc - the facts. And my case' that I complained about a deficient situation was put ahead of piles of cases against physicians with multiple patient complaints. The Ohio Board finds a scapegoat' and table the confidential' complaints of physicians the Board Members know; the Hearing Officer system is a joke of talking heads.

Ohio medical licenses are lopped off like heads in French Revolution guillotines; for not sending colleagues enough patients, disagreeing with a colleague, being late with child support payments (ex-wives can make confidential' complaints and say anything), or for just making too much' of a problem that the Board doesn't think is a problem. Anything goes at the State Medical Board of Ohio, and you can't get the confidential' file to prove this medical license fraud; the file is continually changed and State Representatives admit that and laugh as this fuels legal costs and pays for the legislative legal lobby.

Most other 49 states don't have anonymous complaints, or won't investigate such complaints, and none keep complaints confidential' after it becomes obvious that the complaint was a lie as has happened with my case where the State of Ohio keeps wanting psychiatric goes' at me for saying No' to and finally reporting Dr. Nice - while admitted the falsification of the case???? in front of State Reps/Senators. They admit that they can't prove my case but won't dismiss it after 16 years. They can just order 'evaluations' on Ohio physicians with a new 'right' psychiatrist for existing, even though the Board is not your physician, and your medical insurance won't cover this misuse of psychiatry for politics.

There are built-in abuses for the physician complained about in these Ohio pseudo-investigations where the complainer insists on anonymity' the exaggerations (putting your name on a document means that because you are liable' you are more careful about details and facts, and that the facts can be verified publically) can't ever be proven but aren't disallowed, the inability of objective witnesses to step forward before years of time have elapsed (16 years in my case), the inability to verify the complaint before investigation and discipline of a physician (then you are trying to reverse an injustice while they try to find something else wrong and you have to pay for rehab & rechecking of your skills as Ohio doesn't do damages), the inability to correct mistakes in a timely manner, and the lack of due process which occurs with that kind of complaint or physician censure. And finally physicians WITH NO PATIENT COMPLAINTS are tabled in this way, leaving medical care in the capable hands of physicians in Ohio, like Dr. Timothy Nice and Dr. Carla O'Day, with multiple confidential' complaints.

Our office had over a dozen complaints about Dr. Nice's care and behaviors, and Geagua Hospital (Chardon, Ohio) took him off the active staff roster for care complications and behaviours during this time 1990-2. I'm being 'punished' for saying something about what a lot of physicians, hospital systems, and patients have noticed.

Even Governor Taft tried to get Carla O'Day MD investigated in 2005 and it was a 'rain dance' of any investigation; an investigation among 'friends.' And in Ohio no physician or Member of the State Medical Board can admit a mistake with the lack of mistake laws (which 35+ other states have to prevent abuse of a patient or physician-patient with a missed diagnosis what I had causing my bone pains). Besides botching care or missing diagnoses, the complainers or counter-complainers could have asked the physician out on a date, expected personal' things or the fulfillment of personal needs,' expected patient referrals in double digits but no one, not even the public that this system' is supposed to protect knows the issues (what any 'case' is really about) and what the State Medical Board of Ohio is doing; what types of complaints and who they are investigating or not investigating. It's all anonymous.

Even Dr. Nice's 2 kids think I'm the 'bad woman' and I sent him over 10 notes saying that I wasn't 'interested' and that he had a wife, had my mother try to speak with him, and sat down with him 10/1990 that he 'had a very lovely wife' and I was a colleague ONLY = there wasn't anything more that I could have done to try to make the situation CLEARER; Dr. Nice is a first class sleaze and I don't feel 'sorry' for Mrs. Nice who goes after women that he targets without cause (her article about me in The Sun Press).

There is no review of Medical Board decisions; the State Court of Appeals strikes down the obvious miscarriages of justice, as they did in my case, but won't hear or dismiss the case because Ohio Courts won't/can't censure or admit that the State Medical Board of Ohio is corrupt and fakes evidence. The piles of quotes given to the State Medical Board of California in my situation were entirely fabricated, never said ONE of the statements, and the letters were written only because I asked both orthopedics to sit down and discuss that I couldn't work the way that they left me but if I said this in person, I was seductive.' Only one Member of the State of California Medical Board questioned these rather obvious lies/quotation she-saids -- and he didn't pursue his line of questioning to clear the matter up. No one questions other State Medical Boardsl; was never allowed to defend myself in any way.

No case illustrates the problems in Ohio more than the injustice that has happened to me over the last 18 years where the physician-complainers against my license left my fractures uncasted, refused to order blood work, made all sorts of sexually-laced comments over weeks and months, expected patient referrals for orthopedic surgeries, and in general abused the situation even for 1990-2 rules. And I was the only physician involved in my situation with no patient complaints.

Women physicians are advised not to seek medical licensure in Ohio with this anonymous' system, not to get medical care in Ohio if they are ill (as it's a game' to not allow the woman physician care-to-function' and make her look inappropriate or obsessed with trying to get the right' care, and then complain about her anonymously to get rid of the competition'), to hire a lawyer if you need to write a letter or call a colleague who has botched care, and to advise patients that if they don't like a friend of the Board's care that their names will be published as two of my patient's names were when they refused to return to Dr. Timothy Nice (they didn't even file a complaint and have their names in public records).

The Federation of State Medical Boards needs to look into the problems of the anonymous confidential' complaint system in Ohio, and get the statistics on how many false cases and disciplines are occurring. Federal institutions like the Army, Navy, and Air Force need to be able to get these files to judge for themselves the legitimacy of some of these personal' complaints & disciplines a Federal review so that physicians falsely complained about can join the Armed Forces where things aren't anonymous. Currently in Ohio Dr. Nice and other friends' of Ohio Medical Board Members can get their confidential' files at the Board, but the Armed Forces can't get these files to judge a physician's worthiness for service; things are confidential' for the Armed Forces but not Dr. Timothy Nice of Mayfield Heights Ohio.

The confidential' Ohio system allows the statute of limitations to expire on abuses and malpractices that the Board should be looking into and dealing with at least in non-disciplinary improvement ways (as in Minnesota). The physicians that file a counter-complaint usually have self-serving or exhaust the statute of limitations reasons to do so in this ol' boy system. Once a woman gets into the anonymous complaint system her reputation and child-bearing years will be forfeit the Medical Board of Ohio doesn't care that you don't have a life unjustly, they just want statistics.

States that need physicians are advised to contact Governor Ted Strickland to review some of the cases of FALSE PHYSICIAN DISCIPLINES in Ohio for not going along' or fitting in' (sleeping with Dr. Nice, which Mrs. Nice should have had no worries about as I don't do that for licenses or hospital privileges) so that physician medical licenses can be cleared to work in another state, in the Armed Forces, or for the Indian Health Service. Governor Strickland needs to be doing some improving of the system' in Ohio in between lobbying for Obama.

My case has involved falsification of psychiatric evaluations and testing, ie a Rorschach test with no answers, and multiple goes' at me to try to find something wrong with my personality. Now I'm supposed to go to a 6th go' and say that everything's fine' and my health is fine' and everything will mysteriously go away for the physicians in Ohio that can't do orthopedics, blood work and can waste the life of a good physician so that I can't sue them 18 years later it was all about money and the taxpayers had to pay for this farce which Representative Dolan and State Senator Grendell just laugh about while they try to arrange another go' at me. The bone condition remains untreated, my thyroid problem causing the bone condition was left untreated for probably over a decade because the Members of the State Medical Board of Ohio didn't know what tests I needed, so that I got no blood work, or care. This is the most common thyroiditis that there is which got diagnosed in Washington DC after I broke another bone trying to work in a breast cancer lab. Not one blood test was done in Ohio, from 1990-2, that can be found before my medical license was suspended for objecting something that the Ohio Court of Appeals even overlooked in their gloss.'

For the last 5 years, Senator Grendell has made the solution that I be evaluated' by Dr. Phil Resnick who covered up the drinking of my Chief of Medicine at MetroGeneral in the 1980s, who covered up Dr. Lafferty's senility, who covered up Dr. Keith's being unable to handle a complex wrist fracture and lying about his Boards in Hand Surgery, and who covered up the falsified Rorschach by his University Hospitals adjunct faculty colleagues (they couldn't be bothered record the answers). Dr. Resnick still has a license for 'covering up' for the State of Ohio Medical Board. My medical insurance will not pay for this farce, and the State of Ohio patients are out a qualified physician, with no problems with patients, for 16 years. The solution is to open the files and see what is going on a physician in RI has offered to rehab my skills and get me back as other states need US medical grad physicians badly, and the Army can use me.

This is a plea to the Ohio State Medical Board to correct the records and let me go, as I'm not responsible for the care problems in Ohio and their mistakes and I'm not IMPAIRED, and calling Carla O'Day MD and telling her that she didn't allow me even blood work, and that I didn't touch Dr. Nice, shouldn't be 'disorderly' conduct for a criminal record in Rocky River Municipal Court. Dr. O'Day never answers the lawyer phone calls -- tells them that she's 'in the gym.' Dr. O'Day was on the State Medical Board of Ohio in 1992, despite never finishing any formal residency training (she knew Mrs. Celeste and they started a divorce support group together), and masterminded (ie wrote) the case against me for disagreeing with Dr. Nice - who she's a close personal friend and business associate of.

Dr. Carla O'Day was a CLASSMATE from Case Western Reserve Medical School, who couldn't excuse herself for 'conflict of interest' as she wanted the Directorship of Hillcrest Hospital ER, which she got after she lied to get my medical license suspended for 'making too much of bad care.' The phone tape she gave to Rocky River Municipal Court was falisifed and EDITED; all call dates were removed along with parts of messages (about how she did this for $ = a contract at Hillcrest Hospital). The Rocky River Prosecutor is her 'friend' and corrupt - he knew that the 'chain of evidence' was broken with the phone call tape that Carla gave him, and that the phone records didn't show any 11 calls in 2 weeks time = but he didn't care. The Judge, Maureen Gravens, was not re-elected. The calls are just 'sad,' where I'm pleading with Carla to stop lying and fabricating and allow me a life as she's had two marriages. Carla would threaten the Deans at CWRU Medical School when she didn't get what she wanted years ago, and her ex-husband Magistrate has piles of 'stuff' on her that has been 'sealed.'

Could someone please open the 'confidential' file, allow me to defend myself, and let me go to a state where they do not have ANONYMOUS physician complaints (49 other states)? This has gone on for 16 years now.

The Discovery CME program (or whatever it's call) has a panel of 3 REAL doctors on discussing different ailments and every time I have watched there has ALWAYS been at least 1 FEMALE doctor on the panel thus proving you are a liar.

The decision was more than correct as has been discussed over and over in your other fraudulent reports. Luckily innocent people won't be butchered by you.

Hope you feel good Rick Whitehouse - that the Ohio State Medical Board 'cheats' to get cases - bad 'physician-patient' cases because care is so bad for 'simple' problems in Ohio

#18Author of original report

Tue, March 31, 2009

Bad physician-patients are the rule, not the exception, in Ohio - with medical, orthopedic, or any care of women patients being in the diagnostic & therapeutic pits - statistical bottom. When a woman physician complains that she can't get her wrist fracture casted to preserve range-of-motion (ROM), or an endocrine workup, then she has to have her medical license suspended for 'damage control' = the new reason for medical discipline in the State of Ohio; every reason but the legal ones are used for Medical Board disciplines in Ohio. Got an excuse, Rick will use it as there is no review of State Medical Board of Ohio decisions = they are the law unto themselves = like God.

Rick Whitehouse can't run a State Medical Board where wrist fracture care, or thyroiditis, are done correctly from diagnosis to treatment - so he runs an Ohio State Medical Board to contain mistakes - for legal fees and false complaints. Orthopedics in Ohio can't cast fractures, even with the 'right' materials, so if the physician-patient complains, this becomes a reason to take her medical license - to cover-up for the 'boys being boys' - Rick included. Anita Steinbergh DO just loves the 'boys being boys' - so they 'never grow up' = Peter Pan style. Anita Steinbergh DO is now going to be on the State Medical Board until 2012 - as there isn't another possible DO choice in Ohio?

Then if the reason for the reoccurring fractures can't be determined, because the boys don't know what tests to order (don't know their stuff those orthopedics, and can't open a Textbook of Medicine as it's too heavy, TPO antibodies anyone?) - then take the woman physician's medical license for another decade - while the boys 'figure' it out. It has taken 17 years for the boys (including RICK1957) in Ohio to figure out Hashimoto's thyroiditis; 17 years to open a Textbook of Medicine or Google the multiple-fracture-syndrome workup. And Eileen is still in the medieval Dark Ages - where women do whatever men tell them to = she doesn't have an independent thought.

Something needs to improve in Ohio, and it isn't the number of women physician disciplines for complaining about the wrong or inadequate care. Someone please ask Rick what thyroiditis is, and how you cast a wrist fracture to preserve ROM (Answer: before 5 days or 3 weeks time).

The original 'confidential' complaint was put together by a Hillcrest woman attorney sleeping with the attorney that was hired to try to resolve the care problem mess by the woman physician

There's been enough taxpayer monies spent over a 'confidential' complaint fine-tuned by a woman Hillcrest lawyer sleeping with the lawyer that was hired to try to resolve the mess - he saw the 'confidential' complaint in 1992, along with every hospital system in Cleveland by now, and then I guess was helping her hoping that Hillcrest would hire them both as a 'team' - the dream team to get a hospital out of negligence with a staff member harassment situation.

The problem was that the wrist fracture care at Hillcrest was awful generally, negligent, and then everyone tried to cover up and lie - the worst possible medical scenario. The hand person didn't get called on purpose. Hillcrest physicians were cutting corners that resulted in morbidities - hard to know for a person new on staff temporarily. And part of it was the hazing of women physicians that had gone on for decades - the harassment laws weren't there yet - like so what you have fractures, just use a splint and no need for a cast. . .Then other staff members at Hillcrest were told it was just 'carpal tunnel.'

This is basically get back at the woman physician who was the victim of harassments, hazing, and negligences that went into medical care inappropriately - feelings and hatreds that interfered with any care - because that's how things were in 1990-2. It was unfortunate, but the tragedy was how the State Medical Board handled it to 'save' the boys being boys. All the Ohio Medical Board should have done was improve the situation at Hillcrest instead of taking the woman physician's medical license for 17 years - until she admits that she made the boys 'do it' and says that things are 'fine.' Things will only be 'fine' when relationships between male and female colleagues improve - not yet even - because there has to be mutual respect and a Medical Board that fosters that mutual respect and professionalism. And for that to happen this case needs to be dismissed and the problems improved; care & colleague. But acting with more evaluations, deliberations, hearings and appeals - without any patient complaints - and a pile of lies and documents where both sides were 'sleeping together' - well that makes the public total fools to fund this for 17 years. And all the signers of the Hillcrest 'confidential' complaint knew that the guy lawyer was sleeping with their woman lawyer - it was a locker room joke - and they had the 'case in the bag' as the woman just being 'paranoid' about bad behaviors and fracture neglect - what patient wouldn't get scared with this or try to get away and get help?

State Medical Board orders 'evaluations' to disclose/investigate a woman physician's dating history if she disagrees with a male colleague about care practices - woman MD has to prove that she doesn't have a 'personality disorder'

#18Author of original report

The State Medical Board of Ohio can't just improve women's care practices when a woman physician complains justly about malpractice & orthopedic negligences - the Medical Board of perverts first 'goes after' her that she has a 'personality disorder,' with endless sexual history/dating evaluations (5 so far = 'goes'), that prove that she has to 'disagree' with men - even if the male medical/orthopedic care was wrong - by implying that she isn't 'experienced' enough in the male way to have a 'normal' woman MD personality - a personality that wouldn't report a MALE colleague's misbehaviors if she got enough on the 'side,' or was 'normal' with men sexually - she would just 'gloss' over the problems.

Professionalism, or being able to disagree should NOT mean/equate with a personality flaw, or require that you list your dates/experiences to show that you are MALE 'normal,' and a JUST good professional wanting to improve things in backwards Ohio - that doesn't exist. In Ohio, per Anita Steinbergh DO, you have to have Oslerian 'aequanimitas' for male indiscretions/misbehaviors, and learn to 'handle' them before you can keep a medical license = you can't report a male physician no matter what he does to you - even beat/bruise you up.

Covering up not casting fractures for 3 weeks, which happens all the time at Hillcrest Hospital/University Hospitals Ohio, and trying to get paid for it as Hillcrest Hospital Ohio orthopedics do - covering up is mandatory - or you lose your medical license in Ohio for not 'going along with the boys' cheating and cutting corners - the fractures will eventually heal or so what? the patient loses hand funtion - either way it's a one big Team Ohio 'game' for the orthopedic 'boys being boys.'

Under Tom Dilling and Rick Whitehouse Executive Directors (1999-2009): The Ohio State Medical Board, when you as a woman physician complain that you can't get your medical records (from the boys) or take any more 'cute' hazing harassments (from the boys), then goes after your dating - sexual history - for hours & days/decades with names and dates, for public records and humiliations - to try to show that you don't 'give out' enough and this PERSONALITY DEFECT is why you report male physicians for not doing the 'right' MEDICAL or ORTHOPEDIC care; that if you gave out in sexual ways, you would cover up in medical ones, and thus you have a GENERAL personality flaw of male understanding that needs Medical Board 'help' - too PARANOID about males and male functions.

Why I didn't like Dr. Nice in a 'friendly' womanly way has been discussed for 17 years now - he was married with 2 children, totally not my type, but that shouldn't matter for staff flirtations and comments (male prerogative and 'divine right' of 'boy kings'). . .Even if giving out in sexual ways means being attracted to, and 'hanging' with male physicians with two children - that's what Ohio law requires; that male physicians, just out for some colleague college-style fun with the 'Catholic girl' MD who is supposed to be 'easy' get what they want without a fight or second-thought - or they do the 'confidential' complaint thing - and what's worse?

In other words in Ohio, if you don't give out indescriminately sexually with colleagues, then you won't cover up for the boys in the team sport of medical care, and you shouldn't have your medical license - until you do enough 'sexual' giving, to show that your personality is 'Ohio normal' = Carla O'Day MD 'normal' (2 husbands, plenty of dates/affairs/flirtations and 5 kids). All woman have to be 'Carla O'Day' proven 'normal' = the standard.

This will then equate to the professional practice of not 'whistleblowing' on the boys - because they then have enough to trash you for your behaviors on the side - to silence you. And if I was really drinking while trying to deal with Dr. Nice's fracture mishaps, my license would have been gone long ago - the Board still doesn't have that 'case' - but they keep trying to find it with shameless public misinformation. In Medical School (1976-1980s) the attendings knew who the woman MD students were dating or sleeping with, in residency at Metro they didn't care that you lived with someone, just that you didn't get pregnant = Dr. Carter would fire you in the 1980s for this. Getting married and having children was too 'responsible, for the medical community - it took you out of 'general circulation' with the guys.

But in other words, in 1992 I didn't have enough trash for the Medical Board to shovel into public records to make me 'shut up.' And I need that 'trash,' and to be able to say that everything's 'fine,' before I get my medical license back to practice like Dr. Nice & Keith do - with cruel callousness and with NO regards or thought to prevention or improving medical care for women patients. The male guys just want to 'learn' from our cases, and the sexual experiences with us - Medical School, and the State Medical Board of Ohio, just makes things more available.

Only in my case 1992-2009, at the State Medical Board, my not giving out sexually to every Ohio male who sees me out the Hillcrest Office Medical Building window, is criteria for a 'personality' flaw that means that I PROPHYLACTICALLY had to lose my medical license in 1992 - until I would show that I give out personality-wise (to the Dr. Nices) and hide the male indiscretions with patients = the total corruption of a personality for state purposes.

Hasn't happened yet. . .maybe Rick Whitehouse could find a new way to corrupt and manhandle women physicians for Medical Board 'disciplinary' sport. This certainly isn't about PATIENT CARE, but what does MR. WHITEHOUSE know about patient care? - he just wants to know how many men, what dates, and how far I went? Rick isn't satisfied after 5 evaluations of this? And the public and the legislature just let this farce continue (Speaker Budish of the 'accept the Medical Board ruling') - while even the CEO of GM had to resign, Mr. Whitehouse continues unchallenege in economic hard times.

Re the case against me - Dr. O'Day had 2 choices in 1992: (1) side with me that there were orthopedic care problems with fractures at Hillcrest or (2) slam me for life and vindicate Dr. Nice to get the ER Directorship

Look it seems that no one: not Dr. Varyani, not Mr. Whitehouse, not Senator Grendell, not Speaker Budish, not Senator Coughlin, and not Governor Strickland - gets 'what happened' with my complaint, the medical license suspension for being a 'bad patient' and ratting on the care problems at Hillcrest Hospital, and why all the horrible exaggerations and lies about an MD who generally gets along and has no patient complaints - but now has been beaten up twice and taken out of medical practice for 17 years, hoping she would die, because the care that happened was suable, negligent, and shouldn't happen IN ANY STATE and everyone LIED prodigiously.

In 1992, The Medical Board let Carla O'Day MD - then on the Medical Board, though with little 'clinical maturity' - run the investigation against me for 'making too much of bad fracture care' and complaining about Dr. Nice. Carla O'Day (then Streepy) was in the class ahead of me at CWRU School of Medicine, and in all but name in 1990-2, the Director of the ER (Emergency Room) at Hillcrest Hospital (she had the contract and was there several shifts/week at least). ER shifts twice/week are full-time work.

Dr. Timothy Nice however, had a final say in which physicians got those Emergency Room (ER) privileges at Hillcrest (I didn't have them & never got them as I didn't 'go along') to accept a patient from the ER, who got the ER staffing contracts, and who got the Directorship - that Carla O'Day was directly-in-line for with all the bonuses and job securities that it meant for someone after a recent too highly-publicized and expensive divorce. Despite being an awful clinician, Dr. Nice had huge powers at Hillcrest to 'make or break' staff members, as he would continually threaten - and I'm sure he informed Dr. O'Day of her options in this regard as he did me.

When I complained to the Medical Board in 1991 after trying for months to get Dr. Nice to sit down & DISCUSS, and I didn't realize this initially as I just wanted the medical records and for Dr. Nice to stop and let the consultants try to salvage the fracture mess quietly without his interference, Dr. O'Day was allowed to supervise the investigation and all the ordering of me to evaluations, and manipulate what happened with those evaluations (the answers) - which wasn't fair, ethical or professional. The lawyers objected but were told they had to 'live with Carla.' Dr. O'Day, despite having every conflict in the book, got my complaint to process, and she would directly profit only from one resolution - not even an impasse would have satisfied Dr. Nice's taste for 'blood and vengeance' - Nice wanted justification even though he was directly wrong about the care he tried on me, abusively wrong.

Carla O'Day MD was my competition from day#1 in medical school; in classes, on clerkships, for residencies and in the job market in this area.
So from the start, Carla O'Day was very prejudiced (she's not a saint) - even though I had a big point about Dr. Nice's overbearingness, his taking over, his mistakes, and his refusing to refer and telling other physicians not to help me. Carla O'Day had those problems, or similar problems, with her ex-husband, but Carla had hated me from Medical School, and I didn't respect her because she 'cut so many corners' in her classes, clerkships, and was entirely self-serving. Carla O'Day will never help you out unless there is 'something it it' for her; she's always got her calculator out for risk/benefit calculations.

And Carla O'Day MD in 1991-2, saw me as keeping her from HER ER Directorship, delaying it with my case & hearings; she had an ultimatum to please Dr. Nice and she knew it - he had the key to the Directorship -she wanted the instant money. This pleasing of Dr. Nice, then in 1992, meant delivering my medical license on a platter (like John the Baptist's head) - so that he got out of any liability for nearly destroying my hands with care that he had no business or training to try (no reason for pushing his care on me) - Dr. Nice has got a volcanic ever-expanding ego which is not-so-nice, and he doesn't know when he doesn't belong on the case. Dr. Nice does not know his limitations; what he's good at and what he bungles.

Carla O'Day would have lost her ER contract at Hillcrest Hospital if she didn't 'deliver' and have my medical license forfeit - Dr. Nice was that 'out to get me' even though he knew that he had lied and put me in an impossible situation - he knows this to this day & is afraid of re-opening the case and that it will, with hindsight, produce another outcome. And the situation was so wrong, that everyone involved is afraid of re-opening = that it will mean disciplinary actions or fines for Drs. Nice & Keith - who blatantly lied their heads off to save themselves. The statute of limitations has expired for me, but not for the Board. The case has caused a colossal waste of time and money for the State Medical Board of Ohio.

Dr. Nice had tried to do fracture care that he had no ability with (he was a hip & knee guy), and then refused to refer because of his ego/fear of malpractice - Dr. Nice can't admit a mistake, and he makes plenty of them - which everyone at Hillcrest knows. A lot was kept from me when he started sending me patients without my consent - other physicians didn't want to accept his consults, and I had no choice as the new MD on staff = bad karma.

So Carla O'Day MD was left investigating herself & friends at Hillcrest - her ER was not functioning very well when I tried to use it, and then she was doing what she always does - the lies didn't matter - she opted for the choice that would 'show her the money.' The Board of Medicine knew this, and Hillcrest & Dr. Nice knew that they had her 'number,' and that she would lie and manipulate the case for Hillcrest & Dr. Nice - which is why the case needs to be opened and externally reviewed for the money 'trail,' the 'confidential' complaint responded to and the signers motives checked. Was the 'confidential' complaint a complaint meriting investigation - was there ever a case in this mess of accusations and counter-accusations? Every signer that I know stood to benefit in hospital privileges, contracts, ER privileges, etc at Hillcrest - all of which Dr. Nice had a controlling say-so regarding.

Many of lies in the reports and findings are Carla O'Day's suggestions - they read as Carla writes, ie crudely, inaccurately, and without making any sense but including a lot of psychiatric name-dropping. All the psychiatric diagnoses thrown at me were Carla's suggestions to get Dr. Nice off for not being able to cast a wrist fracture for 3 weeks - that I was 'paranoid,' or a personality disorder - if I questioned his non-care.

Dr. Nice doesn't KNOW his psychiatry terms to throw them around like a polo mallet. Regarding the paranoia or making too much of horrible negligences: well, my medical insurance and every consultant questioned Dr. Nice's behaviors and care, including the Mayo Clinic in Rochester MN. My medical insurance was paying for all the salvage, asking why it happened, and the case gave the Mayo Clinic a very bad headache and Mayo Clinic wanted me checked/evaluated/helped for allowing the physical abuse.

So Mr. Whitehouse: there is no case against me, the care I got was bad, and the lack of blood work kept me fracturing well beyond what any other patient would have endured silently - and I'm no saint. The Medical Board in 1992 had my medical license pulled so that I couldn't continue to work up myself as well as to let the statute of limitations expire for Dr. Nice, Dr. Keith, and Hillcrest Hospital (and Dr. Lafferty at University Endocrinology). Other Members of the Ohio State Medical Board looked the other way for all these ethical blunders, as Dr. Suppes called in his IOUs for getting most of them on the State Medical Board of Ohio in the first place.

Dr. Suppes is Dr. Nice's neighbor in Gates Mills, and their wives ride horses together at the Gates Mills Hunt Club or did in 1990-2. Mrs. Suppes controls Dr. Suppes, as mostly it's her money - their expensive lifestyle and homes - and Mrs. Suppes got on Dr. Suppes because of lovely Mrs. Nice - who has no knowledge of how her husband hurts patients and colleagues = or does and lets it happen = sensitivity chip missing in both and more.

This case needs to be over and dismissed to let me move on and rehab/recheck my Internal Medicine skills in another state. The statute of limitations has expired, you've all made your point that women physicians are supposed to take it and die silently, and I almost died, but I not only had fractures, there was a missed endocrine bone problem - something that everyone of you would sue for if it was missed in your care. Haven't I suffered enough in losing everything to make a point that can't be made? There's never a reason to lie in medicine - it just makes things worse. The rare diagnosis would have got Dr. Nice 'off' in 1992, but Dr. Nice didn't just wait and see, he rampaged.

And EVEN Carla O'Day would sue for the missed diagnosis that I had - it was just her miss too in the ER situation and while sitting on the Medical Board (she missed the non-existent blood work/workup); administrative malpractice is a possible for her - so she's not for re-opening in 2009.

You are asked to dismiss this fraudulent case - where everyone has already collected the money and paid the IOUs - and to let me go as a template case for reforms at the State Medical Board - reforms which hopefully would allow for mistakes, egos, and a decent humane way to acknowledge the medical gaffes and get the patient to the next physician to fix them IN TIME to decrease the MORBIDITY & MORTALITY. The above way of handling mistakes, by villifying the woman physician who initially tried to be everyone's friend, and was no one's friend enough so that she could get even decent fracture care, has got to go. This is wasting Ohio taxpayer monies for 17 years = you need to give Speaker Budish an estimate of the money involved - 'show him the money trail' for starters, then explain Carla O'Day running a case at the hospital where she worked, was on the staff, ran the ER and where she stood to profit if I went 'down.' Carla O'Day had only one option in the end.

It's amazing that that town functions at all. By your account everyone (except you) are incompentent, involved in a conspiracy, against you, etc. But what's you're point? Why not concentrate your efforts on more productive activities.

Here's 400+ pages of public record on this matter to give the other side of the story.
