My wife has been hounded by the unprofessional people that work for this "attorney firm." All they are is a collection agency that hides behind the "scary" name of an attorney, which in some states is being found to be illegal, false and even deceptive to say the least.

I've successfully dealt with such low life collector tactics with large "firms" and agencies before, and am now getting ready to tackle these morons.

I prepared the cease and desist letter for my wife, and will be sending it out via certified mail along with an order for no contact. I hope that they violate the law and continue calling her, we could use the extra money. lol

Rule One: NEVER work with a collection agency. There is NO law that says you need to, nor do you even need to talk with one when they call. Give them NO information about you whatsoever. Stop 'em in their tracks...I do!

You can work with the original creditor IF you truly do owe a debt, which is usually much much lower than what they are claiming you owe. If enough people would understand how to deal with these low lifes, then collection agencies and the morons they employ would be a thing of the past. They don't deserve to exist. WORK with the original creditor only, no exceptions!

These morons are laughable. They called me @ 0855 hrs September 26,2008 but didn't leave a message, so I called back the number on caller ID.

I got thru and asked them what their call was in reference to and it was a debt the LVNV/Resurgent Capital had placed with their office, after I had sent them a Cease Comm letter on the 27th of August.

I spoke to a Susan Forest with their outfit and had to laugh at her ignorance of FDCPA laws after I advised her that I knew her company was an associate company of LVNV/Resurgent Capital, and that they were issued a cease comm letter. I also advised her that her company was not the original creditor and that I didn't have to talk to or deal with them. She asked me who she could talk to about the alleged account. I told her no one again, as I told her I that I didn't have to deal with a 3rd party collector. She kept talking over me that I better go back and read the law. I then advised her that I was recording the call...we get to do that in Texas without notifying the other party or asking their permission...and it got her all flustered, so she hung up on me. I love it!

So, I immediately sent them the famous Cease Communication letter via fax explaining to them that they are not the original creditor, I do not have to talk to them or deal with them, that they are not to call me or harass me any further by phone, fax, mail, email or any other means.

You can fight these people. Richard J Boudreau is licensed to practice law only in Massachussetts, not New Hampshire. He does have "licensed" attorneys in his office in New Hampshire, however, I betting they don't do a whole lot of litigation.
